Ben Frissell 1555 North 17th Avenue Greeley, CO 80631 RE: Approval: Waiver from the requirements of Section 30-20-1408, C.R.S. and 6 CCR 1007-2, Part 1, Section 10.3 of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2, Part 1 for the Weld County Department of Public Works SW WLD GEN 2.5 Dear Mr. Frissell, The Colorado Department of Public Health and Environment Hazardous Materials and Waste Management Division (the "Division") received a waiver request on March 17, 2016 from the Weld County Department of Public Health and Environment on behalf of the Weld County Department of Public Works, requesting a waiver from Waste Tire Hauler requirements. The Weld County Department of Planning Services is offering a one day clean-up event on May 7, 2016 from 8:00 am to 3:00 pm at the Senior Citizens Park located on Yosemite Drive between Glacier Drive and Yellowstone Drive. The clean-up event is for Hill-N-Park area property owners located. It is anticipated that waste tires will be collected at this event and removal of these tires would be required. The Weld County Department of Public Work would remove the waste tires and take them to an approved waste tire destination facility. Registration as a Waste Tire Hauler is required for any person who hauls ten (10) or more waste tires at a time. Your letter requesting that the Weld County Department of Public Works should be granted a waiver from the Waste Tire Hauler registration requirements in Section 30-20-1408, C.R.S. and 6 CCR 1007-2, Part 1, Section 10.3 of the Regulations Pertaining to Solid Waste Sites and Facilities, 6 CCR 1007-2, Part 1 ("the Regulations") stated the following reasons: 1) The Weld County Department of Public Works is not registered as a Waste Tire Hauler due to their limited involvement in waste tire removal activities. If or when such removal is necessary it consists of no more than a single waste tire or two at a time. This is a special one-time event may produce sufficient quantities of waste tires that would require removal. 2) Accommodations have been made with CH2E/Hudson Tireville Operations Company, a registered waste tire monofill and waste tire processor with the Division, to accept the waste tires at their facility. The required WT-2 manifests will be filled out by CH2E as waste tires are dropped off at the facility. All completed WT-2 manifests will be provided to the Weld County Department of Public Health and Environment once the clean-up event has ended. CH2E has agreed to take the waste tires, free of charge, under the following conditions: (1) no more than 1,000 individual tires; (2) only passenger tires with rims removed; (3) passenger tires with no more than a 22: rim diameter. The Division may issue a waiver relating to any of the provisions of the Strategies for Waste Tires, 30-20-1401 et. seq., C.R.S. and the Regulations. Based on a review of this information, the Division approves a waiver from the from the Waste Tire Hauler registration requirements in Section 30-20-1408, C.R.S. and 6 CCR 1007-2, Part 1; Section 10.3 of the Regulations.
