Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: A Site Specific Development Plan and Use by Special Review Permit for any Use Permitted as a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or Industrial Zone Districts (manufacture/handcraft organic skin care products, catering kitchen, office, event center for classes, retreats, weddings, day spa, greenhouse, and warehouse) provided that the property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions, processing, one (1) single-family dwelling unit per lot other than those permitted under Section 23-3-20.A. (second single-family dwelling unit), and multi -family dwellings for persons principally employed at or engaged in farming, ranching or gardening (6 -unit multi -family dwelling) in the A (Agricultural) Zone District. This project is west of and adjacent to CR 53 and is north of CR 4. Parcel number 147529100015. Access is from CR 53. Access: An access permit has been approved for the access to the site (AP16-00315). AP16-00315 Special Requirements or Comments: "Parcel 147529100015. Utilize NEW access point on CR 53 (1 -Small Commercial) located approx. 4400 ft. North of CR 4." Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users. Roads: County Road 53 is a paved road and is designated on the Weld County Road Classification Plan as a local road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. The County Road 6 Section Line is estimated to have 60 feet of unmaintained section line right-of-way per the Weld County GIS right-of-way map. The applicant shall delineate the existing right-of-way on the site plan. All setbacks shall be measured from the edge of right-of-way. Traffic: Latest ADT on CR 53 was taken on 10/15/2013 which counted 134 vpd with 17% trucks. A traffic narrative was submitted with the application materials and indicated that there will be approximately 42 daily roundtrips. The expected traffic routes are CR 12 to CR 53 & CR 4 to 53 and distribution of traffic is estimated to be 75% from south & 25% from north. The site will have 12 employees working on a 9am- 5pm on Tues-Thurs & 1pm-10pm Fri -Sun. The traffic information submitted with the application materials indicated that there will be approximately 42 daily roundtrips. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. 20 to 50 passenger vehicle round trips/day or less than 4 truck round trips/day: • Access onto gravel roads includes 50 ft of road base or recycled asphalt. • Access onto paved roads includes 100 ft of road base or recycled asphalt. *Recycled concrete is not allowed in County ROW **Tracking control devices can be double cattle guards or other specialized device *** Tracking control for unmaintained public ROW is required just prior to entering publically maintained roadways. A development standard will be included on the recorded site plan. The access shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking." A variance request for alternatives to the above tracking control can be submitted to the Traffic Division of Public Works for review and consideration. Improvements and Road Maintenance Agreement: No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or 50 round passenger vehicle trips/day or if defined as a Site Plan Review (SPR). A development standard will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. The access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. CONDITIONS OF APPROVAL: A. The plan shall be amended to delineate the following: 1. The property owner shall control noxious weeds on the site. (Department of Public Works) 2. The access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. (Department of Public Works) 3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized. COMMENTS: General Project Information/Location: Project description: Event Center and Skin Care This project is west of and adjacent to CR53 and is south of CR6. Parcel number: 147529100015 Drainage Requirements: Please contact Department of Planning Services/Engineering Development Review for questions or assistance for drainage requirements at 970-353-6100. URBANIZING VS NON -URBANIZING DRAINAGE AREA: This area IS within a Non -Urbanizing Drainage Area: Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -URBANIZING areas. Detention Pond summarized in a Drainage Report: A Drainage Report has been submitted for review. The drainage report must include a certification of compliance stamped and signed by the PE which can be found on the engineering website. General drainage report checklist is available on the engineering website. More complete checklists are available upon request. MS4: This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized area with state mandated, higher water quality requirements Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692- 3575. Geologic Hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a FEMA regulatory floodplain. CONDITIONS OF APPROVAL: A. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required. (Department of Planning Services -Engineer) B. The plan shall be amended to delineate the following: 1. The applicant shall show and label the accepted drainage features and drainage flow arrows. Water quality features or stormwater ponds should be labeled as "Water Quality Feature/Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume. An individual well (permit 79178) which is permitted for "commercial, irrigation and domestic use" will be utilized. A septic design done by Soilogic dated June 10, 2016 was submitted and stated: "At this time, we understand twelve (12) full-time employees, 250 short-term visitors and one (1) single -bedroom apartment are expected to generate wastewater once the event center facility is fully operational. A total average design flow of 1505 gallons per event was calculated for the subject property based on the information provided above. Response PIP: 9/I -304-64/U Fox, 970.304.6452 Public Health time we understand 3 to 4 events per week are anticipated. As a precaution, the system was sized assuming one (1) event per day. The proposed septic system design would be capable of accommodating additional wastewater flow generated by future building improvements including seasonal -worker housing. Further evaluation of existing and proposed wastewater design flow would be needed at that time." The application states that only non-toxic materials are used in processing the skin care products and a small amount of water is utilized. The septic design must include additional sizing for any process water if necessary. If the septic system requires a design capacity of over 2,000 gallons of sewage per day the applicants shall ensure all requirements of the Colorado Department of Public Health and Environment, Water Quality Control Division's (WQCD) Regulations have been adhered to. All food vendors and food preparations must adhere to the Colorado Retail Food Establishment Rules and Regulations. We have no objections to the proposal; however, we recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust shall attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone District, as delineated in Section 14-9-30 of the Weld County Code. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Onsite Wastewater Treatment Systems. 7. In the event the septic system requires a design capacity of 2,000 gallons or more of sewage per day the applicants shall adhere to the requirements of the Colorado Department of Public Health and Environment, Water Quality Control Division's (WQCD) Regulations. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the existing private water supply (permit 79178). 9. In the event the facility's water system serves more than 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). If not subject to these requirements, the Weld County Department of Public Health and Environment strongly encourages well users to test their drinking water prior to consumption and periodically thereafter. 10. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations governing the regulation of food service establishments. 11.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code.
