SUBJECT: USR15-0074, Messick Dog Kennel
The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
General Project Information/Location:
Applicant is proposing a dog rescue
This project is north of CR 100
Parcel number 045329400024. Access is from CR 100.
Access:
An access permit has been approved for the access to the site (AP15-00565).
Roads:
County Road 100 is a paved road and is designated on the Weld County Road Classification Plan as a
collector road, which requires 80 feet of right-of-way at full buildout. The applicant shall delineate on the
site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future
right-of-way. This road is maintained by Weld County.
Traffic:
Latest ADT on CR 100 was taken on 5/2014 which counted 1517 vpd with 18%trucks.
The traffic information submitted with the application materials indicated that there will be minimal traffic
with less than 20 passenger vpd.
TRACKING CONTROL:
Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
Less than 20 passenger vehicle round trips/day, no upfront tracking control requirements.
Improvements and Road Maintenance Agreement:
No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day
or 50 round passenger vehicle trips/day. A development standard will be applied to the recorded plan
indicating any impacts to the road must be mitigated by the owner. There shall be no tracking from the
site onto publically maintained roads. The applicant is responsible for mitigation of any damage or offsite
tracking and upgrading and/or maintaining onsite tracking control.
Drainage Requirements:
Detention pond waived and a simple drainage narrative:
Exceptions.
1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and
welfare of public and private property and shall be limited to the following:
a. No stormwater detention will be required for sites that meet any of the following
conditions. Requirements of the Municipal Separate Storm Sewer System (MS4)
areas remain applicable.
8) Development of sites where the change of use does not increase the
imperviousness of the site.
Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL:
A. The plan shall be amended to delineate the following:
1. Show and label the approved access (AP15-00565) on the site plan. (Department of Planning
Services-Engineer)
DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Department of Planning Services-
Engineer)
2. The site shall be maintained to mitigate any impacts to the public road including damages and/or
offsite tracking. (Planning and Engineering)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. The historical flow patterns and runoff amounts will be maintained on the site. (Department of
Planning Services-Engineer)

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for a Kennel (dog and cat rescue
facility with a maximum of 50 cats/dogs) in the A (Agricultural) Zone District.
The existing residence is served by an individual domestic well (244947) and a septic
system sized for 4 bedrooms (SP-0300166).
The applicants have applied to the State Division of Water Resources to change the use
of the existing well to include commercial. The applicants applied for a septic permit
(SP-1500326) for domestic use on September 23, 2015. The permit has not been
issued as an engineer design is required for commercial use.
A Pet Animal Care Facilities Act (PACFA) application has been submitted to the
Department of Agriculture. The waste handling plan states that animal waste is picked
up and placed in a dumpster every day which is serviced by Gallegos Sanitation. Noise
will be restricted to Residential levels.
We recommend that the following conditions be part of any approval:
Prior recording the plat:
1. A copy of the Pet Animal Care Facilities Act (PACFA) license, from the Colorado
Department of Agriculture, shall be provided to Environmental Health Services,
Weld County Department of Public Health & Environment.
2. Septic permit SP-1500326 shall receive final approval from Environmental Health
Services, Weld County Department of Public Health & Environment. The system
shall be installed and permitted according to the Weld County Onsite Wastewater
Treatment System Regulations (OWTS).
3. The applicant shall submit a copy of a commercial well permit to Environmental
Health Services, Weld County Department of Public Health & Environment.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized.
2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
5. Fugitive dust should attempt to be confined on the property. Uses on the property
should comply with the Colorado Air Quality Commission's air quality regulations.
6. The facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S.
7. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to On-site WasteWater Treatment Systems.
8. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. The facility shall utilize the
existing private water supply (commercial well).
9. The applicant shall comply with the Colorado Department of Agriculture (CDA),
Division of Animal Industry regulations.
10.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Subject: USR15-0074 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV15-00118)was noted. This
violation was initiated due to the operation of a kennel (too many household pets)without first completing
the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court
Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual
court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints. I can comment that I have spoken to at least 3
(three)separate neighbors initiating complaints regarding this operation.
This violation was initiated on August 28, 2015.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, all but 7 (seven) dogs over the age of 6
shall be removed from the property 30 (thirty) days of denial or the violation will proceed in court
accordingly.
