HomeMy WebLinkAbout20161585.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MAY 16, 2016 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, May 16, 2016, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of May 11, 2016, as printed. Commissioner Cozad seconded the motion, and it carried unanimously. • READ ORDINANCE BY AUDIO: Commissioner Cozad moved to read Code Ordinance #2015-25 by audio. Commissioner Conway seconded the motion, which carried unanimously. eJ CERTIFICATION OF HEARINGS: Commissioner Moreno moved to approve the Certification of Hearings conducted on May 11, 2016, as follows: 1) USR16-0003- Roger and Sheryl Hill. Commissioner Conway seconded the motion, which carried unanimously. CI AMENDMENTS TO AGENDA: There were no amendments to the agenda. CI CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. PROCLAMATIONS: • 1) WELD COUNTY POLICE OFFICERS WEEK - MAY 15-21, 2016, PEACE OFFICERS MEMORIAL DAY - MAY 15, 2016, AND WELD COUNTY FALLEN OFFICER MEMORIAL TRIBUTE CEREMONY - MAY 19, 2016: Chair Freeman read the proclamation for the record. Sheriff Steve Reams accepted the award on behalf of the Weld County Sheriffs Office and expressed his appreciation for the recognition. He further stated this proclamation and Memorial Tribute Ceremony is part of the healing Minutes, May 16, 2016 2016-1585 1/ Page 1 BC0016 process for the loss of police officers killed in the line of duty. Each one of the Commissioners expressed their gratitude to the department and their shared grief over the slain police officers in our community and beyond. They further recognized this proclamation and memorial as an opportunity to remember those who risk their lives every day and commend the hard work of those who serve. Each Commissioner thanked Sheriff Reams and all officers for keeping the citizens safe and putting their lives on the line and remembering fallen officers that were killed in the line of duty. (Clerk's Note: The Board paused for a photo opportunity.) 2) PROCLAMATION OF APPRECIATION - MIKE KETTERLING, KBN ENGINEERING: Chair Freeman read the proclamation for the record. The Board extended their thanks and appreciation to Mr. Ketterling for always giving back to the community and making Weld County a better place to live. Additionally, they recognized him for his work on Island Grove Regional Park. Mr. Ketterling stated it is an honor and a privilege to live and work in Weld County. (Clerk's Note: The Board paused for a photo opportunity.) IR PUBLIC INPUT: No public input was given. BIDS: CI 1) PRESENT BID #B1600097, ROAD BASE SUPPLY (CLASS 6) - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, presented the three (3) bids received and stated staff will bring back a recommendation on June 1, 2016. NEW BUSINESS: 12 1) CONSIDER AGREEMENT FOR WIRE/CABLE LINE CROSSING LICENSE AND AUTHORIZE CHAIR TO SIGN - GREAT WESTERN RAILWAY OF COLORADO, LLC: Aleksei Churyk, Department of Information Technology, stated this agreement will allow the installation of cabling for data and voice communications to the Chase Building, and the cabling will cross the railroad track at 9th Avenue. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Cozad, carried unanimously. el 2) CONSIDER AGREEMENT FOR SOFTWARE DEVELOPMENT AND PROOF OF CONCEPT AND AUTHORIZE CHAIR TO SIGN - SUNGARD PUBLIC SECTOR, LLC/ID NETWORKS, INC: Mike Wallace, Director of the Department of Public Safety Communications, stated a presentation will be done for this pilot interface the first week of July. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Moreno, and it carried unanimously. el 3) CONSIDER THREE (3) AGREEMENTS FOR COMPENSATION FOR DAMAGE TO STRUCTURES WITHIN 200 FEET OF MINING ACTIVITIES (PETERS 313 GRAVEL PIT) AND AUTHORIZE CHAIR TO SIGN: Valerie Mino, Department of Public Works, stated the agreement is required by the Division of Reclamation, Mining and Safety as part of the mining permit process, and that Weld County will be responsible for any damages that occur as a result of mining activity. In order to protect these structures, a fence will be placed around the area to be mined. Ms. Mino explained that five (5) buried pipelines will be covered under this agreement. Commissioner Kirkmeyer moved to approve said agreements and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. O 4) CONSIDER TEMPORARY CLOSURE OF CR 53 BETWEEN CRS 54.25 AND 54.5: Janet Lundquist, Department of Public Works, reviewed the details of the closure effective June 6, 2016, Minutes, May 16, 2016 2016-1585 Page 2 BC0016 through June 24, 2016, for a bridge re-deck and stated they will be using message boards in advance and standard road signs and barricades. Commissioner Kirkmeyer moved to approve said closure. Seconded by Commissioner Conway, the motion carried unanimously. PLANNING: CI 1) FIRST READING OF CODE ORDINANCE #2015-25, IN THE MATTER OF REPEALING AND REENACTING WITH AMENDMENTS, CHAPTER 23 ZONING (WATER LINES), OF THE WELD COUNTY CODE (CON'T FROM 5/9/2016): Tom Parko, Director of Department of Planning Services, explained the details of the changes for Chapter 23, regarding water transmission lines. He reported modifications and changes were made to the Ordinance after input was received at Stakeholders Meetings from municipalities, special districts and ditch companies. Mr. Parko reviewed the language that was modified in Section 23-1-90 concerning domestic water. Commissioner Kirkmeyer stated at the stakeholders meeting paragraph C. was removed. a Dan Brown, Attorney representing several irrigation companies, stated he was one of the parties requesting the removal of paragraph C to avoid unintended consequences during business operations. Mr. Brown expressed the language of paragraph C is still confusing, and would like clarification on what is being transported. Alyson Meyer Gould, explained she represents the owners of the Henrylynn Ditch Company, which lie between Adams County and Weld County and she detailed how the Henrylynn Irrigation Ditch could be affected by this code. Jim Witwer, attorney for the City of Greeley, expressed his thanks and appreciation to the Commissioners and staff for the Stakeholders Meetings to work with the municipalities on their upcoming projects. Commissioner Kirkmeyer thanked Mr. Witwer and the City of Greeley for their participation in the process and attendance at the Stakeholders Meetings. 12 Commissioner Cozad stated after reading paragraph C., this would protect agricultural water, and would propose leaving the language in. Commissioner Moreno thanked everyone for their input to help staff find the correct language. Commissioner Kirkmeyer moved to approve on First Reading Code Ordinance #2015-25. Commissioner Conway seconded the motion, and it carried unanimously. Commissioner Kirkmeyer expressed this sends the messa a that agriculture is important and protecting property surface owners is important to Weld County. Commissioner Conway explained this started from seeking a solution on how to protect Weld County agriculture. Commissioner Cozad thanked everyone for coming to the Stakeholders Meetings. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2015-25 was approved on First Reading.
