Proposed use of the property: Presently the property is a certified organic dairy operating under an existing USR (See Attached). This request to amend the USR is associated with an application for a Recorded Exemption on the property. Once amended , the proposed Lot B of the Recorded Exemption may continue to be used as a dairy under the existing USR along with the following additional uses: 1 ) Community Supported Agriculture (CSA); 2) Self-storage (both enclosed and open); 3) A new single family home site in addition to the existing caretaker's residence. The vast majority of Lot B will remain as farmland that will support the CSA operation and/or other agricultural uses. A new building site for a single-family residence will be included within Lot A. CSA Land Uses: The eastern side of Lot B will be dedicated to a Community Supported Agriculture (CSA) operation that will include garden areas for food and decorative plants, greenhouses, tool and equipment storage buildings, equipment maintenance shop, garden retail center, livestock area , garden caretaker quarters (mobile home) and other areas and/or facilities that support the CSA operation . Most of this area will be seasonal , opening in March and tapering off in early November. An area for livestock, associated with the CSA and/or dairy, is also proposed for a portion of the site. Self-storage Uses: There is a large existing barn/storage building on site that will be utilized for enclosed vehicle and equipment storage. Additional enclosed storage is proposed around this building configured as a typical self-storage facility. Boats, RV's and other vehicles will be stored in an open storage area on the west side of the barn , screened from view by the barn and privacy fencing . This entire area will be fenced and secured by a gate at a single point of entry. The existing home will house the caretakers/managers of the self-storage areas. This area will be open year-round with the majority of activity occurring in late spring , summer and early fall . 2. How this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan: This proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan in the following ways: 1 . The site will remain the current agricultural zone designation to maintain agricultural opportunities for the future per A.Goal 1 . Existing buildings will be used in order to minimize the built areas on the parcel (A. Goal 5). 4. This site can support the conversion of agricultural land and the proposed use is compatible with the region (A.Goal 7). 5. Adequate existing sanitary sewage and water systems area available for the site, surrounding roadways are adequate to serve the proposed land-use and the existing storm water management will not change since the site will be used in an `as-is' condition (A.Goal 8). 6 . Natural site features such as topography and watercourses will be conserved since the site will be used in an `as-is' condition (A.Goal 9). 3. How this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located: The current zoning is Agricultural with a USR for the site. The zoning and USR will remain the same for this site, except for the addition of uses allowed under the Amended USR and the abandonment of the USR from Lot B of the Recorded Exemption . The uses, buildings and structures will be operated and maintained in accordance with the requirements and procedures set forth in Section 23-3-20, Article II , Division 4, W. This allows for "uses similar to those listed as Uses by Special Review as long as the use complies with the general intent of the Agricultural Zone District". 4. Types of uses surrounding the site: Agricultural uses are located to the north and south of the site. Rural Residential is located to the west and Sub-Urban Residential to the east of the site. 5a/b. Number of people who will use this site: The existing single-family house will be used as housing for the on-site manager of the Self- storage facility. The mobile home will house the caretaker of the CSA operation . The number of people visiting the site will vary seasonally and the time any individual or group spends at the site will also vary according to their personal activities. Some employees or volunteers will tend the garden plots. Customers will stop by to pick up food baskets. Families may come to 'pick your own' corn , pumpkins, vegetables, flowers, etc. during the growing and harvesting seasons. Others using the site will include people periodically accessing the storage areas. The total number of people who will use the site at any given time will fluctuate. On average, we anticipate 1 -12 people on site at any given time. 5c. Hours of operation: Standard hours of operation are 7:00 am - 7:00 pm except for some special events and/or evening events, primarily during the summer. Hours for special/evening events would be no later than 9:30 pm with a maximum of 15 events per year. Special events might include cookouts, concerts, antique equipment shows, harvest days, holiday lighting and/or other seasonal activities. Legacy Farm Dairy 02. 13. 15 Page 2 5d . RVs, boats and other stored vehicles will also access the site. Small-scale farm equipment will also be on site. The frequency of site access will vary but large volumes of traffic are not anticipated . Public access to the site will be limited to one main entrance/exit from CR 68.5. Employee, emergency and fire protection will have one additional access from CR 68.5 and one other access from CR 13. Composting and diversion into an existing lagoon on the NE corner of the Property will handle dairy and livestock waste. Portable toilets will be provided for guests. If storage or warehousing is proposed, what type of items will be stored: There is an existing barn/storage building on site that is anticipated to be utilized for vehicle and equipment storage. Boats and RV's will be stored in the open storage area. The types of items anticipated in the self-storage (enclosed ) area will include typical household items. Some storage of business related items might also be stored in the enclosed storage areas. 6: Proposed landscaping: The site will be used in an `as-is ' condition. No new landscaping (except garden and flower beds) is proposed at this time. New perimeter and interior fencing will be installed for aesthetic and security enhancement. 7. Proposed reclamation procedures when termination of the Use by Special Review activity occurs. Not applicable. 8. Storm water drainage: The off-site and on-site drainage patterns will remain as-is. Minimal paving is anticipated and the footprints of any new improvements will replace the equivalent amount of existing footprints of concrete feeding troughs, agricultural outbuildings, paved silage pits and other non-porous facilities. Additional volumes of storm water are not anticipated . Storm water on the south side of the property will continue to flow into the barrow ditch associated with CR 68.5. Storm water on the north side will continue to flow into the lagoon/retention pond area in the NE corner of the entire property. This area will be improved to accommodate increased storm water retention and enhance water quality. A small portion of the North side flows NW with this storm-water retained and percolated into the ground. Please refer to the accompanying Storm Drainage Narrative prepared by Northern Engineering Services. 9. Time required to construct this site: We anticipate 4 to 6 months of construction in order to begin initial operations of any new uses. Additional buildings and greenhouses will be submitted by separate building permit. 10 . Storage and/or stockpile of wastes: Waste will be kept in dumpsters on-site. Regular waste removal will be scheduled with a local disposal company. Garden composting piles will be minimal . Proposed access to the property is in 3 locations. # 1 is on the west side of the Property and it accesses onto WCR 13 . #2 is on the south side of the Property and accesses onto CR 68.5, approximately splitting the property in half. #3 is also accessing CR 68.5 and is approximately 600' East of access #2 . Access #3 will be the primary access point for the activities associated with the USR. # 1 and #3 are access points for the building sites on the property as well as the acreage crop farming operations. Based on the uses proposed in the Amendment to the USR, it is anticipated that traffic activity will be minimal. The Community Sustainable Agriculture (CSA) use will have on-site caretakers to manage the garden areas and livestock. Periodically spread throughout the week, members of the CSA will drop by to collect their produce and other food. Due to the sporadic nature of these pick-ups and the small number of participants, it is difficult to predict any peak hour or non- peak hour impacts this traffic will have, but it should be negligible. The self-storage business traffic is also sporadic and should have negligible impact on traffic. Summer season is busier than off-season for RV's, boats and other recreational vehicles stored on site, but these moving in-and-out activities are typically spread out over different days of the week and different hours of each day. Typical household self- storage also has the same pattern of activity. The managers/caretakers of the self-storage business will be the only employees and will live on- site. Both uses will have typical business hours of operation; i.e. 7am opening to 7pm closing; closed Sundays. There will be periodic deliveries to both operations by trucks but these are anticipated to be infrequent. L VARIANCE REQUEST Legacy Farm Drainage July 27, 2015 1 . Describe the design criteria of the Weld County Code of which a variance is being requested . 2. Describe the proposed alternative with engineering rationale which supports the intent of the Weld County Code. 3. Meet the design intent of the Weld County Code. 4. Demonstrate that granting of the variance will still adequately protect public health, safety, and general welfare. 5. Demonstrate there are no adverse impacts, from stormwater runoff, to the public rights-of-way and/or off-site properties as a result of the project. As per Weld County Engineering and Construction Criteria dated April 2012, Section 5. 11 . 1 Detention Criteria : The elevation of the top of the detention pond embankment, except at the spillway, must be a minimum of 1 -foot above the 100- year water surface elevation in the detention pond . The applicant requests a variance to provide less than the required 1 . 0 foot of freeboard above the hydraulic grade line of the spillway for Detention Pond A. Freeboard will not be provided along the north property line to allow off-site runoff from the north to flow into the detention pond and allow off-site runoff to travel along its historical drainage pattern. The historic drainage basin (Off-site Basin F-3 in the Windshire Park Subdivision Final Drainage Study; see attached conceptual drainage exhibit) drains to a retention pond located in the northeast corner of the property with a top of berm elevation of approximately 4814.0_ The basin is composed of 22 . 1 acres of on-site area and 20.4 acres of off-site area draining from the property to the north . Under current conditions during a major storm if the retention pond capacity is exceeded the retention pond will overtop and spill to 17th Street to the east. The lowest elevation point located along the property line to the north is 4812. 38 and the properties share nearly 680 feet of property below 4814. 00. Under existing conditions this would result in approximately 1 .62 feet of ponding occurring on the property to the north . The proposed emergency overflow spillway will discharge into the 17th Street right-of-way (ROW) and the minimum bottom of spillway elevation is set based on the elevation of the top back of curb in the street, which is approximately 4812.69. The 100-year developed peak on-site flow is 21 .6 cubic feet per second (cfs) . The off-site flow was determined to be 20.4 cfs assuming 1 . 0 cfs per acre for 20.4 acres. The spillway is designed to convey the developed peak on-site and off-site flows totaling 42.0 cfs. Approximately 0.57 feet is required to pass the spillway discharge. Using the minimum bottom of spillway elevation, spillway depth and providing 1 .0 foot of freeboard sets the top of berm elevation at 4814. 26 (4812.69 +0.57'+ 1 . 00') with a maximum water surface elevation of 4813.26 . Providing the top of berm elevation of 4814. 26 can easily be achieved on the east, west and south sides of the pond . Because of issues arising from the low elevation of the property line shared with the property to the north, three pond configurations were considered . Configuration one: provide a pond berm along the north property boundary to the minimum top of berm elevation and reroute the off-site flows from the north along the south side of our property boundary north of the proposed pond berm . One foot of freeboard would be provided in the pond and very little ponding would occur on the property to the north. This option was not acceptable because historical drainage patterns would be disturbed and additional sediment would be discharged into the 17th Street ROW. Configuration two: provide a pond berm along the north property boundary to the minimum top of berm elevation and attenuate the flow from the north into the pond using a storm pipe with a check valve to prevent backflow when the pond is full. One foot of freeboard would be provided in the pond and historical drainage patterns would be kept. This option was not acceptable because in a 100-year storm ponding would occur on the property to the north and logistical and maintenance considerations with attenuating 20.4 cfs of off-site flow via a storm pipe. Configuration three (see attached detention pond exhibit): do not provide a berm to the north , but increase the pond volume by two times to minimize use of the spillway and reduce the ponding depth to the north. This would not disturb the existing drainage patterns of flow traveling from the north. By doubling the pond volume, the pond volume approximates the pond volume required for both on-site and off-site detention, because the on-site basin area is approximately equal to the off-site basin area. In a 100-year storm the emergency overflow spillway would not be utilized and pond would fill to the bottom of spillway elevation of 4812.69. This would result in 0. 31 feet of ponding on the property to the north. If two major storm events were to occur back to back the emergency overflow spillway would activate and would result in 0. 70 feet of ponding on the property to the north , which is not ideal but is an improvement when compared to the approximately 1 .62 feet under existing conditions. jl ,a t r. The project is located just northeast of the intersection of County Road 13 and County Road 68.5 . Existing Site The existing Legacy Farm site consists of a dairy farm, including barns, storage sheds, milking areas, a storage silo, and a large pasture area. Additionally, a large area of the existing site is cultivated farmland. Overall, the site encompasses roughly 50.4 acres. Proposed Project The proposed development will involve some demolition of a few of the existing barns and removal of a portion of concrete paved drive areas. The large barn, located just north of the storage silo, will be converted to accommodate enclosed storage. Additional enclosed or covered storage areas will be constructed on the east and west side of the barn, with outdoor storage also west of the barn. A large garden area will be completed just north of the barn and silo, surrounded by existing gravel drives and parking areas that served the dairy. No changes to basin delineation occur between existing and proposed conditions, as no significant grading is proposed which would alter drainage patterns. Basins are illustrated in the Drainage Exhibit provided in Attachment 1. A copy of the amended USR site plan is also provided, for complete description of the proposed development. • Basin #1 Basin #1 is the largest of the basins and the uses depicted on the site plan will not impact the drainage patterns or stormwater flows. Impermeable surface will be reduced in Basin #1 since the feedlot operations and other livestock areas presently within this basin have significant areas of concrete slab adjacent to the pens that have been used for feeding. There is also a large open silage pit that is paved with asphalt. The concrete and asphalt will be removed and the surface will be returned to permeable planted areas or gravel. All interior drives will remain dirt/gravel. Surface runoff will be conveyed via sheet flow generally south to the north roadside ditch of CR 68.5 and then be conveyed west to an existing culvert under CR 68.5 . • Basin #2 Basin #2 drains to an existing retention pond in the NE corner of the property. A portion of the adjacent land to the north also drains into this pond . There is no historic release for this stormwater currently. A detention pond has been designed in this area, with release from the pond tying in to a storm line system located in adjacent Right of Way of 17th Street. Basin #2 has large areas of concrete slabs and outbuildings used as part of the existing dairy operations, all contributing to stormwater flows within this basin. Historically, the pond has also received all the wastewater from the livestock feeding pens and barn, as well as the cleaning and processing water from the dairy operations. 2 The unimproved pasture area included in this basin also contributes stormwater to the pond . The reduction of livestock on the overall property and the commensurate reduction in size of the dairy operation will significantly reduce the amount of water flowing into this pond and also improve the water quality in the pond. • Basin #3 Basin #3 is a small area that historically drains to the northwest corner of the property. CR 13 obstructs any water from this parcel from discharging off-site, so stormwater and irrigation water is retained and percolates into the soil. No use changes are proposed for this portion of the property; therefore, no changes to existing runoff quantities or patterns will occur. Hydrologic Modeling and Detention Pond Storage The computer program EPA SWMM has been utilized to model the 100-year storm event. Key input parameters for this model are basin percentage imperviousness, soil infiltration parameters, and surface storage parameters. The basis of parameter selection is the Urban Storm Drainage Criteria Manual, by the Urban Drainage and Flood Control District. Tables 3 through 5, below, have been used for parameter selection . Because there are very minimal changes proposed with Basin #1 ( imperviousness is slightly reduced), and no changes in imperviousness or general drainage patterns proposed with Basin #3, we have not modeled runoff and compared existing to proposed runoff quantities. Basin #2 has been modeled in the computer program EPA SWMM in order to provide runoff peak rates and volumes. Utilizing EPA SWMM , we have also determined a required 100-year volume of 1.41 Acre-Feet for the proposed detention area at the northeast corner of Basin #2. This detention pond is proposed to be expanded to double the required the 100-yr volume, since it does not meet the 12-inch freeboard requirements . A variance request has been made by separate document. Additionally the lower stage of the pond will provide 0. 121 Acre-Feet of water quality capture volume . Per the Final Drainage Report for Windshire Park, Section 5.2 : "Offsite flows from Basins Fl-F4 (SWMM Basins 601-604) will be conveyed through the site to Pond 1. Historic 10 year flows (0.24 cfs/acre)from these basins will he routed through the outlet of Pond I and into the regional storm line trunk in County Road 15 (15th Street). Historic100 year flows from these basins will be conveyed by the emergency spillway for Pond 1 and into County Road 68 54 (Jacoby Road). Basin F-4 will drain to storm Line 1, which has been designed to take up to the historic 10 year flow from this basin of 0.24 cfs/acre. Basin F-3 will drain to Storm Line 11, which has also been designed to take up to the historic 10 year flow of 0.24 cfs per acre from this basin. " 5 We will release at a rate below the 5-year historic rate per Weld County Criteria, which we have calculated to be 6.2 cfs . With this release rate, we have calculated a required 100-year pond volume of 1.41 ac-ft. This volume has been doubled, with the pond being designed to hold 2.82 Acre-Feet of storm runoff at a water surface elevation of 4812.69. Please see Attachment 3 for EPA SWMM modeling output. The project is located just northeast of the intersection of County Road 13 and County Road 68.5 . Existing Site The existing Legacy Farm site consists of a dairy farm, including barns, storage sheds, milking areas, a storage silo, and a large pasture area . Additionally, a large area of the existing site is cultivated farmland . Overall, the site encompasses roughly 50.4 acres. Proposed Project The proposed development will involve some demolition of a few of the existing barns and removal of a portion of concrete paved drive areas. The large barn, located just north of the storage silo, will be converted to accommodate enclosed storage. Additional enclosed or covered storage areas will be constructed on the east and west side of the barn, with outdoor storage also west of the barn . A large garden area will be completed just north of the barn and silo, surrounded by existing gravel drives and parking areas that served the dairy.
