WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 14th day of March, 1977, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
a certain parcel of land, being the property of George Salis-
bury of Horses Unlimited in Weld County, Colorado, more par-
ticularly described as follows:

A tract of land situate in the Southwest 1/4 of Section 11, Township 2 North, Range 68
West of the Sixth P.M. , Weld County, Colorado, which considering the North line of the

Colorado, desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, and Section 2-1A (3) of the Weld County Subdivision
Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by George Salisbury of Horses Unlimited,
be exempt from the definition of the terms, "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101 (10)
(d) , CRS 1973, as amended, and Section 2-lA(3) of the Weld County
Subdivision Regulations.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 14th day of
March A.D. , 1977.
The above and foregoing Resolution was read into the record

RE: Recorded Exemption #248
Dear Commissioners:
The attached application, plat and related items are in reference to
a request by George Salisbury of Horses Unlimited.for a recorded
exemption. The parcel of land in question is described as part of
the SW* of Section 11, T2N, R68W of the 6th P.M., Weld County, Colorado.
The subject property contains 35.1567 acres of Class III irrigated soils.
The prvpeity in question is located * miles south of Del Camino on the
east side of Interstate 25.
The request is to split the property into parcels of 10.2865 acres and
24,8697 acres. The entire property is presently zoned cammercial.
Colorado Crane currently leases and utilizes the 10.2865 acre parcel
as a heavy equipment storage and sale yard. Mr. Salisbury ultimately
intends to subdivide the remaining 24.8697 acre parcel for connercial
development. At present he is uncertain as to the dimensions and numbers
of lots he would desire to create out of the remaining 24.8697 acre par-
cel.
Based upon the information submitted and the adopted policies in the
county, the Planning flnn,ission staff recommends the request be approved
for the following reasons:
1. The lease and use of the 10.2865 acre parcel by Colorado Crane for
an equipment storage and sale yard has already been established.

Dear Mr. McWilliams:
Per our phone conversation, the appropriate test data
has been forwarded to Mr. Paul for his evaluation. With respect
to item 2 of your January 31 letter, I would comment on behalf
of Mr. Salisbury as follows:
The reason for splitting the property is the fact that
the present lessees, Colorado Crane, want to utilize and
develop the 10 acre parcel and make substantial building improve-
ments which they are only willing to do if they are the owners.
The balance of the acreage would ultimately be subdivided by Mr.
Salisbury and sold in individual lots for light industrial or
light commercial use. The exact dimensions and number of the
lots are uncertain but my present estimate is that the site sizes
would be approximately 21 to 5 acres in size. If Mr. Salisbury
were to locate a user for the balance of the parcel, then he would
not subdivide it, but I believe it is not economically feasible
to sell the balance of the parcel except to an extraordinarily
large user, the majority of which users prefer to locate closer
to urban centers or to regional trade centers such as Greeley,
Fort 'Collins, etc.
Mr. Salisbury and I will be present at the hearing and
would be glad to elaborate further if deemed advisable by the
Commissioners.

In response to your letter of December 27 , 1976 ,
please find enclosed the following:
1. Original copy of the application for recorded
exemption signed by George Salisbury, III as General Partner
for Horses Unlimited.
2 . Certificate of Conveyances issued by Stewart
Title Company with appropriate attachments.
3. A plat of the proposed land division including a
complete and accurate legal description of the property in a
form which complies with Weld County Planning Commission pro-
cedural guidelines with appropriate certification.
4. Evidence that an adequate supply of domestic water
can be made available by virtue of the enclosed letter from
the Central Weld County Water District.

With refenence to the question set forth in the applica-

On or about May 20 , 1976, on a contract for deed, Horses Unlimited
sold 35. 201 acres directly to the east of the property described
in the survey to William F. Murphy and Terry Gillatt, which
conveyance was made in conformance with the laws of the State
of Colorado and County of Weld by virtue of both the sold parcel
and the remaining parcel being in excess of 35 acres . As you
know from previous discussions, the petitioner and his present
lessees are extremely anxious to get this matter processed, and
I would appreciate your calling me collect when the application
is completed and when further steps, if any, need to be taken.
