Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Planning Services Engineer representative, Wayne Howard Public Works Department representative, Janet Lundquist Health Department representative, Lauren Light The following business was transacted: IE I hereby certify that pursuant to a notice dated February 16, 2016, and duly published February 19, 2016, in the Greeley Tribune, a public hearing was conducted to consider the request of Mark and Jennifer Phillips, for Resubdivision, RES15-0002, to divide Lot 3 of Olinger Subdivision of Garden Tracts into two lots. Bob Choate, Assistant County Attorney, made this a matter of record. le Diana Aungst, Department of Planning Services, presented a brief summary of the proposal to divide an 8-acre lot into two (2) 4-acre lots. She stated 14 referrals were sent out and 11 agencies indicated no concerns or did not respond. She reviewed the site location and the history of the other lots in the subdivision that remain in unincorporated Weld County and those that have been re-platted or annexed into the Town of Platteville. Ms. Aungst mentioned water service is to be provided by the Central Weld County Water District and septic is to be provided by individual on-site wastewater treatment systems. She reported no correspondence has been received regarding this application and the site is located within the three (3) mile referral area of the Towns of Platteville and Milliken, neither of which indicated any concerns. Ms. Aungst displayed images and entered the favorable recommendation of the Planning Commission into the record as written. (Clerk's Note: Some of the following comments by staff, the Board, and the applicant may refer to the Change of Zone application referencing COZ15-0006, heard just prior to this case and is for the same applicant.) 2016-0798 CC; CA,tr-PLPPUJI4C 3[9-9 PL2413 HEARING CERTIFICATION - MARK AND JENNIFER PHILLIPS (RES15-0002) PAGE 2 El Janet Lundquist, Department of Public Works representative, provided a brief overview of the transportation plans and requirements and stated the approved access is from County Road (CR) 25 with Approved Access Permit, AP#15-00580. Wayne Howard, Planning Services Engineer representative, stated engineering has no comments. Lauren Light, Department of Public Health and Environment, referenced the Change of Zone, COZ15-0006, and stated there are no additional requirements. e Jennifer Phillips, applicant, responded to Commissioner Conway stating there is interest in annexing her property into the Town of Platteville, but not at this time. In further response to Commissioner Cozad, Ms. Phillips stated public sewer is not available and she has letters from the Town of Platteville regarding access points and she also explained the circle drive in the corner of the property. In response to Commissioner Kirkmeyer, she confirmed they are building single family homes. El No public testimony was offered concerning this matter. Commissioner Kirkmeyer corrected Condition of Approval (COA)#1.B to read "The applicant shall attempt to address...". Ms. Aungst explained the requests of the Utility Board regarding easements. Commissioner Kirkmeyer corrected COA #1.D.1 to reflect new language approved by the Board. She further suggested deleting COA#1.D.6,#7 and #8. The Board agreed. In response to Chair Freeman, Ms. Phillips indicated they have reviewed, and agree to abide by, the Conditions of Approval, as amended. IR Commissioner Conway moved to approve the request of Mark and Jennifer Phillips, for a Resubdivision, RES15-0002, to divide Lot 3 of Olinger Subdivision of Garden Tracts into two lots, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval as amended and entered into the record. The motion was seconded by Commissioner Cozad, and it carried unanimously.
