HomeMy WebLinkAbout20162283.tiffRESOLUTION RE: ACTION OF THE BOARD CONCERNING REQUEST FOR INJUNCTION AGAINST MID PLAINS INVESTMENT, LLC, CIO RUSSELL RICHARDSON, FOR VIOLATION OF THE WELD COUNTY ZONING CODE - ZCV16-00020 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Mid Plains Investment, LLC, do Russell Richardson, is allegedly in violation of the Weld County Zoning Code, specifically utilization of a camper/trailer-RV as a dwelling unit, firewood sales and a non-commercial junkyard which is not permitted, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 20th day of July, 2016, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Mid -Plains Investments, LLC, do Russel Richardson, were not present or represented at said hearing, although all parties were notified of said hearing by the Zoning Compliance staff, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, and the recommendation of staff from the Weld County Department of Planning Services, and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to refer the matter to the County Attorney's Office for immediate action and staff is directed to pursue court action in the most efficient and expedient process, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the case against Mid Plains Investments, LLC, do Russell Richardson, be, and hereby is, referred to the County Attorney's Office for immediate action and staff is directed to pursue court action through the most efficient and expedient process. All this debris shall be removed from the site. Commercial uses that are operating prior to obtaining the required Weld County Land Use permits are immediately scheduled for a Violation Hearing before the Board of County Commissioners.
