WELD COUNTY COUNCIL
August 15, 2016
The Weld County Council met in full conformity with the Weld County Home Rule Charter,
Monday, August 15, 2016 at the Weld County Administration Building, Greeley, CO.
ROLL CALL: The meeting was called to order by Councilman Jemiola at 6:30pm and on
roll call the following members were present, constituting a quorum of members thereof:
Councilwoman Marge Klein
Councilman Brett Abernathy
Councilman Don Mueller
Councilman Jordan Jemiola
Councilman Charles Tucker
Also present: County Attorney, Bruce Barker, and Sarah Mundt, Council Secretary.
APPROVAL OF AGENDA: Councilman Mueller asked to add a discussion of the future
of the Weld County Council to the agenda. Councilman Mueller asked that the Clerk and
Recorder's Audit be reconsidered. Councilman Abernathy stated that he believes that
Councilman Mueller cannot bring forth the motion for reconsideration. Council Bruce
Barker was asked to advise. Mr. Barker believes that the two members who voted against
the motion, causing the motion to die, are the only members able to call for
reconsideration. Councilman Mueller presented Robert's Rules wording challenging the
Council advisement. Councilman Mueller asked again to add a reconsideration of the
Clerk and Recorder's audit to the agenda. The Board agreed to add the reconsideration
to the agenda.
APPROVAL OF MINUTES: July 18, 2016 Minutes: The motion was made to approve
the minutes by Councilman Tucker and the motion was seconded by Councilman
Abernathy and the motion carried.
PROGRAM REVIEW: Council Barker reviewed the current operations of his department
and the various roles he and his team of attorneys represent.
PUBLIC COMMENT:
Elisa Kunkle- Ms. Kunkel brought a letter to read before the Council. She stated she
would use the time needed to finish reading her letter, not adhering to the Public Comment
time limitation. During the reading, she challenged Councilman Abernathy and
Councilman Jemiola. After hearing council advisement, Ms. Kunkle was asked to end
her reading and leave the public comment podium.
Dave Munoz- Mr. Munoz stated he had concerns with the pay raises that were given to
the Commissioners. Mr. Munoz is also concerned about property values. He has seen

his property values raise $50,000 this year. He does not understand why. He is also
concerned about nepotism in the County. He is concerned about Bright Futures and
where the funds are going, "it's nice, but I thinks kids should work for what they have."
NEW BUSINESS:
• Resignation of Councilwoman Klein
• Councilwoman Klein read her resignation letter
■ Councilman Mueller moved to accept Councilwoman Klein's
resignation and thanked her for her service. The motion passed.
Applications to fill vacancy of District 3 Council Seat
■ The Council agreed to move on advertising and putting notice out to
fill the District 3 vacancy.
INFORMATIONAL BUSINESS:

• Pay Bills: Councilman Abernathy made a motion to pay the bills and the motion
was seconded by Councilman Tucker and the motion carried.

Mileage for Councilman Tucker $ 19.44
Mileage for Councilwoman Klein $ 68.04
Mileage for Councilman Abernathy $ 9.72
MOTION TO RECONSIDER: Councilman Mueller motioned to reconsider the audit of the
Clerk and Recorder's Office. Councilman Tucker seconded the motion. Councilman
Abernathy stated he has supported an audit, as long as other elected offices are
considered in the discussion. Councilman Tucker asked why the audit is being challeged
when Ms. Koppes has stated she welcomes an audit. Councilman Tucker wants to use
the funds the Council has to do an audit now. Councilman Mueller stated he would like
to reconsider a Performance and Operational Review, not an "audit."
The motion to reconsider the Clerk and Recorder's audit died in a 2:2 split
Councilman Mueller: Yes
Councilman Tucker: Yes
Councilman Abernathy: No
Councilman Jemiola: No
Councilwoman Klein: Recused
Councilman Mueller stated that he believes the Council may need to consider dissolving
if it cannot remain nonpartisan. Councilman Jemiola stated he would need to see a review
of the Weld County Charter to ensure an oversight of Elected Officials is still in place.

ADJOURNMENT: By acclamation, the meeting was adjourned at 7:26 p.m.
The next Regular Meeting of the Weld County Council will be on September 19, 2016 at
the Weld County Administration Building, Greeley, CO. Councilman Tucker will contact
DFA and/or WDA to present.
