WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 15th day of November, 1978 at 2 : 00 o' clock p.m. , for the purpose of hearing the petition of Henry Stencel, et al. , 2122 22nd Avenue, Greeley, Colorado 80731, requesting a change of zone from A-Agricultural to E-Estate District for the following described parcel of land, to wit: A part of the Northeast Quarter (NEq) , of Section 26, Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and more particularly described as follows: Beginning at the Northeast Corner of said Section 26 and considering the North Line of said Section to bear North 89°16'00" West, with all other bearings contained herein relative thereto: Thence North 89°16'00" West, along said North line, 128.80 feet to the True Point of Beginning; Thence continuing North 89°16'00" West, 399.30 feet; Thence South 00°08'20" Fast, 1,444.43 feet; Thence North 88°06'40" East, 471.83 feet to a point on the approximate West line of County Road #35; Thence North 00°08'20" West, along said line, 1,337.35 feet; Thence North 40°01'00" West, 112.84 feet to the True Point of Beginning. Mr. Stencel was represented at the hearing by his attorney Thomas Connell. Mr. Connell reviewed his clients application and answered questions from the Board. Mr. Robert Blehm, an adjacent landowner, commented of the drainage problems of the area and, though he is not against the COZ, he asked the Board to take the problem into consideration when considering the COZ and the final plat for the subdivision. After discussion, Commissioner Steinmark made a motion to approve the COZ subject to the recommendations of the Weld County Planning Commission. Commissioner Jacobucci seconded the motion and it carried unanimously. All five commissioners were present for the hearing. Surrounding area is farm land. However , this is within the development zone of Comprehensive plan . 4 . What features apply to the property requesting rezoning which make it logical to rezone this tract and not to rezone in a similar manner surrounding properties which may have like land use characteristics? This land is primarily pasture while surrounding land is primarily devoted to irrigated farming. 5 .
