BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
OCTOBER 24, 2016
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, October 24, 2016, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:
Commissioner Mike Freeman, Chair

Commissioner Steve Moreno

• MINUTES: Commissioner Cozad moved to approve the minutes of the Board of County
Commissioners meeting of October 19, 2016, as printed. Commissioner Conway seconded the motion,
and it carried unanimously.
• READ ORDINANCE BY AUDIO: Commissioner Cozad moved to read Code Ordinance #2016-13
by audio. Commissioner Moreno seconded the motion, which carried unanimously.
• CERTIFICATION OF HEARINGS: Commissioner Conway moved to approve the Certification of
Hearings conducted on October 19, 2016, as follows: 1) USR16-0029 - Reynaldo Bonilla, and 2)
USR16-0025 - Jose Barron. Commissioner Kirkmeyer seconded the motion, which carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed.
Commissioner Kirkmeyer seconded the motion, and it carried unanimously.

PRESENTATIONS:
• 1) RECOGNITION OF SERVICES, DEPARTMENT OF HUMAN SERVICES - EVANGELINE
SANDOVAL: Chair Freeman read the certificate for the record recognizing Ms. Sandoval's dedicated
service to the citizens of Weld County. Judy Griego, Director of the Department of Human Services,
thanked Ms. Sandoval for her many years of employment. She helped Weld County stand out in the
State and be recognized for their various programs including those for non -custodial parents. She then
presented her with a plaque and pin. Each one of the Commissioners thanked her for her 39 years of
service to the County and encouraged her to enjoy her retirement. They invited her back for the many
volunteer opportunities available with the County. (Clerk's Note: the Board paused for a photo
opportunity.)
PUBLIC INPUT: No public input was given.
BIDS:
1) APPROVE BID #B1600151, ELEVATOR MAINTENANCE - DEPARTMENT OF BUILDINGS
AND GROUNDS: Trevor Jiricek, Director of General Services, reviewed the five (5) bids received and
stated staff recommends awarding the low bid to Elevator Technicians for the annual amount of
$17,034.00. Commissioner Conway moved to approve said low bid. Seconded by Commissioner
Moreno, the motion carried unanimously.
• 2) APPROVE BID #B1600156, INTERACTIVE USE OF FORCE AND FIREARMS SIMULATOR -
SHERIFF'S OFFICE: Mr. Jiricek staff the Sheriff's Office needs a few more weeks to evaluate the low
bid as they are not familiar with the particular technology. Commissioner Conway moved to continue this
matter to November 9, 2016. The motion, which was seconded by Commissioner Cozad, carried
unanimously.
NEW BUSINESS:
• 1) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES - JFMT PROPERTIES,
LLC: Chris Woodruff, Weld County Assessor, reviewed Petition for Abatement or Refund of Taxes for the
John Elway Chrysler Jeep auto dealership for tax year 2015. The original value for this parcel was
$4,017,025.00 and Mr. Woodruff recommended a correction to $3,456,325.00, with a refund of
$11,984.36. Commissioner Cozad moved to approve said and refund of taxes for the amount of
$11,984.36. Seconded by Commissioner Conway, the motion carried unanimously.
El 2) CONSIDER ESTABLISHING DISTRICT ATTORNEY'S SALARY FOR YEARS BEGINNING
JANUARY 1, 2017, THROUGH DECEMBER 31, 2020: Commissioner Kirkmeyer moved to establish the
District Attorney's Salary. The motion was seconded by Commissioner Conway, and it carried
unanimously. Commissioner Kirkmeyer reviewed the process of determination of the salary increase for
the District Attorney. Commissioner Conway stated the salary is comparable with other counties that
have similar caseloads.
3) CONSIDER TEMPORARY CLOSURE OF CR 61 BETWEEN CRS 46 AND 48: Janet Lundquist,
Department of Public Works, presented the terms of the closure effective October 31, 2016, through
November 3, 2016. Staff will use standard road signs, barricades, and water for dust abatement on the
gravel portions of the detour route. Commissioner Moreno moved to approve said closure. Commissioner
Cozad seconded the motion, and it carried unanimously.
4) CONSIDER TEMPORARY CLOSURE OF CR 49 BETWEEN CRS 8 AND 10: Ms. Lundquist
reviewed the details of the closure effective October 31, 2016, through November 4, 2016, and stated

staff will use water for dust abatement on the grave portions of the detour route and standard road signs
and barricades. Commissioner Conway moved to approve said temporary closure. The motion, which
was seconded by Commissioner Kirkmeyer, carried unanimously.
5) CONSIDER EXTENSION OF TEMPORARY CLOSURE OF CR 13 BETWEEN CR 54 AND U.S.
HIGHWAY 34: Ms. Lundquist stated staff has been working with Gerrard Excavation who is requesting
an extension of the closure to November 15, 2016, to replace a culvert when the ditch is not being used
during the off season. It will be easier than trying to replace the culvert in the spring. The company is also
doing some road clean up on the project. Commissioner Cozad stated she would like to see about getting
information on the website or somewhere to inform the public. Ms. Lundquist reported closures are posted
on the County page and she will be post this closure on Facebook Thursday afternoon. Commissioner
Cozad moved to approve said extension of closure. Seconded by Commissioner Kirkmeyer, the motion
carried unanimously.
6) CONSIDER CONTRACT ID #882 AGREEMENT FOR PRELIMINARY ENGINEERING
SERVICES AND SUBMITTAL OF EXHIBIT "A" FOR RAILROAD APPROVAL AND AUTHORIZE CHAIR
TO SIGN — UNION PACIFIC RAILROAD (UPRR): Clay Kimmi, Department of Public Works, presented
the terms of the agreement with Union Pacific Railroad (UPRR) and explained IHC is responsible for the
reimbursement to UPRR in the amount of $5,000.00. Commissioner Conway moved to approve said
agreement and authorize Chair to sign. The motion, which was seconded by Commissioner Cozad,
carried unanimously.
el 7) CONSIDER CANCELLATION OF BOARD OF COUNTY COMMISSIONERS MEETING
SCHEDULED FOR NOVEMBER 30, 2016: Commissioner Kirkmeyer moved to cancel Commissioners
meeting for November 30, 2016, while the Board attends the winter CCI Conference. Seconded by
Commissioner Conway, the motion carried unanimously.
El 8) SECOND READING OF CODE ORDINANCE #2016-12, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, OF THE WELD COUNTY
CODE: Commissioner Kirkmeyer moved to read Code Ordinance #2016-12 by title only. Seconded by
Commissioner Conway, the motion carried unanimously. Bruce Barker, County Attorney, read the title
for the record and reported there have been no changes made since the first reading. He explained this
is a correction in the location of the posting place. No public testimony was offered concerning this matter.
Commissioner Moreno moved to approve on Second Reading. Seconded by Commissioner Kirkmeyer,
the motion carried unanimously.
10 9) FIRST READING OF CODE ORDINANCE #2016-13, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE, OF THE WELD
COUNTY CODE: Commissioner Kirkmeyer presented the Code for the fee schedule and explained this
is done on an annual basis after the budget meetings. No public testimony was offered concerning this
matter. Commissioner Kirkmeyer moved to approve on First Reading. Seconded by Commissioner
Moreno, the motion carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2016-12 was approved on Second Reading and Code Ordinance
#2016-13 was approved on First Reading.

Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 9:33 a.m.
