Box 758 Greeley, Colorado 80631 Dear Glenn: The attached letter and notice was referred to Matt Delich, Transportation Planning Project Manager of Larimer- Weld Regional Council of Governments. He consulted with J. J. Beaver, Planner III of Weld County Planning Department. Mr. Beaver found that the citizens in the area as well as the Weld County Planning Department have determined that the preservation of this line is not essential. In addition, he checked with Gil Olson of the Weld County Engineering Department, who said the abandonment was satisfactory and would hasten the construction of a much needed highway in this area. Matt then checked with Jim Holt of the Great Western Sugar Company, who said the abandonment would have no affect on sugar beet transportation , since they have been using trucks for the past six years. I have , therefore , prepared a letter supporting the abandonment of the Greeley Branch of the Union Pacific Railroad near Gill , Colorado. Ifpou have any questions, please contact me. Right of Way Section 23, T-6N, R-64W of the 6th P.M. , Weld County,. ,:Colorado In regard to the above mentioned right of way, I own a portion of the property in that particular section and am quite interested in acquiring the right of way at such time as the property is placed on the market. If you can be of any assistance to me in this matter, or if you have a representative that I can contact, I would appreciate it. In the last advertisement or notice by the Interstate Commerce Commission in the local newspaper, it stated that the property was to be sold to the County for road right of way. I hope this does not happen as it would cut my property into two parcels doing much more damage to the value of the property than could ever have been done by the railroad. I have been in contact with the Commissioners, however, answers have been , hard to come by as to the County's position. Upon consideration of the record in the above-entitled proceeding, including the order of the Commission, Commissioner Brown, dated April 15, 1976, and served April 21, 1976; and It appearing, That by order served April 21, 1976, which is administratively final, the Commission, Commissioner Brown, found that subject to the conditions for the ,:. .r' protection of railway employees prescribed by the Commission in Chicago, B. & Q. R. V Co., Abandonment, 257 I.C.C. 700; and provided, further, that any responsible State agency and/or local government or other interested responsible organization be given the opportunity, for a period of 120 days from the date of actual abandonment to negotiate the purchase of all or any portion of the rail properties to be abandoned for public use at a purchase price and on such terms as the parties may agree are just and reasonable, but not less than a purchase price ascertained in accordance with the principles controll- ing in condemnation proceedings; the present and future public convenience and necessity permit abandonment by the Union Pacific Railroad Company of a portion of its Greeley Branch extending from railroad milepost 10.86 near Gill, Colorado, in a northeasterly direction to the end of the line at railroad milepost 14.17, a distance of approximately 3.31 miles in Weld County, Colorado; and that the order also provided that within 15 days of the date of publication of notice in the Federal Register, any person, including a government entity shall have the opportunity to make a bona fide offer of financial assis- tance to the carrier applicant shall file with the Commission a copy of said offer together with certain demonstrative evidence in accordance with the procedures stated in said order and as was set forth in a notice published in the Federal Register on March 31, 1976, (41 FR 13691), entitled "Procedures for Pending Rail Abandonment Cases"; It further appearing, That notice of the findings was published in the Federal Register on May 27, 1976; that the prescribed time limit for the filing of offers of financial assistance for the purpose of continuation of the rail service involved has expired without the Commission having received any such offer; and that, in the absence of such offer, anrat appropriate certificate and order should therefore be entered; • Docket No. AT -3 (Sub-No. 10) - It is hereby certified, That subject to the conditions for the protection of employ- ees as set forth in the findings herein, and provided, further, that any responsible State agency and/or local government or other interested responsible organization be given the opportunity, for a period of 120 days from the date of actual abandonment, to negotiate the purchase of all or any portion of the rail properties to be abandoned for public use at a purchase price and on such terms as the parties may agree are just and reasonable, but not less than a purchase price ascertained in accordance with the principles controlling in condemnation proceedings, the present and future public con • - venience and necessity permit the Union Pacific Railroad Company to abandon a portion of its Greeley Branch extending from railroad milepost 10.86 near Gill, Colorado, in a northeasterly direction to the end of the line at railroad milepost 14.17, a distance of approximately 3.31 miles in Weld County, Colorado; �l. Attached to the letter were data regarding abandoned lines that you are interested in selling. • The main consideration herein is that so long as the parcel to be sold is - delivered to a contiguous property (property owner) there is no violation of subdivision regulations. If, however, a parcel is to be sold as a non- F contiguous property, there may be a necessity to utilize subdivision regu- lations to complete the transaction(s). At this time, this office has not completed research on property ownership along both abandoned branches, i .e. , P1 . Valley and Puritan. As we complete these, we will be happy to forward them to you if this would be desired. This office would desire to have from your office copies of any contract or deed that has been consumated and henceforth, any contract or deed prior to sale so we might review same and indicate to you whether the transaction will come under the purview of subdivision regulations. If subdivision regulations are necessary, then we shall at that time determine the proper procedure and forward same to you. An understanding should be made clear when parcels are being sold and that is: If the parcel (s) is being sold to contiguous property, it is not con- sidered a separate interest (parcel ), but attached and made a part of the existing parcel . Indicated on the enclosed county map are the following items: 1. (in black) Union Pacific Railroad abandoned right-of-way which Weld County previously purchased. 2. (in red) the portions which Weld County is interested in acquiring a. property in the Barnesville area--a cooperative project between Weld County and the State of Colorado for the continued construction of Colorado Highway 392 from Barnesville to Briggsdale where it will junction with Colorado Highway 14 b. property in the Galeton area--the grade crossing which was the original railroad bed which we need to lower and approximately one acre of land next to the county road which we need for a motor grader station. Mr. Rice stated that he was not sure when the case would be presented and therefore could not tell us when this R.O.W. would be available for Highway construction . This 4, 000 foot stretch of railroad track is urgently needed , for tie-in of the existing road which is under construction northeast of Barnesville to the existing State Highway southwest of Barnesville. I have been informed by the Colorado Highway Department District Engineer, Mr. Dwight Bower, that we may lose future • funding on this road ,since construction has not started on this 4, 000 foot stretch. If construction work is not started within the next six months on this 4,000 foot stretch then it may jeopardize our entire proposed Barnesville to Briggsdale Project with the .the State Highway Department. Mr. Rice stated that a formal application has not been presented to the ICC as of this date and he is not sure when the formal application will be presented for abandonment of this line. Mr. Rice stated that there was nothing else that Union Pacific could do at this time regarding this R.O.W. until the case has been presented and approved by the ICC. Mr. Rice stated that he is preparing the legal documents necessary for transferring the land at Galeton to Weld County, and anti- cipates that this will be done during the next several months. I indicated to Mr. Rice that it was extremely important that we proceed as soon as possible with both of these R.O.W. ' , The District Engineer in Cheyenne will be sending a survey crew to locate the property lines at Galeton in the very near future .
