Everist, Inc., I will respond to your August 5, 2016 adequacy review letter in the order and number format presented in that document. I have also provided responses to the State Engineers Letter, the Colorado Historical Preservation Office, the objector letter from PDC Energy and the objector letter from Mr. & Mrs. Lohmann. I have also revised the Mining and Reclamation Plan Maps to remove the northern well (Coors V 6-4) since it has been aban- doned and will be plugged shortly. The well feeder line and casing will be removed during mining and the top of the casing will be trimmed and capped per Oil & Gas Commission regulations. I also corrected Exhibit S, and the structure list on the maps to fix the list of existing structure agreement owners since some have changed. L.G. Everist received calls from Colorado Inter- state Gas and Kinder Morgan saying their gas lines are now owned by DPC Midstream(Duke)and had just not been changed in county records. Also they did not have an agreement for Comcast Corp even though I marked it as being present. The flood. plain line has also been removed from all maps as explained in the following text. EXHIBIT E - Reclamation Plan (Rule 6.4.5): As discussed on site during the pre -op inspection, if the alternate reclamation plan of inert fill landfill is adopted for final reclamation of "Area C", an appropriate Technical Revision must be submitted and approved by DRMS. An appropriate CD must also be obtained before any landfill activity could be approved at this site as stated in the existing MOU between DRMS and CDPHE. If the site were to be developed as an inert fill site it would be for "Areas B & C" not just "Area C". I concur with your assessment on needing a Certificate of Designation (CD), I talked to the Colorado Department of Public Health & Envi- ENVIRONMENT, INC. SEPTEMBER 1, 2O18 PAGE 2 ronment, Solid Waste Division, they confirmed that a CD would be required. L.G. Everist, Inc. will obtain a CD, as de- scribed in the MOU provided, prior to filing the Technical Revision to implement the Inert Fill alternate plan. EXHIBIT G - Water Information (Rule 6.4.7): This site will employ compacted clay liners to satisfy SEO requirements. These liners, in conjunction with site dewatering prior to liner placement, may result in groundwater mounding or shadowing issues, therefore, a groundwater level monitoring and mitigation plan will be required for this site. Please submit a plan for DRMS approval that illustrates, at a minimum, groundwater level monitoring points, level measuring method, frequency and reporting, as well as impact mitigation trigger levels and proposed mitigation options. Attached is a Groundwater Monitoring and Mitigation Plan describ- ing the items you requested. We are in the process of locating and installing 4 Piezometers around the south, west and north sides of Area C. There are 3 lined reservoirs in the near vicinity of the mine, 2 along County Road 26 and 1 east of the mining area. Also attached is a new map, Map Exhibit G-2 showing the proposed locations of the Piezometers. According to the maps submitted with the application, a portion of the site along the north permit boundary is within the 100 year flood plain. The application as submitted does not address how the permittee will prevent damage to the lined reservoirs from flood events to ensure long term stability of the site - please address. Many operators incorporate engineered inlet/outlet structures to lined reservoirs to allow flood flows to enter and exit the reservoir in a controlled fashion. These structures are intended to prevent damage to the clay liners and prevent possible head -cutting damage due to flood events. The location of the 100 -year flood plain shown on the maps was from an old version of the FEMA FIRM map for this area. A revised FIRM map was issued in January 2016 and it shows the 100 -year flood plain is no longer on the property. I have attached a Firmette showing the permit area (found at http://fema.maps.arcgis.com/apps/webappviewer/index.html?id=49069b91 c14a411 fa8defccf5c1 f6266) I added the Affected Lands line to the map for reference. Since the reservoirs are not in the flood plain we prefer not to include spillways for them. I have enclosed copies of revised Map Exhibit C, C -1, E & F with the flood plain re- moved. EXHIBIT L - Reclamation Costs (Rule 6.4.12): (1) All information necessary to calculate the costs of reclamation must be submitted and broken down into the various major phases of reclamation. You must provide sufficient information to calculate the cost of reclamation that would be incurred by the state. DRMS wilt recalculate reclamation costs when all adequacy issues are resolved. Based on conditions observed during pre -op inspection, a significant amount of clean-up, lining and re -sloping work remains to be completed in Area B. The remainder of Area A will need to be backfilled to approximate original grade. Estimates for these tasks, broken down by task, and including information such as material quantities required, push distances, equipment utilized, etc. should be provided in this Exhibit. Exhibit L contains all of the information noted. The minor revisions we made during this response do not affect the overall numbers provided. ENVIRONMENT, INC. OCTOBER 1 1 , 201 6 PAGE 3 EXHIBIT S - Permanent Man -Made Structures (Rule 6.4.19): Please note that roadways and aboveground or underground utilities (if present) within 200 feet of the proposed affected area are considered permanent man-made structures. In accordance with Rule 6.4.19, when mining operations will adversely affect the stability of any significant, valuable and permanent man-made structure located within 200 feet of the affected area, the applicant may either: a.) Provide a notarized agreement between the applicant and the person(s) having an interest in the structure, that the applicant is to provide compensation for any damage to the structure; or b.) Where such an agreement cannot be reached, the applicant shall provide an appropriate engineering evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining operation. Please provide evidence (certified letter to structure owners) that a notarized agreement between all structure owners listed in the application and the applicant was pursued. If an agreement is unable to be reached a geotechnical assessment may be provided to demonstrate that the structures shall not be damaged. You must provide information sufficient to demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected land will not be adversely affected . As noted in the application packet, the Division has copies of structure agreements for 8 of the 25 structure owners around the mine. We have recently received new signed and notarized agree- ments from Harold & June Hall, Pasquale Varra, and Dolores French (copies attached). As mentioned above, Kinder Morgan and Colorado Interstate Gas representatives called L.G. Everist to inform them that they no longer own gas lines on the permitted property. Their lines are now owned by DCP Midstream (Duke). L.G. Everist already has a structure agreement with Duke. The permit maps have been cor- rected to reflect the ownership changes. Attached are copies of the mailing receipts showing that we mailed 17 structure agreements to the owners on July 15, 2016, where none existed prior to permitting. Copies of any agreements received in the future will be provided to the Division for the permit file. We contacted Deere & Ault to prepare a slope stability analysis as an acceptable option for any structures within 200 -feet for which we do not get structure agreements. Deere & Ault's analy- sis shows the setback distances for the closest structure on all 4 sides of the amendment area will be safe during and after mining for the entire permit area. We have attached a copy of October 7,2016, Carbon Valley Gravel Mine Slope Stability Analy- sis, prepared by Deere & Ault, for your review. ENVIRONMENT, INC. OCTOBER 1 1 , 20 1 6 PAGE 4 Additional Information: You will also need to provide the Division with proof of notice publication and proof of notice to all property owners within 200 feet of the affected area. Any letters from other commenting agen- cies/entities received by the Division to date have been included with this correspondence for you to review. A copy of the Proof of Publication is attached. Publication in the Longmont Times Call started on July 8, 2016 and ended on July 29, 2016. The public comment period ended on August 18, 2016. A copy of the return receipt cards, or proof of mailing and USPS tracking printout if a green card was not returned, are attached for your file. We mailed second notices to Kinder Morgan since the first notice was returned from the address obtained from the Colorado Oil and Gas Commission records. Any letters from other commenting agencies/entities received by the Division to date have been included with this correspondence for you to review. OFFICE OF ARCHAEOLOGY & HISTORIC PRESERVATION - We will follow their sugges- tions if human remains are found. OFFICE OF THE STATE ENGINEER - L.G. Everist, Inc. understands the requirement for updating our Substitute Water Supply Plan and well permit if there is an increase in water use. PDC ENERGY -AS noted in their letter L.G. Everist is working closely with PDC Energy and expect to have an agreement in place for the new area. All PDC structures within 200 -feet of the existing permit area are covered by an agreement on file with the Division. (PDC bought out Merit Energy, the original company listed on the 2001 agreement.) This leaves the 2 wells on the south side of Area C and a portion of the flow lines from those wells to their tank area on the existing mine site that are not covered by an agreement. On September 23, 2016 PDC Energy withdrew their objection and L.G. Everist, Inc. will continue to work with them on an agreement. MR. & MRS. LOHMANN - Three concerns were raised by the Lohmann's in their objection letter - dust, weeds, timing. Lynn Mayer Shults of L.G. Everist spoke with Mr. Ted Lohmann and addressed all of his concerns. See information below. Th Lohmanns have withdrawn their objection. DusT- This issue is not technically under the Division's juris- diction, however, we would like to explain to the Division that L.G. Everist is in compliance with their Air Permits for this mine. Dust control methods are used as required and include the use of water sprays in processing equipment, on roads and disturbed areas, revegetation on growth medium stockpiles, and graveling of roads. ENVIRONMENT, INC. PAGE 5 OCTOBER 1 1 , 201 6 WEEDS- Weeds are controlled on site, using various measures, including chemical (spraying), mechanical (mowing, pulling, dozing, etc.), and revegetation of disturbed areas. A Weed Management Plan is attached, to be included in the permit file. TIMING- Length of mine life and Use of Road Easement - Both of these issues are not technically under the Division's juris- diction, since the state has no time limit for mine permits, as long as mining continues in the site. And the Road Easement is between L.G. Everist and the Lohmanns. Regardless, L.G. Everist wanted to address the Lohmann's concerns. The Lohmanns were mostly concerned with timing of the reclamation of the areas which are adjacent to and north of their property. Ms. Lynn Shults explained to Mr. Ted Lohmann that L.G. Everist is close to the end of mining in these areas and will work to reclaim and release the areas within 5 years after mining operations are completed in the areas. After these areas are released, L.G. Everist will most likely not have need of the Temporary Road Easement, and can work with the Lohmanns on termination of the agreement. The setback areas will be reclaimed if disturbed and the roads will remain for access around the final Water Storage Reservoirs. The mine will be dewatered as explained in the existing permit text and the material will be mined using loaders and excavators to remove material from the face. The material will then be delivered to the Plant for processing, using the loaders, haul trucks or a conveyor system. The arrows on EXHIBIT C-1 - MINING PLAN MAP show how we will prog- ress through the mine area. We estimate that by adding the new area, the life of the mine will be extended from 10 to 12 years. Mining Timetable The continuing uncertainty of economic conditions in the construction materials industry precludes an accurate forecast of demand for materials during the life of the mine. More specifically, the site is located in the Northwest Quarter of the Northwest Quarter of Section 6, Township 2 North, Range 67 West of the 6th P.M. in Weld County. A vicinity map of the area is shown on Figure 1. L.G. Everist, Inc. is in the process of evaluating the potential for the development of a gravel mine on the property. OVERVIEW L.G. Everist is developing permits required to open the mining cell with Environment, Inc. As part of the permitting process Environment, Inc asked D&A to perform slope stability analyses of the proposed mine slopes and proposed reclaimed slopes. The site is currently a cultivate field as shown on Figure L ANALYSIS D&A performed a slope stability analysis for the each of the four cross sections (Sections A -D) shown on Figure 1 using a mined highwall configuration. The highwall was assumed to be mined at a slope of 1:1 (horizontal to vertical). The distance to the nearest site feature, (i.e. property line, fence line, utility, etc.) is shown on each figure. Material properties for the existing geologic profile were assumed based on our professional experience with similar projects in the region. Each cross section was analyzed by the computer software Slope /W. The software performs calculations to develop thousands of failure circles between two user defined entry and exit sections, shown as red bars on the Figures 1-4. The ten failure circles with the lowest factors of safety are shown on each figure. The lowest factor of safety is called out by a red dot with a number and the correlating failure circle is a thick black line. The minimum factors of safety for the four mining slope cross sections ranged between 1.20 and 1.26. A temporary mine highwall with a factor of safety greater than 1.0 is considered stable. None of the sections analyzed came within 30 feet of affecting the nearest site feature. 600 S. Material properties for the reclamation slope fill was added to the model and is based on our professional experience with earthfill for similar projects. Slope /W was used to analyze the stability of the reclaimed slopes. The minimum factors of safety for the four reclaimed slope cross sections ranged between 1.63 and 1.67. A reclaimed slope with a factor of safety greater than 1.5 is considered acceptable. None of the sections analyzed came within 30 feet of affecting the nearest site feature with the reclaimed slope constructed. CONCLUSION Based on the information supplied by Environment, Inc. it is the opinion of Deere and Ault that the proposed mining and subsequent reclamation work at the L.G. Applicable Regulation - Colorado Construction Materials Rule 3.1.10(6) states, "Methods of weed control shall be employed for all prohibited noxious weed species, and whenever invasion of a reclaimed area by other weed species seriously threatens the continued development of the desired vegetation. Weed control methods shall also be used whenever the inhabitation of the reclaimed area by weeds threaten further spread of serious weed pests to nearby areas." Noxious Weed Species The Colorado Department of Agriculture (CDA) has evaluated the noxious weed situation throughout the state and created weed management laws that apply state-wide. In 2004, the CDA updated weed management laws to create the A, B and C species lists. List B Species - CDA and local government develops and implements state noxious weed management plans designed to stop the continued spread of these species. Minimize disturbed areas, disturbing only the acreage to be mined in the upcoming field season, and limiting the roads and equipment storage areas Reclaim affected areas as soon as possible - topsoil and vegetate with a native grass mix Minimize or eliminate wetted soils, create positive drainage at all times Vegetate topsoil and overburden stockpiles, and other disturbed areas, with a native grass mix to control erosion and weed growth Inspections will be will be conducted in early Spring and Fall to determine if weed spraying is needed before the native plants become active. Weeds will be sprayed with most effective chemicals for the species (using county and contractor recommendations - see Weld County specific recommendations below) Throughout the growing season, weeds will be mechanically controlled by various methods (mowing, pulling, dozing, chop -down, and other removal) Estimated Cost of Weed Control $2500 to $5000 per year Carbon Valley Resource, M-2001-017 WEED CONTROL PLAN September 2, 2016 Weld County Weed Management - Techniques and timing for Weed Species Listed below (from Tina Booton, Weed Division Supervisor, Weld County Public Works, Aug -2016) Downy Brome/Cheatgrass Use Esplanade at 5 oz/acre in July/early August as a pre -emergent treatment. Treatments will be made using both broadcast spray on the large patches and handgun treatments of the small patches. Esplanade has shown to provide two years' worth of control of cheatgrass whose seed longevity is fairly short. During these two years of cheatgrass suppression, the surrounding vegetation on the sites in the research plots has filled in to out compete the cheatgrass. With as much other vegetation that is in the area, it is believed that this will be the similar case at Lehr. A spring inspection in February/March (as soon as snow load is gone and the site is accessible) will be conducted to determine if any other treatments are needed before the native plants become active. Field bindweed, Canada thistle and Dalmatian toadflax Tordon at 32 oz/acre with an MSO surfactant at 32 oz/100 gallons will be used to treat these species in September/October of 2016. These patches will be treated by handgun work to limit any impact to surrounding forbs. A spring inspection in May/June will be conducted to see if a spring treatment is necessary or another fall treatment. L.G. Everest, Inc. Carbon Valley Resource Exhibit G Addendum M-2001-017 Groundwater Monitoring & Mitigation Plan This information is prepared to lay out L.G. Everist's Groundwater Monitoring and Mitigation Plan for the mine. At this time there are no monitoring wells on the permit area. Previous data collected was for areas that have been released from the permit area and no longer applies to the current permit area. L.G. Everist, Inc. plans to install 4 ground water monitoring piezometers along the south, west and north sides of Area C. Included is a map showing the location of the proposed wells. The points were chosen because of the location of the surrounding shallow wells noted on Table G. The actual location of the monitoring wells may vary once they are installed and an "as built" map showing the exact location will be provided once the wells are in place. No wells are proposed for the existing area as it is surrounded on the east, northeast and north by three sealed reservoirs; to the south by a large irrigation ditch (Last Chance Ditch); and to the west by the operator's amendment property. Therefore, the reservoir liner on the existing side will have little to no effect, on any of the surrounding areas.. Groundwater Monitoring Plan and Data Analysis Once the wells have been installed in Area C, the plan is to begin collecting monthly data until two years of data has been collected. This period of time is chosen to collect two full seasonal cycles as it will establish background elevations from which the baseline and trigger points can be determined. As the data is collected it will be graphed and as mining may begin before the initial 2 years data is collected it will be important to review the trending depths to determine potential impacts to surrounding wells. During mining, the impact will be due to dewatering and a lowering of the water table within Area C. Data Collection and Submittal to the Division Monitoring wells that are around the perimeter of the operation will have data collected on a monthly basis through the initial 24 -months. After the baseline period, the data collection will be done on at least a quarterly basis, unless a well's data exceeds baseline ranges, then data collection will revert to monthly until the variance is resolved. External wells will be checked for compliance to stay within baseline ranges, as changes at these wells could affect neighbors. The possibility of adjusting the baseline ranges if needed in the future will be discussed between the Division and the operator at that time. The baseline range changes would be documented with a Technical Revision. In the mine's annual report, the operator will give the Division a groundwater monitoring well data summary report that includes groundwater level data, times the trigger points were exceeded, investigations into cause, and any needed mitigation analysis/plans. The operator will also contact the Division with this information when/if a trigger point is reached and there seems to be a trend. Baselines and Trigger Points The baselines for each monitoring well will be determined by taking the high and low groundwater elevations of each well for the first two (2) years of data collected. The proposed trigger points, based on the established elevations, are 2 feet above the highest elevation and 2 feet below the lowest elevation measured. Mitigation If the groundwater levels in a monitoring well pass its trigger points for more than 3 months in a row, the operator will investigate to determine causes, and if it is determined that the operator is responsible for the changes, then the operator will do mitigation as necessary. The operator will notify the Division of the trigger investigations and any subsequent mitigation. A neighbor complaint could also be a "trigger". Examples of possible issues are: water well levels low, flooding fields, and vegetation suffering. L.G. Everist would investigate to determine causes and mitigate if necessary with the mitigation measures outlined below. Mitigation measures that could be implemented if necessary (not necessarily in the order listed) include: Construction of a pipe/drain to equalize groundwater levels. Such a drain or pipe could be constructed along the sides of the mine or between lined cells, where it would convey water from the up gradient side of the operation to the down gradient side. • Release of water in ditches/laterals. Water could be released in ditches/laterals to provide irrigation, increase recharge, and/or raise groundwater levels. • Well improvements. Affected water wells could be deepened or modified to increase yield. Alternatively, new alluvial wells could be constructed to provide a new water supply. The exact mitigation measure or combination of measures would be determined based on additional investigations and consultations with the affected party. If it is determined that the operator has caused water issues for surrounding landowners the operator (L.G.
