HomeMy WebLinkAbout20161179 RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO APRIL 4, 2016 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, April 4, 2016, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tern Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer - EXCUSED Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of March 30, 2016, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Moreno moved to approve the Certification of Hearings conducted on March 30, 2016, as follows: 1) COZ15-0004 - Ronald and Lee Birgenheier, 2) USR15-0078 - Circle B Land Company, LLC, c/o M3 Construction, LLC, and 3) USR15-0079 - RLU Holdings, LLC, c/o Northwinds of Wyoming, Inc. Commissioner Conway seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. el CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Moreno seconded the motion, and it carried unanimously. PROCLAMATIONS: la 1) AWARD FOR EXCELLENCE - DEPARTMENT OF PUBLIC WORKS: Chair Freeman read the certificate for the record and Jay McDonald, Director of Public Works, presented Don Dunker, Mike Bedell and the Public Works team with a plaque. Each one of the Commissioners extended their congratulations and thanked the Department of Public Works for their hard work on the County Road 49 project. (Clerk's Note: the meeting was paused for a photo opportunity.) Minutes, April 4, 2016 2016-1179 Page 1 BC0016 • PUBLIC INPUT: There was no public input. BIDS: 1) APPROVE BID #B1600058, CUSTODIAL SERVICES - DEPARTMENT OF BUILDINGS AND GROUNDS: Trevor Jiricek, Director of General Services, stated staff recommends awarding the various custodial services bids as detailed in the worksheet. Commissioner Moreno moved to approve said bids as recommended by staff. Seconded by Commissioner Cozad, the motion carried unanimously. • 2) APPROVE BID #B1600059, GENERATOR INSTALLATION/HMGP (THREE (3) LOCATIONS) - DEPARTMENT OF BUILDINGS AND GROUNDS: Mr. Jiricek stated staff recommends continuing this matter. Commissioner Conway moved to continue this matter to April 6, 2016. Seconded by Commissioner Cozad, the motion carried unanimously. ra 3) PRESENT BID#B1600072, ROOF TOP UNIT (1551 N 17TH AVE BUILDING) - DEPARTMENT OF BUILDINGS AND GROUNDS: Mr. Jiricek presented the four (4) bids and stated staff will make a recommendation on April 18, 2016. NEW BUSINESS: • 1) CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND AUTHORIZE CHAIR TO SIGN - TRAVIS WINTER: Commissioner Conway moved to approve the appointment of the deputy district attorney and authorize Chair to sign. The motion was seconded by Commissioner Cozad, and it carried unanimously. 2) CONSIDER CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2012-18765) FOR PARCEL #0707-12-0-00-009: John Lefebvre, Weld County Assessor, reviewed the reason for the cancellation of the tax lien certificate stating it was a parcel that was split and the parcel became a taxable entity but was later cancelled by the Assessor's Office. Commissioner Cozad moved to approve said cancellation of the tax lien certificate. The motion was seconded by Commissioner Conway, and it carried unanimously. • 3) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES FOR WATTENBERG WATER SYSTEM IMPROVEMENTS AND AUTHORIZE CHAIR TO SIGN - JVA ENGINEERING: Don Dunker, Department of Public Works, presented the terms of the agreement for JVA Engineering to design the Wattenberg Water System Improvements. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Cozad, carried unanimously. • 4) CONSIDER ACCEPTANCE OF QUIT CLAIM DEED FOR PUBLIC RIGHT-OF-WAY AT PRESENT PHYSICAL LOCATION OF CR 49 BETWEEN CRs 30 AND 32 AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS - ROSE ROCK MIDSTREAM CRUDE, L.P: Tiffane Johnson, Department of Public Works, reviewed the terms of the quit claim deed as part of the acquisition for County Road 49. The County is acquiring 1.62 acres from Rose Rock Midstream Crude, L.P., and there is no cost to the County. Commissioner Conway moved to approve said acceptance of quit claim deed and authorize the Chair to sign all necessary documents. Seconded by Commissioner Cozad, the motion carried unanimously. 5) FINAL READING OF CODE ORDINANCE #2016-03, IN THE MATTER OF REPEALING AND REENACTING WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE, OF THE WELD Minutes, April 4, 2016 2016-1179 Page 2 BC0016 COUNTY CODE: Commissioner Conway moved to read by title only. The motion was seconded by Commissioner Moreno, and it carried unanimously. Bruce Barker read the title for the record and stated there haven't been any changes since the last reading. No public testimony was offered concerning this matter. The motion to approve on Final Reading, which was made by Commissioner Cozad and seconded by Commissioner Moreno, carried unanimously. VIOLATION: el 1) CONSIDER REQUEST TO PURSUE AN INJUNCTION AGAINST SHERWOOD DONALD LANGLEY AND ELIZABETH GARBER, DBA WASTE CHASERS, LLC, FOR VIOLATION OF THE WELD COUNTY CODE - ZCV16-00016 (CON'T FROM 3/14/2016): Bethany Pascoe, Zoning and Compliance Officer, stated the property has been cleaned up and she would like the injunction to be dismissed. Commissioner Conway moved to dismiss the injunction. The motion was seconded by Commissioner Cozad, and it carried unanimously. PLANNING: 1) FIRST READING OF CODE ORDINANCE #2015-25, IN THE MATTER OF REPEALING AND REENACTING WITH AMENDMENTS, CHAPTER 21 AREAS AND ACTIVITIES OF THE STATE INTEREST, (1041 WATER LINES) OF THE WELD COUNTY CODE (CON'T FROM 02/08/2016): Commissioner Conway moved to read by title only. Seconded by Commissioner Cozad, the motion carried unanimously. Mr. Barker read the title for the record. Michelle Martin, Department of Planning Services, explained staff is putting together the final changes and would like to continue this matter. No public testimony was offered concerning this matter. Commissioner Cozad moved to continue this matter to May 9, 2016. The motion was seconded by Commissioner Moreno, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2016-03 was approved on Final Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
