HomeMy WebLinkAbout20163739.tiffRESOLUTION RE: APPROVE VACATION OF AMENDED SPECIAL USE PERMIT, SUP -431 - FRANCISCO GRANADOS JIMENEZ AND LAURA GRANADOS, CIO PAMELA DECHANT PACHELLO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated October 18, 1989, the Board approved Amended Special Use Permit, SUP -431, for a 250 -dog Greyhound Kennel for Richard Blundell on the following described real estate, to -wit: Part of the SE1/4 SE1/4 of Section 21, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request, dated November 4, 2016, from the current property owners, Francisco Granados Jimenez and Laura Granados, c/o Pamela Dechant Pachello, to vacate said Amended Special Use Permit, SUP -431, in its entirety to satisfy a Condition of Approval for administratively approved, Two -lot Recorded Exemption, RECX16-0140, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. RECX16-0140 included the following Condition of Approval: 3.A. "There is a Special Use Permit AMSUP-431, reception #2281978, for a kennel (250 dogs) in the A (Agricultural) Zone District. This SUP encompasses both proposed Lot A and Lot B [of RECX16- 0140]. The applicant shall address the continued operation of AMSUP-431 and which lot(s) it is to be associated with. If the applicant wants to remove any of the lots from AMSUP-431, a partial vacation or complete vacation should be done prior to recording the Recorded Exemption plat." In the attached letter, submitted on November 4, 2016 to the Department of Planning Services from authorized agent Pamela Dechant Pachello for the purpose of addressing the Conditions of Approval for RECX16-0140, item 'A' in that letter states, "The Special Use Permit AMSUP-431 Reception #2281978 is no longer needed or wanted. The current owner wishes for a complete removal of this special use permit on Lot A and Lot B. Previous owner was one with dog kennel, current owner has no interest or need for it." The Department of Planning Services staff has reviewed this request and recommends that this request be approved. If approved, the BOCC Resolution will satisfy condition #3.A of the RECX16-0140 administrative review and the RECX16-0140 plat may proceed with recording. The Special Use Permit AMSUP-431 Reception # 2281978 is no longer needed or wanted. The current owner wishes for a complete removal of this special use permit on Lot A and Lot B. Previous owner was one with dog kennel, current owner has no interest or need for it. B. The applicants have revised their access permit request to eliminate the request for access on CR 31. Both Lot A and Lot B will use the current access off of CR 18, with an extension of current drive/road being lengthened to access new Lot A . C. 1. The owners have stated they will have approved and visible address numbers put up that are legible from the road for both properties. 2. N/A 3. Mentioned to owners 4. The applicants have read thru and understand that the new drive/road extending to Lot A will be built to be able to have fire apparatus access and use them. They will also make sure of them drives/roads being within 150 feet of all portions of exterior walls. 5. Existing drive/road access currently has unobstructed width of 16 feet or more. 6. Owners understand access drive/road to both properties need to be surfaced with all weather materials and maintained. 7. Owners shall make sure there is an appropriate sized area for the turning around of fire apparatus. D. City of Ft.
