Box 129, Greeley, CO 80632, for a Minor Amendment, MUSR15-0020, to a Site Specific Development Plan and Use by Special Review Permit, USR-1687, for Mineral Resource Development Facilities, including open Pit Mining and Materials Processing and Asphalt and Concrete Batch Plants, along with Importation of Resource Materials in the A (Agricultural) Zone District, for property which is described as Lots A and B of Recorded Exemption, RE -4744; being located within the SE1/4 and SE1/4 NE1/4 of Section 7, Township 5 North, Range 64 West of the 6th P.M., Weld County, Colorado, and WHEREAS, Development Standard #4 was approved, to read as follows: "Section 23-4-290.6 of the Weld County Code limits the hours of operation for sand and gravel operations to the hours of daylight, except in the case of public or private emergency, or to make necessary repairs to equipment. Operation hours may be extended with specific permission from the Weld County Board of County Commissioners. This restriction shall not apply to operation of administrative and executive offices or repair and maintenance facilities located on the property." WHEREAS, on September 12, 2016, the Board of County Commissioners was presented with a request, dated August 22, 2016, from the Department of Public Works for an extension of the hours of operation at the J2 Pit for the duration of the County Road 49 expansion project, and WHEREAS, following discussion the Board deemed it advisable to continue the matter to October 3, 2016, to allow the applicant additional time to explain the hours of operations to the neighbors, and WHEREAS, on October 3, 2016, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Departments of Planning Services and Public Works, and having been fully informed, finds that the hours of operation 1.5 hours before daylight and 1.5 hours after daylight for the duration of the County Road 49 expansion project, be, and hereby are, extended tp 1 hour before daylight and 1 hour after daylight, effective November 1st through March 31st. In an email dated August 22, 2016 Clay Kimmi with the Weld County Department of Public Works is requesting an extension of the hours of operation for 1.5 hours before daylight and 1.5 hours after daylight for the duration of the County Road 49 expansion project, (December 31, 2017). Notice of today's hearing was sent to the property owners within 500 feet of MUSR15-0020. Currently J2's USR-1687 is limited to hours of operation between dusk and dawn. We need to extend those hours to 1.5 hours before dawn and 1.5 hours after dusk for the WCR 49 project. The reason being is that the first load needs to be batched and on site at dawn. In order to make that happen, IHC needs to have their testing completed and the loads need to be on the road prior to dawn. At the end of the day the need time to clean and perform maintenance on the plant. Since the paving will likely go until dusk that means they are cleaning up the plant after dusk. The extended hours would not be everyday but only on the days on which they are paving. Please let me know what the Planning Dept. needs so we can change the hours of operation temporarily through the duration of the project.
