This project is located north of CR 59 and CR 20. Parcel number 121535000008 Drainage Requirements: Please contact Department of Planning Services/Engineering Development Review for questions or assistance for drainage requirements at 970-353-6100. The proposed project is working under the previous drainage code in where a less than 10% imperviousness for the entire site allowed the use of water quality control features and not required to use detention ponds. A drainage narrative and WQCF was submitted as required at the pre -app meeting and is acceptable This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized area with state mandated, higher water quality requirements Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Floodplain: This area IS NOT in a FEMA regulatory floodplain. CONDITIONS OF APPROVAL: A. The plan shall be amended to delineate the following: 1. The applicant shall show and label the accepted drainage features and drainage flow arrows. Water quality features or stormwater ponds should be labeled as "Water Quality Feature, No -Build or Storage Area" and shall include the calculated volume. (Department of Planning Services -Engineer) WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT 1555 North 17th Avenue, Greeley, CO 80631 www.weldhealth.org Memorandum To: Chris Gathman From: Ben Frissell, Environmental Health Services Date: April 5, 2016 Re: USR14-0080 Buffalo Ridge Energy Services Facility Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for a Solid Waste Disposal Site and Facility (Solids Treatment and Beneficial Reuse of Commercial Exploration and Production Waste and other appropriate non -hazardous waste streams including cements and other non -hazardous solid waste with free water or liquids, oil water slurries, high oil content slurries, produced water/flowback from exploration and production wells, and drilling fluids (muds) in the A (Agricultural) Zone District. The applicant is proposing to permit and install an engineered commercial septic system. The applicant is unsure the total amount of full-time employees at full -build out, but has agreed to install and permit the necessary sized septic system to accommodate the intended load. The facility has provided documentation that it intends to use the well currently servicing the Buffalo Ridge Landfill, (Well Permit 046346-F) to service the Buffalo Ridge Energy Services Facility. An Engineering Design and Operations Plan was submitted and the CDPHE conducted a "technical review" of the EDOP. The Final EDOP (Version 2) was submitted and WCDPHE considers this the "approved EDOP". We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: Prior to the issuance of the Certificate of Occupancy: 1. An onsite wastewater treatment system is required for the proposed facility and shall be installed according to the Weld County Onsite Wastewater Treatment System Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Onsite Wastewater Treatment System Regulations. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large -capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. The facility shall operate in accordance with the approved Engineering Design and Operations Plan (EDOP). Modifications to the Engineering Design and Operations Plan may be required due to deviations from the approved use at the facility and/or regulatory changes. If such changes occur, approval of the modification will be required from the Hazardous Materials and Waste Management Division of the Colorado Department of Public Health and Environment. 2. Operations will not extend past Certificate of Designation boundaries of the property. 3. The facility shall adhere to the conditions incorporated into the Certificate of Designation. 4. The facility shall submit evidence to the Weld County Department of Public Health and Environment, prior to the acceptance of waste, that financial assurance has been obtained in accordance with CDPHE regulations pertaining to solid waste sites and facilities. 5. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 6. The facility shall receive and manage only those materials that are described in the approved EDOP and materials approved in accordance with the Waste Identification Plan included in the EDOP. 7. All wastes received at the facility shall be unloaded on the unloading pad. The unloading/loading pad leak detection system shall be constructed and operated in accordance with the approved design. The unloading pad will be kept in good condition and cleaned at a frequency that prevents oils and other wastes from building up on the pad. 8. Should recycling or beneficial use activities occur at the facility, the facility shall operate in accordance with their approved EDOP. 9. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 10. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved EDOP and with Chapter 14, Article 1 of the Weld County Code, at all times. 11. Fugitive dust shall attempt to be confined on the property. Uses on the property shall comply with the Colorado Air Quality Commission's air quality regulations. 12.A Spill Prevention, Control and Countermeasure Plan, prepared in accordance with the applicable provisions of 40 CFR, Part 112, shall be available on -site. 13. The applicant shall submit an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit Application and obtain a permit from the Air Pollution Control Division, Colorado Department of Public Health and Environment, as applicable. 14.All stormwater, which has come into contact with waste materials on the site, shall be confined on the site. In the event the storm water is not adequately controlled on the site, upon written notification from the WCDPHE or CDPHE, a comprehensive site -wide Stormwater Plan shall be developed and implemented. The plan must be approved, in writing by the WCDPHE or CDPHE, prior to implementation. 15. Secondary containment shall be constructed around tanks to provide containment for the largest single tank and sufficient freeboard to contain precipitation. Secondary containment shall be sufficiently impervious to contain any spilled or released material. Secondary containment devices shall be inspected at regular intervals and maintained in good condition. All secondary containment will comply with the Colorado Oil and Gas Conservation (COGCC) Commission Rule 604 and/or the provisions of the State Underground and Above Ground Storage Tank Regulations. 16.Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 17.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. Any stained or contaminated soils on the facility shall be removed and disposed of in accordance with applicable rules and regulations. Any reportable spills will be reported and documented in accordance with all state and federal regulations and records will be kept onsite for WCDHPE review upon request. 18. WCDPHE will be notified prior to the closure of the facility. Upon site closure, the facility will comply with the Closure Plan outlined in the approved EDOP. Documentation of closure activities will be provided to WCDPHE. 19.Adequate drinking, hand washing and toilet facilities shall be provided for employees, at all times. For employees or contractors on site for less than 2 consecutive hours a day, and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 20.Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Wastewater Treatment Systems. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 21.The facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S. 22.Analytical waste data and environmental monitoring data shall be made available to Weld County Department of Health and Environment upon request. The Weld County Department of Health and Environment reserves the right to require additional monitoring. 23. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. MEMORANDUM TO: Chris Gathman, Planning Services DATE: April 13, 2016 FROM: Janet Lundquist, Public Works SUBJECT: USR14-0080 Waste Management The Weld County Department of Public Works has reviewed this proposal. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: A Site Specific Development Plan and Use by Special Review Permit for a Solid Waste Disposal Site and Facility (solids treatment and beneficial reuse of commercial exploration and production waste and other appropriate non -hazardous waste streams including cements and other non -hazardous solid waste with free water or liquids, oil water slurries, high oil content slurries, produced water/flowback from exploration and production wells, and drilling fluids (muds) and obtain a Certificate of Designation in the A (Agricultural) Zone District. This project is west of and adjacent to CR 59. Parcel number 121535000008, 121535000009, 130502000001, and 130511000002. Access is from CR 59 Access: An access permit has been approved for the access to the site (AP15-00519). The following are the special requirements and comments: Parcel 121535000009, 121534000003, 121527000004, & 121526000010. Utilize existing access point on CR 59 (1 -Industrial) located approx. 5285 ft. North of CR 20. For shared accesses, Public Works strongly recommends that the property owner establish an access road maintenance agreement so future owners of the properties will be aware of their requirements for shared maintenance of the access road. This is not a requirement for the recorded exemption but is recommended to avoid property owner conflicts in the future. Roads: County Road 59 is a paved road and is designated on the Weld County Road Classification Plan as a arterial road, which requires 140 feet of right-of-way at full buildout. The applicant shall delineate on the site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right- of-way. This road is maintained by Weld County. The County Road 59 Section Line is estimated to have 60 feet of unmaintained section line right-of-way per the Weld County GIS right-of-way map. The applicant shall delineate the existing right-of-way on the site plan. All setbacks shall be measured from the edge of right-of-way. Traffic: Latest ADT on CR 59 was taken on 7/9/14 which counted 742 vpd with 70% trucks. A Traffic Study was submitted with the application materials and indicated that there will be approximately 424 daily roundtrips. The expected traffic routes are CR 59 to CR 18 to Market St. The facility meets the warrant for a left deceleration lane from CR 18 onto Market Street. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. More than 10 round truck trips/day (tandem or semi -trucks) or more than 50 round passenger vehicles trips: Access onto gravel roads requires a tracking control device and a minimum of 300ft of recycled asphalt or road base. • Access onto paved roads requires either a tracking control devise and 100ft of asphalt OR 300ft of asphalt. `Recycled concrete is not allowed in County ROW "Tracking control devices can be double cattle guards or other specialized device "" Tracking control for unmaintained public ROW is required just prior to entering publically maintained roadways. A development standard will be included on the recorded site plan. "The access shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking." Improvements and Road Maintenance Agreement: An Improvements Agreement between the Applicant and the County will be required for this project. Items may include the approved haul route(s), outline when offsite improvements will be triggered, and include a maintenance agreement for the haul routes. Improvements/Road Maintenance Agreement: An example agreement is available at: http://www. co.weld. co. us/Departments/Plann incZon i no/Land U seApplicationsAssistance/ApplicationAssist ance.html An Improvements Agreement is required for sites with required offsite improvements. Collateral is required to ensure the improvements are made. Road Maintenance is typically included as a section of the Improvements Agreement when the County feels that the site activities may impact the County roadways. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. CONDITIONS OF APPROVAL: A. An Improvements and Road Maintenance Agreement is required for offsite improvements at this location. Road maintenance including dust control, damage repair, specified haul routes and future traffic triggers for improvements will be included. (Department of Public Works) B. The plan shall be amended to delineate the following: 1. County Road 59 Section Line is shown to have 60 feet of unmaintained section line right-of-way per the Weld County GIS right-of-way map. Show and label the approved tracking control on the site plan. 4. Show and label the section line Right -of -Way as "CR 59 Section Line Right of Way, not County maintained" (Department of Public Works) Prior to Construction: A. The approved access and tracking control shall be constructed prior to on -site construction. (Department of Public Works) Prior to Operation: A. Accepted construction drawings and construction of the offsite roadway improvements are required prior to operation. B. A left deceleration lane on CR 18 turning onto Market Street is required prior to operation. DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. The access on the site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. (Department of Public Works) 3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized. (Department of Public Works) 4. Access will be along unmaintained County right-of-way and maintenance of the right-of-way will not be the responsibility of Weld County. (Department of Public Works) MEMORANDUM TO: Chris Gathman, Planning Services DATE_ August 23. 2016 FROM: Janet Lundquist, Public Works SUBJECT: Buffalo Ridge Energy Services Facility -Traffic Counts Weld County Public Works has received a Traffic Count Analyses for the Buffalo Ridge site prepared by Matt Delich. After reviewing the submitted materials and recent County traffic counts I have prepared the following comments: The County worked with the applicant and gathered newer traffic counts to evaluate the area and the existing traffic volumes in the area the traffic counts were taken the 8/4/2016: The ADT on CR 59 was 612vpd with 50% trucks. The ADT on CR 18 East of Market was 661 vpd with 50% trucks. The ADT on CR 18 West of Market was 951 vpd with 25 % trucks. In advance of this Development Case Public Works staff identified that the intersection was signed incorrectly with a stop sign stopping the east bound traffic at the intersection of CR 18 & Market St. Public Works will be removing this sign to correct this error that is out of compliance with the MUTCD. The intersection is most likely meeting warrants for a left deceleration lane from CR 18 on to Market Street at this time. However the applicant has indicated that there will be 424 daily roundtrips or 848 daily single trips to the for this proposed development meaning that the traffic count will raise from 661 vpd to 1,509 vpd and increasing the truck traffic from 50% trucks to 71% trucks. The proposed development is triggering the need for the turn lane entirely based upon its own trip generation. For that reason Public recommends that the applicant solely pay for the roadway improvement entirely instead utilizing a proportional share in this case. Public Works recommends that the applicant be responsible for the approved design and construction of a left deceleration lane on CR 18 turning onto Market Street prior to operation of the new development.
