STREET, EATON, COLORADO 80615 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 20th day of Sept- ° ember, 1978 at 2 : 00 o'clock p.m. , for the purpose of hearing the petition of Jay Steinberger, Eaton Ford, Inc. , 10 Oak Street, Eaton, Colorado 80615 , requesting a change of zone from A-Agri- cultural to C-Commercial District for the following described parcel of land, to-wit: A tract of land located in the East Half (E?) of the Southeast Quarter (SM.) of Section 25, Township 7 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, being more particularly described as follows: Commencing at a point on the West right-of-way line of U.S. Highway #85, from which the Southeast Corner of said Section 25 bears south 47°55'00" Fast, 19.11 feet; and thence south 16°22'00" East, 385.00 feet; and thence south 430.00 feet; and considering said west right-of-way line to bear south 16°22'00" East, with all bearings contained herein relative thereto; Thence along a seep ditch line, surveyed by the county surveyor (Moody) in 1937 and referred to in Book 1074, Page 538 of the records of Weld County by the following courses: North 47°55'00" West, 435.89 feet; North 31°18'00" West, 356.83 feet; Thence north 37°15'00" East, 390.63 feet more or less to a point on the west right-of-way line of U.S. High- way #85 Thence along said west highway right-of-way along arc of a curve to the right having a radius of 11,375.00 feet and whose long chord bears south 19°21'33" East, a distance of 102.85 feet to a point on the curve. (Not a point of tangency.) Thence south 16°22'00" Fast along said west right-of- way line, 845.80 feet to the True Point of Beginning; Said tract contains 4.00 acres. WHEREAS, the petitioner was present and presented evidence on his behalf, and WHEREAS, Section 8 . 2 and 8. 3 of the Weld County Zoning Reso- lution authorizes the Board of County Commissioners to grant a change of zone upon the showing by the petitioner of certain facts, and 780029 Gs 1767873 V^-c WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, has studied the request of the petitioner and the recommendations of the Weld County Plan- ning Commission, and having been fully informed and satisfied that the request for re-zoning complies with the Weld County Compre- hensive Plan and the conditions set out in Section 8 .2 and 8 . 3 of the Weld County Zoning Resolution; NOW, THEREFORE, BE .IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the petition of Jay Steinberger for a change of zone from A-Agricultural District to C-Commercial District on the above described tract of land be, and hereby is, granted. RECOMMENDATION August 15, 1978 fact that commercial development has occurred in the immediate area. This development has taken place subsequent to the approval of the original zoning and the adoption of the Weld County Comprehensive Plan. 2. This request agrees with the goals and policies outlined within the Weld County Comprehensive Plan in that the request for commercial development is in accordance with the desires of the Town of Eaton. The Town of Eaton Planning Commission recommended approval of this request . 3. The Weld County Engineering Department has set forth no objections to this request . 4. The Colorado Geological Survey has set forth no objections to this request provided the applicant considers the Geological Survey ' s recommmendations in its letter dated July 25, 1978. 5. The Eaton Area Fire Protection District has set forth no objections to this request . 6. The Weld County Health Department has set forth no objections to this request . The Planning Commission recommendation for approval is subject to the applicant improving the existing shoulders of U.S . Highway 85 to serve as accel/decel lanes to the property. Construction of the accel/decel lanes shall be in accordance with the specifications and/or recommendations of the Colorado Division of Highways. This has been requested by the Colorado Division of Highways in its letter dated July 19, 1978. Comments : The applicant has submitted a petition form signed by all adjacent property owners in support of this rezoning request . The Mead lateral forms the went_ern houcfdar-e or the property. lice drainage plan submitted with the request indicates that the western houndary along the channel will- he sloped to 4 : 1 , leaving a channel hottom 20 feet wide. The plan indicates that a 1,230 cubic feel per second discharge will_ he present in the Mead lateral during n 100 year I Lend event. The plan also indicates that I Bias discharge would he contained in the channel at a 9 foot depth. Based on [he 9,230 cfs, a 20 foot channel width and 4: I slopes will require a channel grade of 2.57 to carry the dis-charge volunm. With a channel grade less tlfan 2.57 and. down to 1.257, the flow depth will be 11 .0 ₹eet. The plan was hatted on an overall channel grade of l.257 which indicates that actual flow depth may be greater than stated in the plan. The drainage plan also indicated that all storm runoff from the developed area should he contained in a detention pond and released through an eight inch corru- gated metal pipe. The figures for a 26,000 cubic foot detention pond seem ade- quate and reasonable to contain expected runoff. So vegetative plan was submitted with the request for evaluation. Consideration should be given to vegetation of the 4:1 slope along the Mead lateral, as well as vegetating the area adjacent to the slope which will carry the runoff to the de- tention pond. This will lessen the erosion potential as well, as acting as a de- silting area which wilt prolong the life span of the detention pond. We ask for your consideration of the following comments. 1 . There are two existing points of access for this site. The northernmost of the two does align with an -existing median opening and left-turn lane. There does appear to be adequate storage length in the left-turn lane to provide for an increase in left-turn movements which would occur in the event of favorable action on this application. We -do take exception to item number 4 of the petitioner's answers to the Planning Commission. It is true that acceleration and decel-er-ation lanes should -be incorporated into the access -clan for this site. However, the existing eight-foot shoulder does not constitute an -accel/detel lane. We have attached to this letter specifications to which these shoulders should be improved in order to serve as accel/decel lanes. This improvement would be the responsibility of the developer. After a final development plan is approved, an application fora Iriveway Permit will need to tae made to David N. Fraser, District IV Maintenance Superintendent, P. 0. Box 850, Greeley, Colorado 80_632. This application shoulid include three copies of an approved plan showing details of construc- tion work to be -done in State - Highway right of way. We would assume that the existing 20- and 24-Toot-wide openings may need to tae widened to 35 fe-et. 2. We should add that we do have some reservations about allowing commercial development to occur along an access-controlled highway.
