HomeMy WebLinkAbout20161555.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MAY 11, 2016 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, May 11, 2016, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer - EXCUSED Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Senior Accountant, Chris D'Ovidio O MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of May 9, 2016, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. • AMENDMENTS TO AGENDA: Commissioner Cozad moved to amend the Agenda and to add the following two (2) items to the Agenda under New Business: 4)Authorize Filing of Proceedings in Eminent Domain, Pursuant to Section 38-1-101, C.R.S., against Jeff and Deanne Maxey, and 5) Authorize Filing of Proceedings in Eminent Domain, Pursuant to Section 38-1-101, C.R.S., against George and Eloise Maxey. Commissioner Cozad moved to amend the Agenda. Seconded by Commissioner Moreno, the motion carried unanimously. �',_J CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Moreno seconded the motion, and it carried unanimously. ▪ PUBLIC INPUT: No public input was given. J COMMISSIONER COORDINATOR REPORTS: Commissioner Cozad attended the Poudre Trail Board Meeting and attended, as a representative, the MPO Meeting and lastly, she reported on the success of the Hill-n-Park Clean-up and extended her thanks to all the volunteers who helped make the event successful. Commissioner Conway reported he attended the South Platte Round Table Meeting. The Commissioners expressed their disappointment that Senate Bill 210 failed and the voters didn't get a chance to vote regarding funding for transportation for the state. Commissioner Moreno attended Minutes, May 11, 2016 2016-1555 x/1O Page 1 BC0016 a luncheon for Society of Petroleum Engineers and went to the Evans Economic Development Advisory Council Meeting. Chair Freeman stated he attended the ground-breaking for a new park in New Raymer, where they are re-doing the park, lying sidewalks, and installing new equipment. He is appreciative of the partnership with Noble and Weld County. BIDS: IR 1) PRESENT BID #B1600037, WEB CONTENT MANAGEMENT - DEPARTMENT OF INFORMATION TECHNOLOGY: Ryan Rose, Director of the Department of Information Technology, presented the seven (7) bids received, and explained two have been disqualified. He advised staff will bring back a recommendation on May 25, 2016. O 2) PRESENT BID#61600100, CISCO EQUIPMENT MAINTENANCE RENEWAL- DEPARTMENT OF INFORMATION TECHNOLOGY: Mr. Rose presented the two (2) bids received and stated staff will make a recommendation on May 25, 2016. NEW BUSINESS: O 1) CONSIDER TEMPORARY CLOSURE OF CR 51 BETWEEN CRS 44 AND 46: Janet Lundquist, Department of Public Works, reviewed the terms of the closure effective May 31, 2016, through June 3, 2016, for a culvert replacement and stated staff will use water for dust abatement, standard road signs and barricades. Commissioner Moreno moved to approve said closure. The motion was seconded by Commissioner Cozad, and it carried unanimously. Eti 2) CONSIDER TEMPORARY CLOSURE OF CR 25 BETWEEN CRS 52 AND 54: Ms. Lundquist presented the closure effective May 24, 2016, through May 27, 2016, for a culvert replacement and reported staff will use magnesium chloride for dust control, standard road signs and barricades. Commissioner Conway moved to approve said closure. Seconded by Commissioner Moreno, the motion carried unanimously. • 3) CONSIDER TEMPORARY CLOSURE OF CR 45 BETWEEN CRS 42 AND 44: Ms. Lundquist reviewed the closure effective May 24,2016, through May 27, 2016, for a culvert replacement and will use water for dust abatement, standard road signs and barricades. Commissioner Moreno moved to approve said closure. The motion, which was seconded by Commissioner Cozad, carried unanimously. El 4) AUTHORIZE FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST JEFF AND DEANNE MAXEY: Bob Choate, Assistant County Attorney, made known the Maxey's are being represented by Doug Widlund, a Domain Attorney. Mr. Choate explained the County Attorney's Office needs to initiate a condemnation process in order to obtain the right-of-way and keep the County Road 49 project on schedule. Mr. Choate stated the additional $32,000.00 requested was from the land owner with no back-up provider. Commissioner Moreno expressed his appreciation with staff working diligently and fairly with the Maxey's to try and reach a fair agreement. Commissioner Conway moved to authorize said filing of proceedings in eminent domain. The motion, which was seconded by Commissioner Moreno, carried unanimously. 5) AUTHORIZE FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST GEORGE AND ELOISE MAXEY: Mr. Choate presented the original offer to George and Eloise Maxey for the amount of$47,000.00. Mr. Choate explained the filing of condemnation is to keep with the schedule. Commissioner Cozad moved to authorize said filing of eminent domain. The motion, which was seconded by Commissioner Moreno, carried unanimously. Minutes, May 11, 2016 2016-1555 Page 2 BC0016 RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
