A public hearing was conducted on April 13 . 2016. at 10 : 00 a . m . . with the following present:

The following business was transacted :
P I hereby certify that pursuant to a notice dated March 23 , 2016, and duly published
March 30, 2016, in the Greeley Tribune, a public hearing was conducted to consider the request
of John Johnson . c/o Sterling Energy Investments , LLC , for a Site Specific Development Plan and
Use by Special Review Permit, USR15-0072 , for Mineral Resource Development Facilities ,
including Oil and Gas Support and Service (six (6) compressors) in the A (Agricultural) Zone
District . Bob Choate, Assistant County Attorney. made this a matter of record .
P Chair Freeman reviewed . for the applicant and the public, the procedures to follow should
either case result in a tie vote due to four Commissioners being present and one Commissioner
excused .
a Kim Ogle . Department of Planning Services , presented a brief summary of the proposal
and reported this case was continued on February 10 . 2016 . to allow for state mandated mineral
notification : and , continued again on March 23, 2016 . due to a County closure related to inclement
weather. He presented a brief summary of the proposal and reviewed the location stating the site
is within the three (3) mile referral area of the Town of New Raymer, which indicated no objections
in the referral response. Mr. Ogle described the surrounding property uses and reported receiving
one telephone call and one letter citing concerns regarding noise and requesting sound barriers
on the equipment. He explained the applicant's intent to expand their operations in Weld County
and he stated at this location there will be six (6) compressors at full buildout operating 24 hours
a day and seven (7) days a week. Mr. Ogle stated twelve ( 12) referrals were sent out and staff

received two (2) responses with comments taken into consideration . He displayed images of the
site and surrounding properties and entered the favorable recommendation of the Planning
Commission into the record as written .
Ea Janet Lundquist, provided a brief overview of the transportation plans and requirements
stating the approved access is from County Road (CR) 129 , has been approved under Access
Permit Number, AP15-00433 . She reviewed the traffic counts and stated due to low traffic volume ,
there is no requirement for tracking control or an Improvements Agreement.
Wayne Howard , Planning Services Engineer representative . stated the site meets the
drainage exemption and there are no further requirements .
Lauren Light. Department of Public Health and Environment. reviewed the water and sewer
provisions .
Ms . Rimel , represented the applicant and stated this compressor station is essential to the
overall operations. She presented a PowerPoint Presentation reviewing the basic plan for
operations , site location. existing compressors combined with additional compressors at full
buildout for this location . equipment, and storage . Ms . Rimel stated there are future plans to put
up a building at this site and an application for a building permit has been submitted .
P Ms. Lund stated this site is similar to other systems ; however this location is a hub for the
gathering system . She explained the hub gathers from three directions and can send product in
three directions. Ms . Lund reviewed the SPCC Plan , approximate truck trips , Air Pollution Control
Division Permit, employees requirement to be OSHA trained , and that the equipment is on a Skata
System to be monitored 24 hours a day and seven (7) days a week with personnel assigned to
visit the site every day.
La No public testimony was offered concerning this matter.
Commissioner Cozad requested clarification regarding the building permit and addressing
the noise issues. She corrected Development Standard (DS) #3 , and recommended deleting DS
#20 and #21 . The Board agreed .
Chair Freeman clarified for the record the change from five (5) compressors to six (6)
throughout the Resolution . as corrected by the applicant. The Board agreed to the correction .
In response to Chair Freeman , Ms . Lund on behalf of John Johnson , c/o Sterling Energy
Investments , LLC , indicated no further changes or concerns with the Conditions of Approval or
Development Standards and stated they have reviewed , and agree to abide by, the Conditions of
Approval and Development Standards, as amended .

Commissioner Moreno moved to approve the request of John Johnson , c/o Sterling Energy
Investments , LLC for a Site Specific Development Plan and Use by Special Review Permit,
USR15-0072 , for Mineral Resource Development Facilities, including Oil and Gas Support and
Service (six (6) compressors) in the A (Agricultural) Zone District, based on the recommendations
of Planning staff and the Planning Commission , with the Conditions of Approval and Development
Standards as amended and entered into the record . The motion was seconded by Commissioner
Cozad . Commissioner Cozad expressed her appreciation for the applicant's patience regarding
the continuances . Chair Freeman concurred . The carried unanimously. There being no further
discussion . the hearing was completed at 11 : 13 a . m .
This Certification was approved on the 18th day of April , 2016 .
