A public hearing was conducted on May 18 . 2016 . at 10 : 00 a . m . , with the following present:

The following business was transacted :
I hereby certify that pursuant to a notice dated March 25 , 2016. and duly published March 30,
2016 . in the Greeley Tribune . a public hearing was conducted to consider the request of Ivar and
Evelyn Jordan Children ' s Trust, c/o Berven Industries , LLC , DBA New Deal Deicing . LLC . for a
Site Specific Development Plan and Use by Special Review Permit. USR16-0008 . for any Use
permitted as a Use by Right. Accessory Use . or Use by Special Review in the Commercial or
Industrial Zone Districts (office . manufacturing and warehouse facility for airfield de-icing
production company) provided that the property is not a lot in an approved or recorded subdivision
plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in
the A (Agricultural) Zone District. Bob Choate . Assistant County Attorney . made this a matter of
record .
[57: Chris Gathman , Department of Planning Services, presented correspondence from the
applicant, dated May 16 . 2016, requesting withdrawal of the request in response to the
surrounding opposition .
�2 Commissioner Moreno moved to accept the request of Ivar and Evelyn Jordan Children's
Trust. c/o Berven Industries , LLC , DBA New Deal Deicing , LLC , to withdraw the application for a
Site Specific Development Plan and Use by Special Review Permit . USR16-0008 . for any Use
permitted as a Use by Right. Accessory Use. or Use by Special Review in the Commercial or

Industrial Zone Districts (office. manufacturing and warehouse facility for airfield de-icing
production company) provided that the property is not a lot in an approved or recorded subdivision
plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in
the A (Agricultural ) Zone District. The motion was seconded by Commissioner Kirkmeyer. and it
carried unanimously. There being no further discussion , the hearing was completed at 10: 23 a . m .
This Certification was approved on the 23rd day of May, 2016 .
