EXHIBIT 1 1 In regards to USR application # USR15-0974 Dog Rescue The purposed "USR15-0074" (Use by Special Review) will have a negative impact on the surrounding areas. The noise of a large amount of barking dogs is a disturbance to the regularly quite and serene environment. The approval and continuation of this operation will cause the surrounding area to be less desirable to own, develop and resale. In essence this will cause a diminishing value of property compared to not having this operation near by. Reference the below county code. Sec. 23-2-200. - Intent and applicability. A. Uses by Special Review are USES which have been determined to be more intense or to have a potentially greater impact than the Uses Allowed by Right in a particular zone district. Therefore, Uses by Special Review require additional consideration to ensure that they are established and operated in a manner that is compatible with existing and planned land USES in the NEIGHBORHOOD. The additional consideration or regulation of Uses by Special Review, and the application to a Use by Special Review of Performance, Design and Operations Standards listed both herein and for applicable USES from any zone district, are designed to protect and promote the health, safety, convenience and general welfare of the present and future residents of the COUNTY. Although the below statue does not reference an aquiculture zone I believe for this purpose this would be the best standard to consider . 25-12-102 Definitions — (6) "Residential zone" means an area of single-family or multifamily dwellings where businesses may or may not be conducted in such dwellings. The zone includes areas where multiple- unit dwellings, high-rise apartment districts, and redevelopment districts are located. A residential zone may include areas containing accommodations for transients such as motels and hotels and residential areas with limited office development, but it may not include retail shopping facilities. "Residential zone" includes hospitals, nursing homes, and similar institutional facilities ++++++++++ 25-12-103 Maximum permissible noise levels (1 ) Every activity to which this article is applicable shall be conducted in a manner so that any noise produced is not objectionable due to intermittence, beat frequency, or shrillness. As has been proven by this past 6 months of continuous noise, this will be a concern for more than just the persons residing within 500ft of the property in question. It will also, in my opinion, deteriorate the value of the properties for at least a 1/4 mile radius around this property. My extended family was in town for a week several months back for my daughter to get married. I was embarrassed to have them sit outside and try to enjoy the beautiful Colorado weather and scenery due to the levels of noise radiating from said property. This has continued to be true and will continue to be true if the animal shelter is allowed to remain. It is unfortunate that the persons involved in purchasing the home and land and opening the shelter did not take anyone but themselves into consideration. We all want for animals to be safe and not be abused, but a much better choice in location could have been chosen. At the very least, a person with any type of respect for their present and/or future neighbors would have talked to the community in which they would be opening this shelter and make sure that everyone was happy for this to become part of our lives. They did not, nor did they even reach out to anyone in the neighborhood for many months after moving in. The parties in question only contacted their neighbors when we began to make complaints to the county. I do not feel that I should be subjected to disturbance of the peace every day at our home. While I am gone much of the time because I work in 3rd world countries all over the world so that I may provide a good and decent life for my family, it is disturbing for me to think that I have worked so hard and in so many dangerous places only to be subjected to this when I am home with my family. And, they live with it every day. I'm glad that these people made so much money from the stock market while living in California that they are able to retire early and pursue something they feel needs to be done. However, that does not give them the right to move to Colorado and demand that we give up our rights to peace and serenity in our own homes and most likely lose a good deal of value in our properties. I ask that whoever is making this decision please consider whether they would want this next to their own home. I think the answer to that is pretty evident. No one wants to walk outside their home to listen to 50+ dogs barking incessantly day after day. And, would you consider what would happen to your property value if a dog shelter were to be allowed to move in next to your home. I have worked too hard to allow this to happen. I am writing this letter from Kakinada, India. I will be unable to attend this hearing due to this. While my address is on County Road 102, my house sits 1/2 mile south of CR 102. I am opposed to the approval of this Special Use of the property in question. Mostly because this event began with a blatant violation of Weld County Codes. People that run these Dog Rescues know there are laws that regulate them. While their intention to care for unwanted dogs is admirable, they seem to have no concern for laws regulating them. In this case the owner simply didn't care about the local neighbors nor the existing serene, and regularly quiet environment of living in the country. While there are certainly barking dogs, livestock noises, and farm noise common to the country life we all love, these are usually within the agriculture guidelines of our agriculturally based County. There is nothing more obnoxious than having to listen to 50 constantly barking dogs while trying to enjoy the country life we pay a premium for. My concern is that if these Special Review Applicants were only caught by the complaint of neighbors, and later forced to comply with County Codes and Restrictions on this endeavor, what will be the ongoing compliance enforcement by the County? It is my understanding that many dogs are coming across the border from Mexico and land in these dog rescues. These dogs must be in quarantine for 30-60 days before being released to come into the United Stated. How will Weld County enforce this and the many other rules and regs on this property? It is also my understanding that this situation currently has more dogs on the property than will be allowed if this Special Review is approved. Please consider the enforcement issues. Other questions I have are what is done for the health of all dogs on the parcel? How is the feces of all these dogs being handled and disposed of? What is the cleanliness of the dog cages and holding pens. How are all these dogs exercised? What sound proofing is being done to keep the noise levels down for the local / close-in neighbors? What ventilation is being given for these dogs? Additionally my concern is for the close-in neighbors and my property values being diminished by the overwhelming local noise, as well as how the County will enforce any approved variance when the applicant began this issue with an unwillingness to abide by County Regs? I was in the Stock Brokerage Industry for 21 years before retiring and becoming involved in Animal Rescue. I have been an animal lover my entire life. When deciding on "where" to move permanently, we decided on the Fort Collins/Wellington area as I have family there and have made many visits . I was never blatant about the County rules. I was simply ignorant of them. When looking for a place, I was specific about Agricultural, no close neighbors, No HOA, No CC&R's, out in the country, etc. I fully explained to the previous owners what our plans were, and that was to run an Animal Rescue. Never once was I told that I should check with County Zoning or anything even remote. My real estate agent was told that, since it was zoned Ag, I didn't need to worry about anything unless a complaint was filed . Sadly, I never imagined anyone would complain about someone rescuing dogs. We moved in May 27th 2015. I never, for one minute, would have sunk my entire life savings, approximately $150, 000, into building this facility if I thought I would NOT be able to run it. No one intentionally "breaks" rules and spends that kind of money. Again , I was never aware of the County Zoning Rules. To my knowledge, I was REQUIRED to file with The Secretary of State of Colorado for Incorporation (we did), File with the IRS for our Tax Exempt Status (we did) and both were effective June 15th 2015. My next step was to contact The Department of Agriculture (PACFA) but prior to getting to that step, we received notice from County Zoning. IMMEDIATELY upon being notified by them, we began working with them to satisfy their requirements. I was never FORCED to do anything . I did not know I needed to and when I found out, I was more than happy to comply. As I will comply going forward. I am not looking for problems or trouble. I simply want to save these animals' lives and run our business. EXHIBIT 9 Since that time, I have abided by all rules, supplying the Zoning Department with their requirements. I have been inspected by The Department of Agriculture and was given high praises for our facilities, the care of the animals, the cleanliness etc. Once we (hopefully) receive our USR Permit, I've already been told we will be given our PACFA license. I have also been inspected by 2 Vets and PetSmart stores and given high praises as well . I always care about other people but truly did not think DOGS would be any more of a nuisance than cows, goats, roosters, other dogs that are left out ALL NIGHT and bark ALL NIGHT, etc, or the extreme smell and odors these such animals create. It is simply the country and that's what goes with the country. We actually go above and beyond to mitigate noise. I have had MANY people inspect for noise. The ONLY time these dogs bark is at breakfast and dinner, each for about 15 minutes_ They are kept inside day and night during the winter. If the sun is out and it's warm , they get much more time outside. Each dog has an indoor kennel and an outdoor kennel with a magnificent dog house. They exercise in 136' long cattle pens with 10 foot fences. I would never appreciate OBNOXIOUS barking and therefore we do everything we can to keep barking to a minimum . We don't want to hear it either and we don't. They are definitely quiet for the most part. ALL OF OUR DOGS that come to us from a Rescue in Tijuana , Mexico, are FULLY VETTED prior to arriving . They are all spayed/neutered , vaccinated , checked for diseases and spend anywhere from 30 to 60 days in foster homes before arriving here. We then take them to our vet in Wellington , for Heartworm testing (none have been positive) and provide them 6 months of Heartgard and 3 mos of Bravecto flea/tick medicine. We also have them microchipped . So EVERY DOG that comes into our rescue is 100% vetted and healthy before ever being adopted . Our vet will be on hand at both meetings to attest to the health of our dogs. All feces is cleaned multiple times each day and disposed of in construction garbage bags and thrown in our dumpster out front which is cleaned out every Tuesday. Small and medium dogs are kept in a shed that is 3600 square feet with heat and when the weather is nice, we open doors at both ends. But when weather is cold , the building is plenty big enough for ventilation . Large dogs are kept in a 32' x 40' barn that was converted to a dog house. It has a large propane heater that we can use once we get the permit for winter. It has 6 windows to open in the summer. Dogs are put out 3 to 4 times a day to potty and run depending on weather conditions. Our dogs are extremely well cared for. The feeling we get when we find that perfect home for a dog who was living on the streets, freezing to death , starving , being eaten by predators, or beaten by local kids, is an amazing feeling . We even had one of our hospice dogs adopted by a local nursing home. I am truly sorry for any inconvenience caused but I do believe that as time goes on , our rescue will only get better and everything will be improved , We invited you to come see our facilities and get an idea for yourself how we do things. It really helps to read your points and understand your situation better which is what this review process is for. Enforcement and compliance is important to people especially when it happens "in their back yard", and you should have done your due diligence before buying land regardless of what a real estate agent does or does not say. All the same, rescuing the dogs is also an important task, and I admire you for doing it. I wanted to find the balance and reading your response has helped. However, your neighbors that are close by have obviously complained and the ones I know do not just complain for no reason. So as diligently and respectfully as you responded to me, I'm sure you'll respond to them. They are closer and may hear things I cannot regarding barking dogs and any odors. Yes I do hear the dog left out by others that bark all night, or most of the night. But an individual with a single dog is not in violation of Weld County regs nor do they need County approval. Again, I do respect you for the care you have for rescuing these dogs from horrible situations. But we don't know of the health issues and what you are doing to prevent something from being spread to other animals in the area. Thank you for responding it has cleared some things for me. Thanks, Corey The proposed "USR15-0074" (Use by Special Review) is not an operation that will be a welcome addition to our neighborhood, not to mention the impact it will have on the value of our carefully selected properties. We chose this area almost 20 years ago based on the ambiance projected by the rural, country atmosphere . The quiet and solitude we experience here is frequently pointed out as an asset by those visiting us. The noise created by the rescue operation is already at noticeably unacceptable levels. Even though our property is at a substantial distance from theirs, we still experience disturbing levels of noise that disrupt and antagonize our pets and livestock. Messick - Property Owner or "Applicant" Township 9 North, Range 67 West Section 29: part of the W/2SE/4 ("Property") Weld County, Colorado Mr. Gatham: This objection and notice letter is submitted to Weld County ("County") on behalf of Anadarko Land Corp. and Anadarko E&P Company with respect to USR15-0074 that has been filed with the County by Edie A. Messick ("Applicant") that includes property in the W/2SE/4 of Section 29, Township 9 North, Range 67 West in Weld County. Anadarko Land and Anadarko E&P (the "Anadarko entities") together own the minerals that underlie the property located in Section 29 ("Property"). The Anadarko entities wish to give notice to the County of the mineral interests they own under the Property and make the County aware that the approval of a final application may significantly impact the prospective development of the minerals that underlie the Property. The Anadarko entities object to the approval of a final application for development until agreements on surface use are reached among the Anadarko entities and the Applicant covering the Property. The following are comments in support of this Notice and Objection: EXHIBIT I a 1 . The Mineral Resources Owned by Anadarko Land Corp. Anadarko Land owns all of the hard rock minerals, including the coal, that underlies the Property. 2. The Oil and Gas Resources Owned by the Anadarko Entities. The Anadarko entities together own all of the oil and gas that underlies the Property. Colorado Oil and Gas Conservation Commission ("COGCC") reports reflect that there are currently no producing wells in Section 29. Current COGCC rules and regulation provide for five drilling windows in a quarter section where the Property is located, one in the center of the quarter section and one in the center of each quarter quarter section. 3 . There is Clear Statutory Authority and Direction for the County to Take Into Account the Rights of Mineral Interest Owners in Its Consideration of Applications for Development. The State of Colorado recognizes the important rights of mineral owners and lessees in C.R.S. § 30-28- 133(10) which states and acknowledges that both the mineral estate and the surface estate are interests in land and that the two interests are "separate and distinct." The subsection specifically recognizes that the owners of subsurface mineral interests and their lessees have "the same rights and privileges as surface owners." 4. Owners of Split Estates Must Exercise Their Rights in a Way that Gives Due Regard to the Rights of the Other. Colorado law provides that the mineral owner has the right of reasonable access to and use of the surface estate to extract minerals and that the mineral estate owner and the surface estate owner are to give due regard to the rights of the other and reasonably accommodate each other's rights. 5. The Anadarko Entities Have Entered into Many Agreements with Developers with Respect to the Disposition of the Minerals at the Time that the Developer Proposes to Develop the Surface Estate, and the Public Interest is Served by the Parties Entering into Such an Agreement. The mineral assets have significant value and consequently the Anadarko entities are concerned that the approval by the County of an application for development of the Property and the subsequent build-out of the Property may impair their ability to develop their minerals. Any future surface development plans approved by the County should incorporate and designate lands to be set aside for oil and gas development and expressly provide protection for future wells, pipelines, gathering lines and related oil and gas facilities and equipment. Approval of any surface development plan that forecloses the rights of mineral and leasehold owners may be a compensable taking. The Anadarko entities have extensive mineral interests throughout the State of Colorado and have successfully worked with many parties who wish to develop the surface estate in order to assure the compatible development of the surface estate and the oil and gas estate or some other disposition of the minerals. The practice of the Anadarko entities is to meet with surface owners to reach a mutually acceptable agreement, including the disposition of the hard rock mineral interests. To date, the Anadarko entities have not had any discussions with the Applicant on this matter. Because no agreement has been reached between the parties that covers the Property, and in order to protect their mineral interests and private property rights, the Anadarko entities object to the application and request that the County make any approval of a final application for development of the Property conditioned upon an agreement among the Anadarko entities and the Applicant. If the above conditions are included in the development standards I believe that my property rights have been preserved and will drop my objection to the use. I would like assurance from your department that a violation of the standards, especially when it comes to a noise complaint, that it will meet the degree of significance to warrant the staff time to bring it into compliance. We are here to pay a Debt to the Animal World for the abuses, neglect and abandonment perpetrated on them by Humans. We rescue dogs scheduled for euthanization from high kill shelters, other rescues or Owner Surrenders. It is rare to find a rescue who will take Owner Surrenders. We do whatever is medically necessary to heal them. We focus on those in desperate need that nobody wants. We have wonderful relationships with other rescues. Some save dogs from life on the street. Some are heartworm positive whom we have treated and rehomed. Some have been beaten and abused so terribly that rehabilitation can be lengthy. NO DOG leaves our rescue until fully ready. In addition to our dogs available for adoption, we have a small Senior and Hospice group. We have blind, deaf/blind, dying of heart/kidney failure and some simply too old to find another home. We provide them food, shelter, exercise and as much love as possible until The Rainbow Bridge calls them home. Our facility in Colorado can house up to 50 dogs, which includes our adoptables, personal, senior and hospice. Our adoption process is as follows: Adoption Application, reference checks, home visits and follow-up visits. Many adopters often send updated pictures. Our dogs do NOT leave an Adoption Event unless pre-arranged . We personally deliver to their new home. Every dog is fully vetted before adoption and includes Spay/Neuter, all vaccines, microchipped, heartworm tested and provided with 6 months of Heartgard and 3 months of Bravecto flea/tick preventative. In 2015, we rescued 120 dogs. 34 were adopted in Colorado; 32 were transferred to Sherry, a partner rescue in Seattle, 1 was returned to their owner and 1 was euthanized due to cancer. 52 remained going into 2016. In January 2016, we adopted 10 in Colorado, transferred 13 to Sherry, a partner rescue in Seattle and 29 remained. In February, we have 14 separate Adoption Events planned. For our first year of rescue, 6/15/2015 - 12/31/2015, we had $198,000 contributed of which $17,000 were outside donations, $8,745.49 were adoption fees and $172,254.55 was contributed as a one-time private donation. We spent $101,000 on Operating Expenses which includes vetting, dog food, transports, rescue fees, dog supplies, training. Every once in a while we strike gold . We find that willing rescuer who answers our desperate call for help. Enter Edie and The Animal Debt Protect. Ellie Messick, through her Colorado rescue, has answered that long distance call on more than one occasion . Members of the Board; I am writing this letter in support of the Animal Debt Project, Inc. (ADP). My family began searching for a dog to add to our family several months ago. Being a family who prefers to rescue animals in need, we turned to our county humane society. After several visits, we met with a dog we thought would fit well with our family. It quickly became clear that the staff at the humane society did not know their animals, and all of us came out of the experience with cuts and bruises. Moreover, the cleanliness of the facility left much to be desired. This is far from the case in our experience with Edie and the ADP. We went to an adoption event in Fort Collins and the staff took the time with us to discuss the different animals they had brought. Simply put, they know their animals. Noticing our interest in a beautiful boy named Gumbo, Jeff stepped in to discuss the fact that he felt this particular boy would be too powerful for my 69 year old mother. We did not receive this kind of feedback from other rescues or even the humane society. We then asked about Ace; an adorable lab-schnauzer mix. Having two elder cats we were concerned about the new member of our family having an affinity for them. Ace being young, the staff felt he would be accepting of our feline family members, and offered to take the time at the rescue to expose Ace to their cats and gauge his reaction and compatibility. Edie even went so far as to send us a video of Ace playing in the presence of the cats before she personally delivered him to us at our home. We recently had occasion to visit the ADP facilities, and we took Ace with us for the visit. It is quite easy to determine the care an animal receives from a shelter or rescue by their reaction when they return to see those who cared for them. Our Ace was ecstatic! His tail never stopped wagging, and he wanted nothing more than to give puppy kisses and receive hugs from Edie and her staff. It is clear these animals are very well cared for, and you can see from our boy's response how much the animals they rescue mean to the entire staff. Additionally, I cannot fully express how impressed my family was with the facilities. These animals, which were sure to be euthanized if not rescued, have such clean and well-cared for facilities until they find their forever home. Moreover, to find a rescue that accepts and cares for hospice animals is simply amazing. I had first met Edie about 7-8 months ago, at a animal showing she was having outside of a pet supply store . She had a dog that I fell in love with immediately, and wanted to take home so badly but knew it wasn ' t quite the right time . I stayed in contact with Edie, and when the time was right and the holiday ' s were past, and I knew I would have time to spend with my new dog, I asked Edie if I could come and meet with her . From the start Edie has been such an amazing person, she was very willing to take a lot of time to talk with me, and my wife about what dogs would be a good fit for our family (we have 2 smaller children ) . After a lot of conversation, we decided on a group of puppies she had recently brought in from a rescue in Texas and was helping to distribute the pups and the mother of the pups . She spent an incredible amount of time and resources in making sure the dogs got the best of care . The mom came in , in very bad shape . Covered in fleas and scabs/wounds etc , Edie got to work on the mom and the pups as well . It was a long road to recovery and she was there for it all . Edie is an absolute commodity to the rescue community . Her facilities are nicer than any I ' ve seen, there is a ton of room for the dogs she ' s working with to run and play . That combined with Edie ' s passion has made for a whole lot of happy pups . The dog we decided on was one of the ' Blue Lacy ' puppies that had the terrible flea problem . Edie helped us the entire time in ensuring the puppy was properly taken care of . She took us to vet visits to have shots given, had a skin test done to confirm that although there was a flea issue there was no mange, provided all the necessary creams and other care items to make sure my pup was as comfortable as he could be while he was healing up from his hard beginnings . I am so grateful to have met Edie when I did, and I am so thankful to know there is a place like the Animal Debt Project out there, that goes so far beyond that extra mile to ensure the animals in their care receive the absolute best care . I can attest that Edie and the Animal Debt Project should most definitely continue to run , because of the amazing care I have personally witnessed to these animals that had nowhere else to turn . Edie is a godsend to any animal that passes in front of her, and I am eternally thankful for Edie introducing me to the newest member of my family . I cannot express in words just how happy I am with our new family member, and I would most definitely be happy to discuss with any that have concern just how amazing of a person Edie is , and how much she is needed within this community . I have written this letter of my own free will, I was not once asked by any person to do this . . . I just felt it necessary because of how much I was helped by the Animal Debt Project . We, the below noted, are writing in support of The Animal Debt Project, Inc. We became acquainted with Edie Messick and her rescue organization in August of 2015, when we DESPERATELY needed a rescue to step up and help a female, black lab who was living on the streets of Houston, starving to death and being beaten by local neighborhood kids. Edie immediately responded and offered to take her in. At the last minute, before leaving Texas for Colorado, we asked Edie if she could take an additional lab who had been rescued from the streets as well and was living in boarding. Of course she said YES. Both Sunny (black lab) and Oliver {yellow lab) went to their facility at the end of August. Edie immediately got both dogs started on their 6 month Heartworm treatment. They flourished under the care of The Animal Debt Project. Even as Heartworm positive dogs, both dogs found their forever homes in October 2015. The Animal Debt Project continued to cover the heartworm treatment. Sunny and Oliver were doomed to abuse and a slow death on the streets of Houston before Edie took them in. Since that time, The Animal Debt Project has saved about 20 additional dogs from our streets and found them new homes. We have built a wonderful relationship with her and their rescue and are extremely grateful for their devoted love of these animals. We have never worked with a rescue like theirs and many dogs would die homeless without The Animal Debt Project. We believe in them and hope to have many y o working with them. It was a lucky day when Edie Messick, founder of The Animal Debt Project, saw my post on Facebook regarding an emaciated black Labrador. We had saved the dog off the street while picking up another ill street dog . We were in a horrible neighborhood and it was was just the two of us. Two women who qualify for senior discounts who had no business being there were putting two large dogs in our car. We had no idea that Edie Messick would be the their hero. The black labrador was just the first dog she would save from our area. She also took a yellow Labrador that we had been paying, to have boarded after saving him from the street. We were also able to save a Blue Lacy momma and her nine newborn puppies from one of our high kill shelters because Edie said she could take them . She took over twenty dogs from us in 2015 that would have died on the street or in the shelter. I understand it is long, but I hope you will find it worth the time given the sensitivity of this important issue. ! live in southern California, but am originally from Illinois, in the heartland of America. At the time I met Edie Messick she lived in northern California. A mutual acquaintance and animal lover/rescuer introduced us. I grew up in a large city, but was surrounded by agricultural areas. My great uncle and also a cousin of my mother owned farms in Illinois. My best friend grew up on a farm is Washington state. I understand that Weld County has a tradition of Agriculture as well as those farms that I was personally familiar with in the Midwest. Tradition is so very important to most of us; whether it be in our Country, our county, city or on a personal level in our families. Tradition is an important factor that holds us together as a group of people. However as I have aged, I realize that traditions change. Not the basic fiber of the tradition that keeps us together, but the changes that take place because of an ever changing world. The point of this letter is to appeal to your sense of understanding regarding the petition of Edie Messick to incorporate her non-profit, 501C3 Animal Rescue, ADP into Weld County. Visiting agricultural areas, I have been hard pressed not to find domesticated animals, especially dogs and cats on farms and ranches. These animals most often are working dogs, which show the degree of intelligence domesticated animals have. Sometimes these animals are also pets of the family who live on these lands. Human beings painstakingly domesticated these animals for centuries, all over the world. Unfortunately we also have an abundance of breeders, for purebred dogs and cats, but more frightening we have puppy mills. This is where some people, arbitrarily in many cases, breed dogs strictly for profit. If a puppy is born and is too small, for example they are drowned, without ever having a chance to live. That puppy may not bring them the most for their money. Many other atrocities take place and have caused the American Society for the Prevention of Cruelty to Animals (ASPCA), to find these mills, save the animals present, and penalize the owners to the full extent of the law, which varies from state to state. There are also backyard breeders who have one or two female dogs and breed them every time they go into a heat cycle. Once again for money, but never caring if the adult dogs being bred are free of any genetic defects. Then as often happens, a family purchases a puppy and soon finds out it has a genetic defect, such as dysplasia; a genetic disorder, typically 10 Please with that all is good and fair and moral; consider her appeal to obtain a permit in Weld County for her ADP Rescue.
