HomeMy WebLinkAbout790830.tiff RESOLUTION RE: DENIAL OF REQUEST BY ELVIRA IHNEN TO WAIVE PROCEDURE FOR AMENDING RECORDED EXEMPTIONS . WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 28 , 1979 , the Board of County Commis- sioners of Weld County, Colorado did, by resolution, approve Recorded Exemption No. 381 for Elvira Ihnen, and WHEREAS, due to an error when laying out the North boundary line of Lot A, Elvira Ihnen has requested that said Recorded Exemption be amended without going through the procedure for amending recorded exemptions, and WHEREAS, the Board of County Commissioners has studied the request and has heard the recommendations of the Weld County Department of Planning Services in this matter and finds that said request to waive the procedure for amending recorded ex- emptions should be denied. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that Elvira Ihnen shall be asked to go through the amended recorded exemption procedure in amending Recorded Exemption No. 381. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14th day of May, A.D. , 1979. Thank you for the help you have given us in the past on this matter, We apologize for requesting this change because you must have a busy schedule and your time is valuable. As Mr. Frederick explained in his attached letter, there was considerable snow on the ground when we laid out the boundary line. When things dried out this spring and the surveyors set the stakes, it was obvious that we had misjudged the flow of the irrigation water. Instead of improving the farm, we had made it worse. As you know, one of our aims was to bypass the bend in the ditch so as to make the planting and maintaining of crops easier. The requested change will accomplish this. Since this revision will result in a change of less than one-tenth of an acre, we hope you will allow it to be made. If you need more information, please contact us. We are anxious to have this matter settled. Thank you for your consideration. In December of '78, I met with the owners of the property and the renter of the property, who also farms the land. We attempted to determine a division line for the two lots by determining a line which was compatible with the flow of irrigation water during farming of the land. At that time there was approximately four inches of snow on the ground, and what looked like a good line was not suitable to the owners or renter when they witnessed the location with the snow gone. We are requesting a change of approximately twelve feet on each end of the division line. It is certainly obvious that this change would be instrumental in the farming operation of the land when one witnesses it without the snow on the ground.
