The purpose of the proposed use of the property is to store and stage excess oil field equipment such as tanks, separators, flares, pipe and miscellaneous parts. 2 . The Bonanza Creek Lay Down Yard proposal is consistent with the Weld County Code, Chapter 22 of the Comprehensive Plan because we have worked diligently not only with the property owner but surrounding land owner to locate the yard in a mutually agreeable area, central to many of Bonanza Creeks operations and out of the site of all existing and proposed development. 3. Oil and gas wells and facilities are a Use by Right with in an Agricultural Zone. Although the Lay-down Yard is not directly related to a specific oil and gas well or facility it is an integral part of the oil and gas operations. Bonanza Creek worked closely with the surface owner of the property as well as the surrounding surface owner to choose the most central, least impactful area for the Lay-down Yard . In addition, by creating a Subdivision Exemption that runs with the term of the lease the property will be restored to Agricultural Zoning one the lease is terminated . 4. The properties surrounding the site are Agriculturally Zoned and used mostly for farming, grazing and oil and gas activities. 5 . The Lay-down Yard will contain oil field equipment including but not limited to tanks, separators, valves, and various pipe . The yard will be manned by 1-2 personnel and will be open daily Monday through Saturday from dawn until dusk. There will be a prefabricated storage shed that will contain a desk and chairs for the yard personnel . In addition there will be approximately 4-6 metal conexes that are each 8' x 40' and will house the smaller pieces and parts. No new construction on site is planned at this time. Estimates for new equipment deliveries from manufacturers will vary from 1- 5 flatbed truck deliveries per week. Pickup trucks with gooseneck trailers will access the site up to 10 times per day to pick-up/drop-off material . There will be a forklift on site to load/unload the equipment. FedEx/UPS will deliver once or twice per week. We expect no more than 15 people per day at the yard and that includes both the yard personnel plus people driving the delivery/pickup trucks. There won't be any animals onsite. Fire protection will be provided by Platte Valley Fire Protection District. We are expecting to use a port-o-potty and bottled water out at this location . 6. Not Applicable 7. At the time of reclamation any gravel that has been brought onto the site will be removed and the site will be restored and reclaimed per the State Lease as well as Colorado Oil and Gas Conservation Commission rules and regulations. 8 . Please see the letter provided by Jeff Buston from Tetra Tech . 9. Site construction should take approximately two weeks. Most of the work will be done prior to the actual construction of the site with the removal of the existing hog pens on the property. Construction will begin as soon as possible after approval of the USR. 10. The Site will have a dumpster and scrap bin for the storage of waste before removal . No other waste will be stored on-site. 11 . Six foot, chain link fence will be placed around the entire site for security purposes. The fence will be erected soon after the site is constructed . At the time of construction the site will be graded toward the SW and a water quality feature will be located near that corner of the site. WATER SUPPLY AND SEWAGE DISPOSAL Bonanza Creek proposed to use bottled water and a Port-o-Potty on the Lay-down yard site. Bottled water will be restocked weekly, or as requested by personnel manning the site. Waste Logistics LLC will be providing sewage disposal for the site by way of a Port-o- Potty. The facility will be cleaned once a week or as requested by personnel manning the site. WASTE HANDLING PLAN Northern Colorado Disposal will be providing waste handling for the site. Trash will be picked up once a week or as requested by personnel manning the site. There will be no hazardous, chemical or NORM material stored on-site. DUST ABATEMENT PLAN Bonanza Creek owns and operates the fresh water storage pond located in Section 26, 5N-63W. 1f/when dust abatement is needed Bonanza Creek can use a bobtail water truck to reduce dust impact. ACCESS CORRIDORS AND EASEMENTS. 3 . 1 Access Corridors. 70 Ranch hereby grants to Bonanza an easement for road, water and gas pipeline and utility access to all Lands and Leases, using the access routes depicted on the annexed Exhibit C, and as otherwise provided in this Agreement. 3.2 Access to Additional Wellsites. Roads, pipelines and utilities on 70 Ranch Lands associated with future Wellsites and production facilities on 70 Ranch Lands, other than those shown on Exhibit C, shall be at reasonably direct locations which do not materially interfere with the intended surface uses of 70 Ranch, consent to which locations shall not be unreasonably withheld by 70 Ranch. With respect to any such additional access corridors, existing ranch roads on 70 Ranch Lands will be used to the maximum degree practical. 3.3 Limitation on Entrances. Bonanza shall enter 70 Ranch Lands on roads only at the following entry and exit locations which are depicted on Exhibit C or C-1 : (a) the Main Road entering 70 Ranch Lands in the west half of Section 20, Township 5 North, 63 West, (b) via County Road 69 through the southwest corner of Section 26, Township 5 North, Range 63 West (and thereby accessing the Main Road, (c) from the Antelope P- 15 well site in the northeast quarter of Section 15, Township 5 North, Range 62 West, (d) from State Section 28, Township 5 North, Range 62 West, (e) from State lands in the NE/4 of Section 3, Township 4 North, Range 62 West, (f) at the Location depicted on Exhibit C-1 for access to Section 3, Township 5 North, Range 62 West, and (g) from State lands in Section 6, Township 4 North, Range 62 West. Having once entered 70 Ranch Lands or State Lands via any of the above entrances, Bonanza shall be entitled to use the roads shown on Exhibit C between and among the 70 Ranch Lands, State Lands and TH Ranch lands. Nothing in this Agreement prohibits Bonanza from accessing, departing or transiting State Lands and/or TT-I Ranch Lands directly from lands other than 70 Ranch Lands. 6 (1/' 3 .4 Recorded Access Easement, Upon request of either party, 70 Ranch and 'Bonanza shall execute a Mutual Reciprocal Access Easement in a mutually agreeable form, which Bonanza shall record in the real property records of Weld County, Colorado. Such Easement shall be an easement appurtenant to Bonanza's leasehold interest in the State Leases and the TH Ranch Leases. By such Easement, 70 Ranch shall grant Bonanza, and their respective successors, assigns and contractors, road, water and gas pipeline and utility access across 70 Ranch Lands along the Primary Access Corridors shown on Exhibit C and described on Attachment 1 to such Easement (the "Primary Roads" and/or "Primary Access Corridors" herein) for the purpose of exploring for, developing and producing oil and gas from the State Leases. By such Easement, Bonanza shall also quitclaim to 70 Ranch, its successors, assigns and contractors, such rights of access across the State Lands along the Primary Access Corridors shown on Exhibit C, as Bonanza may be legally permitted to grant, to allow 70 Ranch to survey, inspect, test, and repair water facilities in anticipation of negotiating a water supply contract between 70 Ranch and Bonanza. 3.5 State Reciprocal Easement. In addition, Bonanza agrees to use all commercially reasonable efforts to assist 70 Ranch in its efforts to obtain from the State of Colorado, by its State Land Board, a reciprocal access easement between the State and 70 Ranch, their successors, assigns and contractors, for road, water facility and utility access to their respective landlocked parcels located within the Lands, over the "trunk roads" shown on Exhibit C and at such other locations as may be agreed upon by 70 Ranch and the State of Colorado. 3 .6 Contingent Alternative Road Access. 3.6. 1 The parties acknowledge that the Main Road Access Corridor as it passes through the NE/4NE/4 of Section 28, and the W/2 of Section 27, Township 5 North, Range 63 West passes through lands which are not currently owned or controlled by 70 Ranch. If at any time 70 Ranch is not able to deliver to Bonanza the road, pipeline and/or utility access rights across such lands which are provided for in this Agreement, or if Bonanza is denied access across such lands, Bonanza shall be permitted to construct roads, pipelines and utilities at an adjacent and reasonably convenient alternative access corridor on 70 Ranch Lands, so the access to the Lands and Leases intended by this Agreement can be continuously provided. 3 .6.2 If 70 Ranch does not own any of the 70 Ranch Lands described in Exhibit A to this Agreement, other than those described in section 3 .6. 1 above, across which runs an road, pipeline or utility access route shown on Exhibit C, Bonanza shall be permitted to construct roads, pipelines and utilities at an adjacent and reasonably convenient alternative access corridor on 70 Ranch Lands, so that access to the Lands and Leases intended by this Agreement can be continuously provided. If it is discovered that 70 Ranch does not own any such lands after Bonanza has constructed roads, pipelines and/or utilities across such other non- owned lands at a location shown on Exhibit C, and such other owner took title to such lands by, through or from 70 Ranch, then 70 Ranch shall work with Bonanza in good faith to obtain necessary easements, or provide easements to Bonanza on 70 Ranch Lands, as necessary, and if Bonanza is required to relocate such roads, pipelines and/or utilities as a result, 70 Ranch will reimburse the reasonable costs of such relocation. 7 1 TRAFFIC NARRATIVE Type of Vehicle Number of Round Trips/Day a . Describe the trip distribution along the routes ( i . e. 50.E of traffic will come from the north, 20.E from the south, 30,E from the east, etc. ) 75,E of the traffic will come from the west and the remaining 251 will come from the east. f. Describe the time of day that you expect the highest traffic volumes from the table above. 6 :00 AM through 10 :00 AM is when the majority of traffic is expected . The subject property is being leased from the State of Colorado for the purpose of storing equipment, tanks, separators, pipe, etc. in support of oil and gas development in the vicinity. The subject property is located in the southeast '/ of Section 26, Township 5 North , Range 63 West of the 6th P. M . The site is located in the vegetated dunes area east of the town of Kersey. The topography is characterized by significant hills and bowls which capture drainage. The bowls, if of sufficient size, do not allow drainage to leave . The runoff is expected to infiltrate into the subsurface rapidly since the soils are hydrologic soil group A. Offsite flows enter the site from the northern and eastern property boundaries. Flows will leave the site near the southwest corner. Runoff will flow from northeast to southwest across the property. There are no known drainage problems with the property. The property is located in a remote and unpopulated area. Surrounding land uses are agricultural (ranching) and oil/gas development. The site is not located in a mapped FEMA floodplain. Based on the criteria set forth in Section 23-12-30. F. 1 . h of the Weld County Code, this project does not require a detention pond. The site was formerly a hog farm that has since been abandoned . The structures for the hog farm are in the process of being removed . They occupied approximately 180,000 square feet of space, all of which is impervious. After the hog farm buildings are all torn down , they will be replaced with the laydown yard . The total impervious area within the boundary is proposed to be approximately 2,065 square feet, in addition to other transient items consistent with a laydown yard (tanks, for example). The surface of the site will be uncompacted pea gravel, which is not expected to generate any additional runoff as water will percolate through this layer to the subsurface. Tetra Tech 1900 S. Total site imperviousness is approximately 5%. The water quality feature would be located in near the southwest corner of the property, as determined by the grading plan (by others). The calculations for the water quality pond and outlet are attached. A total water quality volume of approximately 0.076 acre-feet ( 122 cubic yards) shall be provided . The pond will be approximately two (2) feet in depth . Due to location of the site and the nature of the activities planned , we do not expect to increase impacts on adjacent landowners.
