APPLICATION FOR A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL
REVIEW PERMIT, USR16-0008, FOR ANY USE PERMITTED AS A USE BY RIGHT,
ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR
INDUSTRIAL ZONE DISTRICTS ( OFFICE, MANUFACTURING AND WAREHOUSE
FACILITY FOR AIRFIELD DE-ICING PRODUCTION COMPANY) PROVIDED THAT
THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION
PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY
REGULATIONS CONTROLLING SUBDIVISIONS
WHEREAS, the Board of County Commissioners of Weld County , Colorado . pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County . Colorado . and
WHEREAS , , the Board of County Commissioners held a public hearing on the 18th day
of May . 2016 . at the hour of 10: 00 a . m . , in the Chambers of the Board . for the purpose of hearing
the application of Ivar and Evelyn Jordan Children 's Trust , 20154 E . Grand Lane . Aurora , CO
80015, c/o Berven Industries . LLC , dba New Deal Deicing , LLC , 12015 E . 46th Avenue , Suite 410,
Denver. CO 80239 , for a Site Specific Development Plan and Use by Special Review Permit,
USR16-0008 . for any Use permitted as a Use by Right, Accessory Use . or Use by Special Review
in the Commercial or Industrial Zone Districts (office , manufacturing and warehouse facility for
airfield de-icing production company) provided that the property is not a lot in an approved or
recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations
controlling subdivisions in the A (Agricultural) Zone District, on the following described real estate.
to-wit, and :
SE1 /4 SE1 /4 of Section 27 . Township 1 North ,
Range 65 West of the 6th P. M . , Weld County,
Colorado
WHEREAS , on May 18 . 2016 . the Board was presented with a letter, dated May 16, 2016.
from the applicant requesting the withdrawal of the application , stating the vast opposition of the
surrounding properties makes it impossible to move forward , and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present. studied the request of the applicant and all of the exhibits and
evidence presented in this matter and , having been fully informed , deems it advisable to grant the
applicant's request and thereby accept the withdrawal of the application .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado , that the request of Ivar and Evelyn Jordan Children's Trust. c/o Berven
Industries . LLC , dba New Deal Deicing , LLC , to withdraw the application for a Site Specific
Development Plan and Use by Special Review Permit, USR16-0008. for any Use permitted as a
Use by Right. Accessory Use . or Use by Special Review in the Commercial or Industrial Zone
Districts (office , manufacturing and warehouse facility for airfield de-icing production company)
provided that the property is not a lot in an approved or recorded subdivision plat or part of a map

Subject: USR - Berven Industries
Good Morning Chris,
We would like to withdraw our USR application from Weld County for the CR 4 & 45 location as well as cancel the
County Commission Hearing scheduled for Wednesday, May 18th. Despite what the County Commission may decide,
we've decided that it is not in the best interest of the local community or of our company to locate the project in an area
with such significant opposition . We have substantial ongoing concerns that the local residents will continue to oppose
the project well after approval. As a small business with limited resources we don't possess the ability to continue to
mitigate such opposition for extended periods of time.
Seeing that we have already completed the required application, survey, and payment for the RE, can we finalize the RE
for the benefit of the existing land owners?
