RESOLUTION RE: LOT SIZE VARIANCE # 46 - DAVIS FARMS, INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 19th day of September, 1977 , in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land is owned by Davis Farms , Inc. , Frank S . Davis, President and Don R. Vornholt, Secretary of Davis Farms, Inc. , Greeley, Colorado, which land is more particularly described as follows , to-wit: The East Half (E1/2) of the Southeast Quarter (SFM) of Section 20, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado and a tract of land located in the West Half (Wz) of the Southeast Quarter (SE3) of Section 20, Township 6 North, Range 65 West of the 6th P.M. , particularly described as follows: to-wit: Beginning at the Northeast Corner of the West Half (W#) of the Southeast Quarter (SEa) of said Section 20, Thence South 278 feet along the East line of the W1 of the SEQ of said Section 20; Thence North 39°31' West, 432.5 feet to a point on the north line of the W1/2 of the SE4 of said Section 20; Thence South 78°36' East, 281 feet, more or less, along said north line to the place of the beginning. Said described parcel of land contains 63.197 acres, more or less, including a strip of ground 30 feet in width along the South line of said described parcel of land reserved for County Road ROW purposes and is subject to any rights-of-way or other easements as recorded by instruments of record or as now existing on said described parcel of land. WHEREAS, the owners of Davis Farms , Inc. desire to split the property into parcels of 1. 768 acres and 60 . 550 acres to sever the 1. 768 acre parcel from the remainder of the unimproved agricultural land for the purpose of conveying the 1. 768 acre parcel with the existing residence to one of the shareholders in the Davis Farms , Inc . , and WHEREAS, Section 9-4A (6) of the Weld County Subdivision Regulations requires that a Lot Size Variance be obtained before a Recorded Exemption is granted to the applicant, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, based upon the recommendations of the Department of Planning Services, feels that the applicant has shown good cause 770158 eLi for granting a Lot Size Variance under Section 9-4A (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that a variance from lot size requirements be, and hereby is, granted to Davis Farms , Inc. for the above-described parcel of land. August 11 , 1977 Gentlemen: The explanation for the purchase of the said property, Lot B, is stated within the following letter. Frank Stanley Davis, owner of the Davis Agency and President of Davis Farms, Inc. , wishes to sell Lot B for the convience of a residential dwelling to his cousin, Mark Davis Vornholt and who is also a share holder in Davis Farms, Inc. Mr. Vornholt is also employed at the Davis Agency under the title of Farm and Property Manager and would find it more convienient to be located nearer to farming operations of the Agency. The dwelling that is currently located on Lot B has been in existance for several years and maintains a sufficient water and sewer system and has remained structually sound. We feel that it would make a comfortable dwelling for several years and that there would be no need for any other major structural changes to occur other than clean up and restoration of the existing improvements. This is an .area covered by the Greeley Comprehensive Plan which designates an agricultural use.
