A public hearing was conducted on April 13, 2016 . at 10: 00 a . m . . with the following present:

The following business was transacted :
Le-:-41 I hereby certify that pursuant to a notice dated March 23 , 2016, and duly published
March 30, 2016, in the Greeley Tribune, a public hearing was conducted to consider the request
of Clyde and Janice Hemberger. c/o Sterling Energy Investments, LLC , for a Site Specific
Development Plan and Use by Special Review Permit, USR15-0070 , for Mineral Resource
Development Facilities , including Oil and Gas Support and Service (six (6) compressors) in the
A (Agricultural) Zone District. Bob Choate , Assistant County Attorney, made this a matter of
record .
Chair Freeman reviewed , for the applicant and the public, the procedures to follow should
either case result in a tie vote due to four Commissioners being present and one Commissioner
excused .
P Kim Ogle , Department of Planning Services , presented a brief summary of the proposal and
reported this case was continued on February 10 , 2016, to allow for state mandated mineral
notification : and , continued again on March 23, 2016 , due to a County closure related to inclement
weather. He presented a brief summary of the proposal and reviewed the location stating the site
is not within the three (3) mile referral area of any municipality. Mr. Ogle described the surrounding
property uses . nearest residence , and reported receiving no correspondence related to this
application . He explained the applicant's intent to expand their operations in Weld County and he
stated at this location there will be six (6) compressors at full buildout operating 24 hours a day
and seven (7) days a week. Mr. Ogle stated nine (9) referrals were sent out and staff received

three (3) responses with comments taken into consideration . He displayed images of the site and
surrounding properties and entered the favorable recommendation of the Planning Commission
into the record as written .
Janet Lundquist, Department of Public Works . provided a brief overview of the transportation
plans and requirements stating the access from County Road (CR) 105 has been approved under
Access Permit Number, AP14-00107 . She reviewed the traffic counts and stated based on low
traffic volume there is no requirement for tracking control or an Improvements Agreement.
PI Wayne Howard , Planning Services Engineer representative , reviewed the drainage and
grading requirements and explained this project is accountable to the old drainage code based
on the date of inception ; furthermore, the only requirement is a water quality feature and Grading
Permit if disturbing more than one ( 1 ) acre .
Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions stating portable toilets are allowed . She explained the relevant Conditions and
Development Standards and clarified that Development Standards (DS) #5- 13 address typical
Environmental Health items.
Abby Rimel represented the applicant and presented a PowerPoint Presentation reviewing
the basic plan for operations , site location , existing compressors combined with additional
compressors at full buildout for this location , equipment, and storage.
Lc Dena Lund represented the applicant and further explained the approximate truck trips, Air
Pollution Control Division Permit, employees requirement to be OSHA trained . and that the
equipment is on a Skata System to be monitored 24 hours a day and seven (7) days a week with
personnel assigned to visit the site every day.
No public testimony was offered concerning this matter.
Commissioner Cozad suggested a minor correction to Development Standard ( DS) #3. She
further suggested deleting DS #22 . The Board agreed .
In response to Chair Freeman , Ms. Lund . on behalf of Clyde and Janice Hemberger, c/o
Sterling Energy Investments , LLC indicated she has reviewed , and agrees to abide by, the
Conditions of Approval and Development Standards . as amended .
= Commissioner Conway moved to approve the request of Clyde and Janice Hemberger, c/o
Sterling Energy Investments . LLC for a Site Specific Development Plan and Use by Special
Review Permit, USR15-0070 , for Mineral Resource Development Facilities, including Oil and Gas
Support and Service (six (6) compressors) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission , with the Conditions of Approval
and Development Standards as entered into the record. The motion was seconded by
Commissioner Moreno, and it carried unanimously. There being no further discussion , the
hearing was completed at 10: 50 a . m .
