A public hearing was conducted on April 20. 2016, at 10: 00 a . m . . with the following present:

The following business was transacted :
I hereby certify that pursuant to a notice dated February 5 . 2016, and duly published
February 10, 2016, in the Greeley Tribune , a public hearing was conducted February 24 . 2016,
to continue the matter to March 16 , 2016, due to circumstances related to inclement weather. On
March 16 . 2016, a public hearing was conducted to consider the request of Miller HFI . LLC . for a
Site Specific Development Plan and Use by Special Review Permit. USR15-0073 . for Mineral
Resource Development Facilities , including an Oil and Gas Support and Service Facility (storage
of a maximum of 85 empty frac tanks) in the A (Agricultural) Zone District. at which time the Board
deemed it necessary to continue the matter to April 6 . 2016 , to allow the applicant to be present
per the Board 's request. On April 6, 2016, the applicant could not be present , as planned , and
requested a continuance to April 20th , 2016. which the Board granted . On April 20 . 2016, Bob
Choate . Assistant County Attorney, made this a matter of record .
21 Chair Freeman informed the public that only new information will be allowed to be presented
today , as certain phases of the hearing process were completed in the prior hearing that took
place on March 16 , 2016.
Chris Gathman , Department of Planning Services , presented a brief summary of the meeting
that took place between the applicant and the neighbor, and stated that both the applicant and
the neighbor are present.
Ryan Harding , applicant. stated he met with the neighbors and addressed all the issues.

P In response to Commissioner Cozad , Mr. Harding stated he is the landowner.
In response to Commissioner Conway. Mr. Harding clarified his efforts to mitigate by
repairing the road , planting trees , and moving some of the tanks further from Mr. Olson 's property.
2 Chair Freeman opened public input to allow for any new testimony.
P Brad Olson , neighbor, confirmed the meeting that took place and stated that Mr. Harding
did a fantastic job of repairing the road and that he was pleased with the agreement that took
place between them to mitigate his concerns .
In response to Chair Freeman . Mr. Naylor indicated they have reviewed . and agree to abide
by. the Conditions of Approval and Development Standards . as amended .
a. Commissioner Kirkmeyer moved to approve the request of Miller HFI , LLC , for a Site Specific
Development Plan and Use by Special Review Permit, USR15-0073 , for Mineral Resource
Development Facilities , including an Oil and Gas Support and Service Facility (storage of a
maximum of 85 empty frac tanks) in the A (Agricultural ) Zone District, based on the
recommendations of Planning staff and the Planning Commission . with the Conditions of Approval
and Development Standards as amended and entered into the record . The motion was seconded
by Commissioner Conway. Commissioner Kirkmeyer thanked the applicant for coming today and
for working with the neighbors . She also thanked the Olson's for being present. The Board
concurred with Commissioner Kirkmeyer and the motion carried unanimously . There being no
further discussion , the hearing was completed at 10 : 11 a. m .
This Certification was approved on the 25th day of April , 2016.
