RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-1045 - BRUCE
SANDAU
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 14, 1994, the Board approved Use by Special
Review Permit, USR-1045, for an Agricultural Service Establishment for Griffin -Holder Company
on the following described real estate, to -wit:
Lot A of Recorded Exemption, RE -1325, being part
of the W1/2 SE1/4 of Section 36, Township 6 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from the current property owner, Bruce
Sandau, dba Green Earth Environmental, Inc., 32660 Vista Lake Road, Greeley, CO 80631, to
vacate said Use by Special Review Permit, USR-1045, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit, USR-1045, be, and hereby is, vacated.

Request:
Weld County Department of Planning Services is requesting that USR-1045 (storage and
processing of onions) be vacated.
The owner, Mr. Bruce Sandau, is requesting a new USR for this site (USR15-0057). This new
USR is on the Board of County Commissioner's agenda for August 24, 2016. The vacation of
this existing USR is a condition of approval on the new USR.
The Department of Planning Services is in support of this request.
Location:

Background on USR-1045:
USR-1045 was approved on June 15, 1994 by the Board of County Commissioners for
Griffin -Holder, Co. for an Agricultural Service Establishment (Onion Storage and Processing).
The USR map was recorded on July 11, 1994. On August 27, 2015 Mr. Bruce Sandau purchased
the property.

future. There is an existing USR on my property (USR-1045) that was in place for the previous
owners use. (Onion storage facility) I wish to have that previous USR vacated. Please let me

RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1045 FOR
AN AGRICULTURAL SERVICE ESTABLISHMENT (ONION STORAGE AND PROCESSING) IN
THE A (AGRICULTURAL) ZONE DISTRICT - GRIFFIN -HOLDER CO.
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested
with the authority of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 8th
day of June, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the
purpose of hearing the application of Griffin -Holder Co., P.O. Box 511, Rocky
Ford, Colorado 81067, for a Site Specific Development Plan and Special Review
Permit #1045 for an agricultural service establishment (onion storage and
processing) in the A (Agricultural) Zone District on the following described real
estate, to -wit:
Lot A of RE #1325, WI SEe Section 36,
Township 6 North, Range 65 West of the 6th
P.M., Weld County, Colorado
WHEREAS, Hal Holder, President of Griffin -Holder Co., was present, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides
standards for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the
recommendations of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter and, having been fully informed, finds that
this request shall be approved for the following reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the
applicant has shown compliance with Section 24.4.2 of the Weld
County Zoning Ordinance as follows:
a. The proposal is consistent with the intent of the Weld County
Comprehensive Plan. The Comprehensive Plan Agricultural Goals
and Policies are intended to support and preserve agricultural
industries and farming.
b. This use is consistent with the intent of the A (Agricultural)
Zone District and is provided for as a Use by Special Review.

c. The uses permitted will be compatible with the existing
surrounding land use and with future development of the
surrounding area as permitted by the Agricultural Zone
District. The surrounding land uses include agricultural
production and rural residences.
d. The Special Review Permit site is located in the Airport
Overlay district. Special Review Permit Development. Standards
address the overlay district regulations. No other overlay
districts affect the site.
e. Special Review Permit Development Standards will provide
adequate protection for the health, safety, and welfare of the
neighborhood and County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Griffin -Holder Co. for a Site Specific
Development Plan and Special Review Permit #1045 for an agricultural service
establishment (onion storage and processing) in the A (Agricultural) Zone
District on the hereinabove described parcel of land be, and hereby is, granted
subject to the following conditions:
1. The attached Development Standards for the Special Review Permit
shall be adopted and placed on the Special Review plat prior to
recording the plat. The plat shall be delivered to the Department
of Planning Services and be ready for recording in the Weld County
Clerk and Recorder's Office within 15 days of approval by the Board
of County Commissioners.
2. The Special Review activity shall not occur nor shall any building
or electrical permits be issued on the property until the Special
Review plat is ready to be recorded in the office of the Weld County
Clerk and Recorder.
3. Prior to recording the Use by Special Review plat:
a. Written evidence shall be submitted to the Department of
Planning Services that all septic systems on site are in
compliance with the Weld County Health Department I.S.D.S.
Regulations.
b. The applicant shall submit evidence to the Department of
Planning Services that the Colorado Department of Health has
determined that all existing emission permits have been
modified for the increased operation if such a modification
represents a significant change in emissions or production.

SITE SPECIFIC DEVELOPMENT PLAN
SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS
GRIFFIN -HOLDER, CO.
USR 111045
1. The Site Specific Development Plan and Special Review Permit is for an
agricultural service establishment (the storage and processing of onions)
in the A (Agricultural) Zone District as submitted in the application
materials on file and subject to the Development Standards stated herein.
2. Approval of this plan may create a vested property right pursuant. to
Section 90 of the Weld County Zoning Ordinance.
3. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
4. No permanent disposal of wastes shall be permitted at this site.
5. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
6. Fugitive dust shall be controlled on this site.
7. The maximum permissible noise level shall not exceed the commercial limit
of 60 db(A), as measured according to 25-12-102, Colorado Revised
Statutes.
8. No on -site disposal of produce of any type shall be permitted at anytime.
Produce shall be handled and stored at the facility in such a manner so
that no nuisance is created by odor, blowing debris, fugitive dust, or
spoiled produce on or around the facility.
9. All pesticides, fertilizers, and other potentially hazardous chemicals
shall be stored and handled in a safe manner in accordance with Section
25-8-205.5, Colorado Water Quality Control Act and Rules and Regulations.
10. The property shall be maintained in compliance at all times with the
Airport Overlay District.
11. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
12. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.

13. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
14. Personnel from the Weld County Health Department, Western Hills Fire
Protection District, and Weld County Department of Planning Services shall
be granted access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with the
Development Standards stated herein and all applicable Weld County
Regulations.
15. The Special Review area shall be limited to the plans shown herein and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
16. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.
