CONDITIONS OF APPROVAL:
K. The applicant shall pay any additional costs associated with the installation of their facilities along the Weld County
Road (WCR) 49 Corridor Project between US 34 and 1-76, due to the WCR 49 Corridor Project relocation of existing
utilities along the corridor. ( Department of Public Works)
L. The applicant shall not interfere with or cause construction delays during the construction of the WCR 49 Corridor
Project, December 2015 through December 31 , 2017. If the WCR 49 Corridor contractor, Interstate Highway Construction
(INC) , cannot make reasonable accommodations to work with the applicant's contractor anywhere along the WCR 49
Corridor, the applicant's contractor shall postpone their work until the applicant's work can be done with no conflict or
delays during construction of the WCR 49 Corridor Project. The decision to postpone construction by the applicant in
certain areas along the WCR 49 Corridor shall be at the sole discretion of Weld County. (Department of Public Works)
M. The applicant shall provide the updated maps that show the different alignment of the Tri State facilities. It was
discovered that in more than one place the pedestal of the towers will be as close as 8' to 10' outside the proposed right
of way. Should a tower failure occur during or after construction . the tower could fall across some of the new WCR 49
Corridor travel lanes. In some cases part of the applicant's easement will have to include part of the new WCR 49
Corridor right of way. In other cases the transmission towers will not be in the middle of the applicant's proposed
easement. (Department of Public Works)
N . The applicant shall provide details of how they will cross the side roads along WCR 49 Corridor Project. ( Department of
Public Works)
O. The applicant shall coordinate the access into their facilities during and after their construction . The applicant shall not
delay or disrupt the construction of WCR 49 Corridor Project. ( Department of Public Works)
Currently the WCR 49 Design Build team has not completed the final alignment for the horizontal and vertical alignments
of the Corridor. This final alignment will not be known until approximately February 29, 2016. At this time IHC may need
to acquire additional right of way along the WCR 49 Corridor. This could affect the applicant's easement locations.

CONDITIONS OF APPROVAL:
1 . The applicant shall not interfere with or cause construction delays during the construction of the WCR 49 Corridor Project,
February 2016 through the end of the project. If the WCR 49 Corridor contractor, Interstate Highway Construction (IHC),
cannot make reasonable accommodations to work with the applicant's contractor anywhere along the WCR 49 Corridor, the
applicant's contractor shall postpone their work until the applicant's work can be done with no conflict or delays during
construction of the WCR 49 Corridor Project. The decision to postpone construction by the applicant in certain areas along
the WCR 49 Corridor shall be at the sole discretion of Weld County. (Department of Public Works)
2. In some cases part of the applicant's easement may inadvertently overlap part of the new WCR 49 Corridor right of way,
applicant agrees to obtain additional easement to account for the overlap. Tri-State's easement acquisition shall not impede
Weld County's right-of-way and/or easement acquisition for the WCR 49 project, especially at intersections. The applicant
shall not place any structures in areas where the applicant's easement is coincidental with county road right way.of

3. The applicant shall pay any additional costs associated with the installation of their facilities along the Weld County Road
(WCR) 49 Corridor Project between US 34 and 1-76, due to the WCR 49 Corridor Project relocation of existing utilities

4. The applicant shall provide their design to Public Works for review and approval to ensure there minimum structures offset
from public right-of-way and no conflicts with other utilities and their tower height. Applicant shall ensure a fall zone equal
to the height of the tower; should a tower failure occur during or after construction, the tower shall not fall on WCR 49.

5. All easements acquired by Tri-State shall be non-exclusive. In areas where Tri-State co-locates in easements with other
utilities, Tri-State will accommodate those utilities by locating structures to the outside of the shared easement not adjacent to

6. The applicant shall provide details of how they will cross the side roads along WCR 49 Corridor Project. (Department of

7. Prior to landowner offers, Tri-State shall provide Public Works all right-of-way acquisition documents within 1000 feet of
WCR 49 for review and approval. (Department of Public Works)
8. The applicant shall utilize access as approved by permit number AP- 15-00502. (Department of Public Works)
9. Applicant shall obtain a right-of-way permit for project construction. (Department of Public Works)
10. Any temporary or construction accesses shall be permitted and approved by Public Works. The applicant shall coordinate
with IHC to ensure the use of any access points do not delay or disrupt the construction of WCR 49 Corridor Project.

DEVELOPMENT STANDARDS:
1 . The applicant shall not interfere with or cause construction delays during the construction of the WCR 49 Corridor Project,
February 2016 through the end of the project. If the WCR 49 Corridor contractor cannot make reasonable
accommodations to work with the applicant's contractor anywhere along the WCR 49 Corridor, the applicant's contractor
shall postpone their work until the applicant's work can be done with no conflict or delays during construction of the
WCR 49 Corridor Project. The decision to postpone construction by the applicant in certain areas along the WCR 49
Corridor shall be at the sole discretion of Weld County. (Department of Public Works)
2. The applicant shall not place any structures in county road right of way, whether or not applicant has an easement in that
location. (Department of Public Works)
3. The applicant shall pay any additional costs associated with the installation of their facilities along the Weld County
Road (WCR) 49 Corridor Project between US 34 and 1-76, due to the WCR 49 Corridor Project relocation of existing
utilities along the corridor. (Department of Public Works)
4. The applicant shall provide their design (structure locations, line clearances, etc.) to Public Works for review and approval
to ensure their minimum structures offset from public right-of-way and have no conflicts with other utilities, current, or
future traffic signals, or other future traffic control devices such as an overpass. (Department of Public Works)
5. All easements acquired by Tri-State shall be non-exclusive. In areas where Tri-State co-locates in easements with other
utilities, Tri-State will accommodate those utilities by locating structures to the outside of the area where the easements
overlap except as otherwise approved by Public Works and such other utility. (Department of Public Works)
6. Prior to landowner offers, Tri-State shall provide Public Works all right-of-way acquisition documents within 150 feet of
WCR 49 ROW, or within 150 feet of any intersecting side roads for 1 ,000 feet. These right-of-way acquisition
documents will be reviewed and approved by Public Works to ensure there are no project conflicts. (Department of

7. The applicant shall utilize access as approved by permit number AP- 15-00502. (Department of Public Works)
8. Applicant shall obtain a right-of-way permit for project construction. (Department of Public Works)
9. Any temporary or construction accesses shall be permitted and approved by Public Works. The applicant shall
coordinate with the County's contractor to ensure the use of any access points do not delay or disrupt the construction
of WCR 49 Corridor Project. (Department of Public Works)
10. The owner of the facilities shall be responsible for all costs associated with relocating or elevating their tines if the line
conflicts with future roadway infrastructure along WCR 49 or 1 ,000 feet along the intersecting side roads.(Department of

Tri- State Generation and Transmission Association, Inc. (Tri-State) is a wholesale electric power
supplier owned by the 44 electric cooperatives that it serves. Tri-State generates and transmits electricity to
these member systems United Power, is your local electric utility, and is one of our members.
Tri- State is in the process of preliminary route selection for the above listed transmission line project. This
project is necessary to support increased loads in the immediate area and to bolster system reliability. One of
the possible routes may be located on your property in Weld County, Colorado. As part of the decision making
process, Tri-State needs to investigate certain field conditions in the project area. Tri-State' s procedure may
include right-of-way inspections, land surveying, engineering inspections, as well as environmental and
geotechnical work. Access to your property will not be continuous throughout the inspection process.
I have included an access form for your review and signature that will allow Tri-State and/or their field
contractors to enter your property for the listed purposes. If you have no immediate questions at this time,
please sign and return to me in the enclosed postage paid envelope.

Greenhouse to Davis 115kV Transmission Line Project

Tri-State Generation and Transmission Association , Inc . (Tri-State) needs to construct a new
transmission line in Weld County , Colorado . The new transmission line project will connect
the Greenhouse Substation to the Davis Substation with approximately 5 . 0 miles of new
transmission line .
In order to construct and maintain the transmission line , Tri-State needs to acquire an interest
in property in which you have a record interest which is located in a portion of Section .1
Township 2 North , Range 66 West, 6th P . M . , Weld County, Colorado . The interest
property
that Tri-State intends to acquire is a perpetual easement for electric lines and related facilities
along with access (collectively, the " Easement" ) . A copy of the proposed Easement, legal
descriptions and sketches , and an Agreement for Easement are enclosed for your review.
With this letter, Tri-State is offering you as compensation for the Easement and
the access area . In addition to execution of the documents referenced above , Tri-State
needs the following completed and executed documents prior to delivery of payment: IRS
Form W-9 . A copy of each required document is enclosed . In order to ensure the Project' s
schedule , we would appreciate receiving your response to this offer by November 6 , 2015 .
