USR15-0067, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES, OIL AND GAS
SUPPORT AND SERVICE FACILITY (CLASS II OILFIELD WASTE DISPOSAL
FACILITY - SALTWATER INJECTION FACILITY) IN THE A (AGRICULTURAL) ZONE
DISTRICT- D&C FARMS, LLLP, C/O NGL WATER SOLUTIONS DJ, LLC
A public hearing was conducted on January 27, 2016, at 10:00 a.m., with the following present:

The following business was transacted:
El I hereby certify that pursuant to a notice dated December 16, 2015, and duly published
December 22, 2015, in the Greeley Tribune, a public hearing was conducted to consider the
request of D&C Farms, LLLP, do NGL Water Solutions DJ, LLC, for a Site Specific Development
Plan and Use by Special Review Permit, USR15-0067, for Mineral Resource Development
Facilities, Oil and Gas Support and Service Facility (Class II Oilfield Waste Disposal Facility —
saltwater injection facility) in the A (Agricultural) Zone District. Bob Choate, Assistant County
Attorney, made this a matter of record.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
location stating the site is located within the three (3) mile referral area of the Cities of Dacono,
Northglenn, and Adams County, none of which returned a referral response. He explained the
site is not in an overlay district and the 20 acre lease hold parcel of land for this Use was created
by a Subdivision Exemption, SUBX15-0030. He described the surrounding land uses, nearest
residences, and other USRs in the area and stated to date, no correspondence in objection has
been received. He reviewed the operations plan, number of employees, and fencing. Mr. Ogle
stated staff sent out 17 referrals and three (3) returned responses with comments for
consideration. He displayed images of the site and surrounding property and entered the
favorable recommendation of the Planning Commission into the record, as written.
Wayne Howard, Planning Services Engineer representative, provided a brief overview of
the transportation plans and requirements stating the site is accessed from County Road (CR) 19
utilizing the approved Access Permit, AP#15-00481. He reviewed the traffic counts and the traffic

narrative, which indicated 90 daily truck round trips and 10 daily passenger vehicle round trips.
Mr. Howard stated tracking control and an Improvements Agreement are required and he
reviewed the drainage plan, water quality feature and grading stipulation. In response to Chair
Freeman, Mr. Howard clarified the tracking control options.
• Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions and stated water will be provided by a commercial well and the applicant will be
installing a commercial septic system. He reviewed the Development Standards (DS#3-22)which
address typical Environmental Health items.
• Doug White, applicant, stated there is another NGL operational USR south of this site with
one injection well and he explained the intent to expand and build a brand new site and move the
entire operation to the new site. He stated they have an Easement Agreement with Encana to run
a flow line to the injection well at the old site and all business activity will cease at the old site and
be moved to the new site where the plan is to also drill two (2) new injection wells. He reviewed
the geology in the area and provided successful parameters for the proposal.
• No public testimony was offered concerning this matter.
• In response to Chair Freeman, Mr. White had no concerns with the Conditions of Approval
or Development Standards.
• In response to Commissioner Kirkmeyer, Mr. White verified all traffic will be diverted to the
new site. Commissioner Kirkmeyer corrected DS #27 to read, "The access to the site..." The
Board agreed.
• In response to Chair Freeman, Mr. White, on behalf of D&C Farms, LLLP, c/o NGL Water
Solutions DJ, LLC, indicated they have reviewed, and agree to abide by, the Conditions of
Approval and Development Standards, as amended.
• Commissioner Cozad moved to approve the request of D&C Farms, LLLP, c/o NGL Water
Solutions DJ, LLC, for a Site Specific Development Plan and Use by Special Review Permit,
USR15-0067, for Mineral Resource Development Facilities, Oil and Gas Support and Service
Facility (Class II Oilfield Waste Disposal Facility—saltwater injection facility) in the A (Agricultural)
Zone District, based on the recommendations of Planning staff and the Planning Commission,
with the Conditions of Approval and Development Standards as entered into the record. The
motion was seconded by Commissioner Moreno, and it carried unanimously. There being no
further discussion, the hearing was completed at 11:38 a.m.
