Department of Public Health and Environment CASE NO.: PUDZ15-0001 NAME: PKE Investments Limited Partnership Environmental Health Services has reviewed this proposal to rezone a portion of Lot 1 of Althen Boyer Planned Unit Development from the A (Agricultural) Zone District to the Planned Unit Development with C-3 (Business Commercial) Zone District uses. Central Weld County Water District provides water. An on-site wastewater treatment system provides sewage disposal. Septic permit SP-1300036 received final approval 7/25/2013 and is sized for 19 people. The following should appear as notes on the change of zone plat: 1. Water service shall be obtained from Central Weld County Water District. 2. The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Language for the preservation and/or protection of the absorption field shall be placed on the plat. The note shall state; Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. 4. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Change partial zoning of a parcel so entire parcel is zoned the same. This project is east of and adjacent to 1-25 frontage road in the Althen Boyer subdivision. Roads: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163)to verify the access permit or for any additional requirements that may be needed. (1-25 Frontage road.) Access: This project accesses onto CDOT 1-25 frontage road. Please obtain an approved CDOT access permit for this access. Drainage Requirements: This project appears to fall under a detention pond exception for no increase in imperviousness section 23-12-30 F.1.a) 8). The latest drainage code is available on the Department of Planning Services- Engineer website. http://www.co.weld.co.us/Departments/PlanningZoning/Engineering.html . If development is proposed that increases the imperviousness of the site a Detention Pond summarized in a Drainage Report is required. This subdivision has an approved mast drainage plan, however the subdivision detention pond was not constructed, therefore each site is required to provide stormwater detention with an increase in imperviousness. F. Exceptions. 1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property and shall be limited to the following: a. No stormwater detention will be required for sites that meet any of the following conditions. Requirements of the Municipal Separate Storm Sewer System (MS4) areas remain applicable. 1) Use by Right or Accessory Use in the A(Agricultural) Zone District. 2) Zoning Permits in the A (Agricultural)Zone District. 3) A second dwelling permit in the A (Agricultural) Zone District. 4) Towers including, but not limited to, cell,wind, and telecommunication towers. 5) Pipelines or transmission lines. 6) Gravel pits if the stormwater drains into the gravel pit. 7) Residential developments where all the following conditions exist: a) Nine (9) lots or fewer. b) The average lot size is equal to, or greater than, three (3) acres per lot. c) Downstream roadway criteria are not exceeded. d) The total post-development imperviousness for the rural residential development does not exceed ten percent (10%), assuming that all internal roads and driveways are paved, or will eventually be paved. 8) Development of sites where the change of use does not increase the imperviousness of the site. 9) URBANIZING areas where the total project stormwater runoff of less than, or equal to, 5 cubic feet per second (cfs)for the 1-hour, 100-year, storm event. 10) NON-URBANIZING areas where the total project stormwater runoff of less than, or equal to, 10 cfs for the 1-hour, 100-year, storm event. 11) Parcels with total area less than, or equal to, a 1.0 gross acre. 12) Individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency Management Administration (FEMA) regulatory floodplain channel and the project. 13) A parcel greater than 1 gross acre and less than, or equal to, 5 gross acres in size is allowed a onetime exception for a new 1,000 sq ft building or equivalent imperviousness. 14) A parcel greater than 5 gross acres in size is allowed a onetime exception for a new 2,000 sq ft building or equivalent imperviousness. 15) Approved by a variance. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment,Water Quality Control Division, Rik Gay, 303-692- 3575. Geologic Hazard Area: This site IS in a Geologic Hazard Area. The Colorado Geologic Society will be a referral agency. A geologic hazard permit may be required. The Colorado Geologic Survey (CGS) has expertise in geologic hazard areas and is a referral agency for this project. Contact Jill Carlson with the CGS at 303-384-2643 for more detailed information on the geologic hazards in your project area and any additional requirements that may be needed. Depth to mine 350ft-400ft. Floodplain: This area IS NOT in a FEMA regulatory floodplain. CONDITIONS OF APPROVAL: A. All projects occurring in a Geologic Hazard Area as delineated by the Colorado Geological Survey shall comply with Overlay District requirements of Chapter 23, Article V, Division 2 of the Weld County Code. A Geological Hazard Development Permit may be required pending Colorado Geologic Survey referral. (Department of Planning Services-Engineer) B. The plan shall be amended to delineate the following: 1. Show the approved Colorado Department of Transportation (CDOT) access on the site plan and label with the approved access permit number if applicable. (Department of Planning Services- Engineer) 2. Show and label all easements with the recorded document reception number and date on the site plan. (Planning) 3. Show and label the Geologic Hazard Area on the site plan. (Department of Planning Services- Engineer) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Department of Planning Services-Engineer) 2. The site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. (Planning and Engineering) 3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized. (Department of Public Works) 4. The historical flow patterns and runoff amounts will be maintained on the site. (Department of Planning Services-Engineer) 5. Weld County is not responsible for the maintenance of onsite drainage related features. (Department of Planning Services-Engineer) 6. This property lies within a known Geologic Hazard Area as defined by the Colorado Geological Survey. The Lot 1 Althen Boyer PUD site ((PUDZ15-0001) is undermined by the Washington Mine.The depth of mining is quite deep, 350 to greater than 400 feet below the ground surface. Undermining at such depths typically corresponds to a low subsidence hazard. Considering the low hazard and the existing and planned commercial-industrial uses, CGS has no objection to approval of the proposed rezoning. Let me know if you need a formal letter. If you do, I can get that to you on Jan 4. This is an existing developed property in the Althen-Boyer Commercial Unit Development.They do not intend to construct any additional structures or buildings at this time.
