Revised Date 6/29/5.0 Approved by Traffic Control Nan — Access Permit Application Saddle Butte Rockies Storage and Terminals, LLC Lucerne Crude Oil Terminal Section 26, T6N, R65W WCR 45 Saddle Butte is proposing to construct a crude oil storage and polishing terminal (Lucerne Terminal) with an associated pipe laydown yard off Weld County Road 45, between WCR 64 and 64 %2 . The terminal will be built upon an approximate 60 -acre portion of an 80 acre piece of property owned and managed by Saddle Butte. The remaining portion of the parcel will be used for a construction storage and laydown yard. Currently, access to the site is from two points; one located off of WCR 64 and the other off of WCR 64 z. Once approved, access to the site will be from two points located along WCR 45 with the entrance to the site being located approximately 150' south of WCR 64/2 and the exit being located 750' north of WCR 64. In this area, both WCR 64 and 64 dead end approximately 1,600' to the east of WCR 45. The existing access from WCR 6414 will only be used for access the existing natural gas well and will not be used by Saddle Butte. The access point off of WCR 64 will only be used for emergency purposes and will be shut off by a locked gate. During construction of the site, all construction vehicles will be parked off of WCR 45, on the construction site. Warning signs will be placed at least 500 feet either side of the north and south access point to the site along WCR 45. Should dust become an issue with vehicle visibility, water will be applied to control the dust. Once operational, traffic will continue to enter and exit the site off of WCR 45. Site Specific Development Plan and Use By Special Review Weld County, CO Saddle Butte Rockies Storage and Terminals, LLC Lucerne Terminal USR Questionnaire 1. Explain, in detail, the proposed use of the property. Saddle Butte Rockies Storage and Terminals, LLC (Saddle Butte) proposes to construct a crude oil polishing terminal (Lucerne Terminal) located in central Weld County (SW4 Section 26, Township 6 North, Range 65 West) on property owned by the applicant. The Lucerne Terminal will be supplied with crude oil from several 8" in diameter steel pipes connecting to the existing Saddle Butte gathering system. Other sources of oil would come into the facility via truck to 6 loading and offloading ACTS. Only the terminal is being reviewed in this Use By Special Review (USR) process as the proposed pipelines connecting to the terminal are 8" in diameter or less, thus do not require the need for special review. The Lucerne Terminal is currently designed to transport approximately 500,000 barrels of oil per day in and out of the terminal from existing oil development in the immediate area through gathering lines constructed throughout the region. The terminal will occupy approximately 60 acres of an 80 -acre parcel. The remaining 20 acres will initially be utilized as a pipe and equipment laydown yard during construction. Once construction is completed, the remaining portion of the parcel will be held for potential future expansion. While the project site is located immediately adjacent to the Greeley/Weld county Airport, no negative impact to the day to day operation of the airport is expected. Saddle Butte has been in contact with the airport manager and the FAA, both of which have stated that the proposed terminal will not impact the airport. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. The Lucerne Terminal is consistent with Section 22-2-10 (D) which emphasizes the development of natural resources. The land being converted to industrial use is currently irrigated farmland adjacent to an existing regional airport; although the property has been fallow in recent years. Saddle Butte does not anticipate any impact to cultivated lands found nearby. The project is anticipated to have minimal impact to the existing land use of the subject parcel and those surround it. By building the terminal, the project will contribute to the County's industrial economic base by providing additional capacity in the production of crude oil. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. As per Weld County Code, oil and gas support facilitates and services are currently allowed in the Agricultural Zone District upon approval through the USR process. Impacts incurred by the proposed project will be mitigated through reclamation and landscaping and thus, should be minimal and temporary in nature, allowing for existing land uses to continue post construction. 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surround land uses). The proposed Lucerne Terminal is located in an area identified as Agricultural Zoning. Part of this designation includes areas of primary use where oil and gas extraction is located. Since the proposed project is in alignment to other existing and nearby land uses and due to the rural nature of the area, it is anticipated that there will be few impacts to traffic and adjacent residences. 5. Describe, in detail, the following: a. Number of people who will use this site During construction, there will be numerous employees at the terminal location. Once construction is completed, Saddle Butte anticipates that approximately 3-5 employees, plus the individual truck drivers, will have access to the terminal during times of truck loading, maintenance and routine inspections. b. Number of employees proposed to be employed at this site Once completed and operational, the number of Saddle Butte employees people using the entire site will be approximately 3 people per week c. Hours of operation The terminal will operate 24 hours/day, 7 days/week, and 365 days/year. d. Type and number of structures to be erected (built) on this site The following structures are proposed at each site: • 8-30,000 barrel tanks • 2-100,000 barrel tanks • 12-7,500 to 10,000 barrel water tank for fire suppression • Mainline pumps • Booster pumps • Sump pumps • Sump tanks • Outlet metering • Filtration & polishing equipment • Inlet metering • Pig launchers and receivers • 2 Combustors • 6 -ACTS for truck loading and offloading • 16-400 barrel polishing tanks • 8 Breakout tanks • Vapor recovery unit • Office Building/Warehouse (40'x60') • MCC building • Transformers The attached plot plan provides additional detail. e. Type and number of animals, if any, to be on this site No animals will be associated with this project. f. Kind of vehicles (type, size, weight) that will access this site and how often A total of 15 vehicles (light weight trucks) per week will access the site as well as approximately 30 semi -truckloads per day at maximum buildout loading and offloading oil to and from the terminal. During construction, commercial vehicles will be accessing the Milton Terminal parcel and along the pipeline easement. g. Who will provide fire protection to the site The Eaton Fire Protection District will be providing fire support to the terminal. Saddle Butte will contact the District, as well as the adjacent fire protection districts to inform them about the project and coordinate with them on an emergency action plan. An Emergency Information Sheet will be distributed to the District every year with updated information. h. Water source on the property (both domestic and irrigation) Currently, there is no domestic water on site. During construction and initial operation, bottled water will be provided by the construction contractor until a permanent water source can be established. Currently, Saddle Butte is consulting with North Weld County Water District about providing a permanent water supply to the site for both domestic use and fire supression. Water for dust abatement will be trucked to the site by the construction contractor from a municipal site. i. Sewage disposal system on the property (existing and proposed) During the construction phase of the project and during the initial operation of the terminal, portable toilets will be provided until a permanent water source can be established and a septic system constructed. j. If storage or warehousing is proposed, what type of items will be stored No major storage is proposed for the Lucerne Terminal site with the exception of a few small parts that will be kept in the warehouse attached to the office building. On the laydown yard to the south of the terminal site, valves, pipe, pump parts etc. will be stored during construction. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. No landscaping around the Lucerne Terminal is planned. However, a chain link fence around the perimeter of the site will be installed. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. If and when termination occurs, all improvement will be removed and the site will be reclaimed to its original state and seeded with native seed. 8. Explain how the stormwater drainage will be handled. Stormwater drainage and control will be managed as per the guidelines outlined by the Colorado Department of Public Health and Environment (CDPHE). The applicant will obtain a discharge permit from CDHPE that will cover long term operation and maintenance of the terminal. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. Construction of the Lucerne Terminal will take approximately 12-18 months. No landscaping is planned for the site. 10. Explain where storage and/or stockpile of wastes will occur on this site. No storage is planned for any site associated with this project. Any waste produced will settle to the bottom of the existing tanks and be removed directly from there. 11. Please list all proposed on -site and off -site improvements associated with the use (example: landscaping, fencing, drainage, turn lanes etc.) and a timeline of when you will have each one of the improvements completed. All improvements proposed for this project will be performed throughout and towards the end of the construction phase. All improvement will be completed based upon the construction stage of each facility and the pipeline and will be weather and seasonal dependent. Currently, it is anticipated that road access to the site will be from WCR 45. Saddle Butte proposes two access points from WCR 45 and one emergency access point from WCR 64. At the two general access points, tracking control will be installed in the form of 100' of asphalt from the county road. The access from the road to the new office building will utilize the same access points. Access to and from the truck loading ACTS will also utilize the same entry and exit points. Saddle Butte Rockies Storage and Terminals, LLC Lucerne Crude Oil Terminal Waste Handling Plan 1. All wastes generated on site will be disposed of by Waste management or Waste management Conservation Services Inc. (CSI). General wasted generated at the terminal will be taken to the Waste Management North Weld Landfill. Wastes generated by or accumulated in tanks will be removed via vacuum trucks and then transported to CSI. All sediment and solids removed from the tanks will be stored in tanks until transports to CSI. Traffic Narrative — Use By Special Review Saddle Butte Rockies Storage and Terminals, LLC Lucerne Crude Oil Terminal Section 26, T6N, R65W WCR 45 This traffic narrative is associated with the Use by Special Review application for the proposed Lucerne Crude Oil Terminal located along WCR 45, between WCR 64 and 64 %2 as proposed by Saddle Butte Rockies Storage and Terminals, LLC (Saddle Butte). Currently, the proposed construction site is owned by Saddle Butte and has 2 existing access points. The first access point from the south is a dirt farm access road from WCR 64. The second access point is is located on the north end of the property accessing an existing oil and gas well from WCR 64 % . Neither of these access point will be utilized for normal use by Saddle Butte. However, Saddle Butte is proposing to construct two new additional access points from the property to WCR 45. The first access point used for entering the facility will be located approximately 150' south of the intersection with WCR 64 % . The second access point will be constructed approximately 750' north of WCR 64 and will be used as the general exit from the site. Both access points will be constructed to allow for the entering and exiting of the semi -trucks. While the two existing access point will not be utilized, Saddle Butte is proposing to leave the southern access point as a viable emergency access point with a locked gate. In this area, both WCR 64 and 64 %2 are dead end roads ending approximately 1,600' to the east of WCR 45. Once constructed and at maximum build out, approximately 30 truckloads per day will enter and exit the terminal, every day of the year. The terminal will be accessed from WCR 45, with trucking coming from both the north and the south and from WCR 64. On unpaved roads, Saddle Butte will utilize water trucks as needed to control dust. Vehicle speeds will also be limited to ten miles per hour to reduce dust. The main access drive and truck circulation areas will be constructed with road base, thereby reducing dust emission. Truck unloading areas will be constructed with concrete. If areas are disturbed due to facility maintenance activities, disturbances will be watered to control dust as needed and vehicle speeds will be limited to ten miles per hour. Revegetation of the disturbed area shall be completed within one year. To prevent dust emissions, disturbed soil shall be furrowed a minimum of six inches deep at right angles to prevailing winds. If needed, silt fence shall be installed as a wind break. Water used for dust suppression will be provided by an offsite source. This document summarizes the site drainage with the intent of requesting a waiver from the Weld County Department of Public Works requirements for a full drainage report and design and construction of a detention pond (s) for the proposed site. The existing site, which is currently in agricultural use, drains from the northwest corner of the site to the southeast corner of the site and is relatively featureless. The properties to the north and south are similar in topography and use to the proposed site and also drain in the same direction. The properties to the north and south are separated from the proposed site by gravel roads (WCR 64 and WCR 64'/2) and a paved road to the west (WCR 45). Flow across the proposed site is sheet flow with no natural drainage channels or ditches evident on site. Drainage of the site flows toward the Greeley Weld County Airport where current and proposed drainage is collected by a stormwater swale or ditch west of the north -south taxiway directly east of the proposed site. Slopes on the site are approximately 1-1.5% across the site. The proposed site falls within a FEMA Zone C area. Proposed grading for the site is designed, in general, to follow the natural drainage and to smooth out the slight rises and depressions across the site to give an even sheet flow draining from northwest to southeast. In addition to the grading of the site for drainage; structural t i l l will be imported to construct secondary containment berms around the planned storage tanks. The area inside the containment berm will be lined with clay or HDPE and will drain to the south east end of the containment where it can be pumped out of the containment area in the case of a major storm. The inside area of the containment berms totals approximately 7.25 acres and is not designed to have an outlet to public drainage facilities_ Breakout tanks and crude polishing facilities will have secondary containment as well with a total of 0.53 acres of area. The total imperviousness for the proposed site is (I) is 0.046 taking into consideration the areas of the site within the secondary containment areas. In our estimation, the proposed grading and drainage for the project will adequately protect public health, safety and general welfare and will not cause adverse impacts from stormwater runoff to public rights of way or offsite properties. The addition of the containment berms for he storage tanks, crude oil polishing and breakout tanks will help to reduce the amount of stormwater runoff frol the site, reducing the burden on the public stormwater drainage system located just east of the property. Our understanding of her concerns are as follows: 1) The stormwater or snawmelt that is captured and contained in the tank berm will be pumped out of the berm and onto the surrounding terminal grounds, thus causing a high runoff event. 2) The proposed terminal grading will cause higher historical flows onto the University/Board property. Regarding Item 1, any stormwater or snowmeit that is captured and contained in the berm will either remain in the berm and evaporate or be pumped out to trucks for disposal off site. Regarding item 2, the proposed terminal grading follows the existing site contours and maintains the original site slope and direction of flow, with minor modification. The proposed site roads do have an impact to the soil permeability in rocalized areas; however, the amount of runoff onto the adjacent landowners should remain the same as it is now or be less due to the amount of stormwater contained in the proposed tank berm. The inside area of the containment berms totals approximately 7.25 acres. The proposed grading design Includes one Water Quality Feature on the southern portion of the east side of the site to intercept the drainage from the working areas of the site. This water quality feature is two (2) feet deep and has a volume of approximately 25,260 cubic feet. The required volume for the entire site is 13,537 cubic feet. The total site imperviousness (I) is 0.066, The proposed grading and drainage for the project will not cause increased impacts to properties downstream of the project site. It is requested that the requirement for stormwater detention and a full drainage report for the proposed Milton Terminal Site be waived. According to Weld County's records, the two parcels south of our property are owned by the State Board of Agriculture and the USDA -Experimental Potato Station. However, after further review and several conversations with the actual tenants of the parcels, we have identified the Colorado State University Research Foundation (CSURF) as the land manager of both parcels for the owner, CSU. Once we established the correct people to speak with, Saddle Butte provided CSURF with our proposed site plan on 3/30/16. CSURF's engineer provided comments back on 4/12/16. CSURF's comments were as follows: When the containment berm is pumped out, how will the water be conveyed off the site, where will it go and at what rate? If we get a 3" rain, the volume will be more than three times the volume of the small water quality depression in the southeast corner. I think it would be better to make the depression larger to detain the pumped stormwater and snowmelt. In general, based on the information provided, there is a concern that more than historical flows will enter on to the University/Board property which is unacceptable to us. Saddle Butte and our engineer's responded to these concerns on 4/18/16 (see attached). To date, Saddle Butte has not received any response back. In addition, Saddle Butte held an informal site visit with the local landowners yesterday evening (4/26/16), inviting landowners with property within 0.5 miles of the terminal site. During this site visit, a representative from CSURF was present. All present were given the site map that was submitted to the County. While the CSURF representative had some general questions, most were centered around how our structures would affect the weather station located approximately 0.43 miles south from our nearest proposed structure. When we stated that we had already received approval from the Airport Authority and the FAA, that seemed to take care of his concerns regarding structure height. Nothing was mentioned regarding the stormwater runoff. Anyway, that's the latest from Saddle Butte. Based upon this information, where do we stand in the USR process and what is next? As I stated earlier, Saddle Butte is in the process of getting approval to construct a crude oil terminal on property we currently own just north of your property (NW4 NW4, Section 35, T6N, R65W). As you can see in the attached site plan drawing, most of our facilities will be constructed on the northern portion of our property. As part of the county's approval process, we were asked to submit a drainage narrative. Based upon the narrative (attached) and the current county drainage codes, Saddle Butte requested a variance from the county regarding our drainage plan. The county has stated that they would have no problems issuing a variance, however, with the adjacent property to the south (your property) being used for research in agricultural irrigation, the county asked Saddle Butte to contact the landowner to make sure that there were no concerns from your standpoint. The goal of this exercise it to allow the county to issue the variance Saddle Butte with some amount of certainty that no negative issues will arise during the public comment portion of the county approval process, thus requiring the county to rescind their variance approval. With that, Saddle Butte is contacting CSURF as the managing entity for the adjacent property. Upon review of the attached information, please let me know if you have any additional questions. If you have no issues with our drainage narrative, please respond back to me so that I can provide your comments to the county.
