(Start) Statements to Weld County Commissioners Sept. 7, 2016 at 10: a.m.
1.Chapter 23 -Zoning
2. Article 1 General Provisions
3. Section 23-1-10 Title. The regulations contained herein shall be known and cited as Weld
County Zoning Ordinance.
4. Section 23-1-50 (B) interpretation: The word SHALL is mandatory.
S. SECTION 23-1-90: Definitions.
6. Accessory Building or Use. any Building or Use which:is subordiate in purpose,area or
intensity to the principle BUILDING OR USE served.
(A) Is normally associated with the principal BUILDING or USE.
(B) Contributes to the needs of the occupants within the principal BUILDING or USE.
7. AUXILIARY QUARTERS: one(1)or more interconnected rooms permanently attached to or
located within a SINGLE-FAMILY DWELLING which are arranged,designed,used or intended for
USE as a complete independent living facility for one (1)FAMILY. ALL AUXILIARY QUATERS SHALL
comply with the following requirements:.
(a) The AUXILIARY QUARTERS may NOT be used on any basis as a rental. PLANNING
COMMISSIONER JOHNSON ASKED what the intent of the residence will be after it serves it's
intended purpose? Mr Roehrs stated, they would like to reserve the right to use it as a rental.
This is not allowed in 23-1-90 (A).
(B) The use is subordinate in purpose,area or intensity and the occupants contribute to the
needs of the occupants of the SINGLE- FAMILY DWELLING SERVED. There are three questions,
in the questionare 1-2,&3. regarding the use of the of the structure. AM three answers are
basicallythe same. WHEN NEED HAVE FAMILY NEARBY TO HELP WITH CARE, TRANSPORTATION
FOR MEDICAL APPOINTMENTS,AND ASSISTED LIVING (IN-LAW CARE). Mr Roehrs also stated
this in the Planning Commission meeting. Last part is backwards with the first part of (B).
(D) The minimum lot size SHALL be no less than two and one-half (2 1/2 acres. The size of Lot -3
is 2.11 acres Assessors Records. Less than the required amount of the 2 1/2 acres. Legal Lot AS
used in this chapter,the term LEGAL LOT SHALL REFER TO: (B-2) For parcels in the A
(Agricultural) Zone District,meets the minimum area and similar requirements specified by this
chapter. The County Commissioners -wax pnot vary from the 2 1/2 acre minimum requirement
for AUXILIARY LIVING QUARTERS AND APPROVE (USR) 16-0017 PERMIT.

o School, Extracurricular activities, sports, horse training,
Church & Youth group
activities and general support as we raise a young family with horses.
