HomeMy WebLinkAbout20162585.tiffHEARING CERTIFICATION DOCKET NO. 2016-69.B RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR16-0020, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (STORAGE AND FABRICATION OF MATERIALS, INCLUDING STEEL PIPE) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT — MATTHEW AND HEATHER YOUNG A public hearing was conducted on September 14, 2016, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Department representative, Janet Lundquist Planning Services Department representative, Michelle Martin Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated July 22, 2016, and duly published July 27, 2016, in the Greeley Tribune, a public hearing was conducted on August 31, 2016, to consider the request of Matthew and Heather Young, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0020, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (storage and fabrication of materials, including steel pipe) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, at which time the Board deemed it appropriate to continue the matter to September 14, 2016, to allow the applicant to be present. On September 14, 2016, Bob Choate, Assistant County Attorney, made this a matter of record. E+ Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, site location and surrounding property uses. He stated the site is not within the three (3) mile referral area of any municipality and there has been no correspondence received from surrounding property owners. Mr. Ogle stated the applicants own and operate a fencing company utilizing pre -used pipe associated with the oil field. He reviewed the number of employees, hours of operation and reason for the zoning violation which will be corrected with the approval of this application. Staff sent out eight (8) referrals and five (5) offered comments for consideration. Janet Lundquist, Department of Public Works, provided a brief overview of the transportation plans and requirements to include the approved Access Permit, AP16-00272, utilizing County Road (CR) 32. She reviewed the proposed number of daily round trips, the average daily traffic counts on CR 32, and stated neither tracking control, nor an Improvements Agreement, will be required. 12 Michelle Martin, Department of Planning Services, presented the drainage and grading requirements and stated the applicant has submitted an acceptable drainage narrative that meets the exception for an exemption. She reviewed the Conditions of Approval (COA) and the Development Standards (DS) related to engineering. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions stating a portable toilet is acceptable and DS #14-20 address items relevant to Environmental Health. 12 Matt Young, applicant, introduced his representation, Attorney Bill Hughes. Mr. Young stated he buys oil field pipe that doesn't pass the test and sells it for fencing for agriculture use. He clarified he does not clean the pipe and it is required that the pipe is clean prior to purchasing it. In response to Commissioner Conway, Mr. Young stated he has no regular employees but hires temporary help to assist with property maintenance as needed. He clarified he added employees to the application for future needs and to prevent amending the USR. la In response to Commissioner Kirkmeyer, Mr. Young stated he currently uses a pickup and a trailer. He clarified he does not own any semi -trucks; however, if needed he hires a semi to help with moving product for larger orders. Mr. Young reviewed the parking area and traffic circulation. .Ke No public testimony was offered concerning this matter. la Commissioner Conway suggested amending DS #3 to reflect daylight hours, deleting DS #4, and changing DS #10 to restrict the number of employees to four (4). The Board agreed to the changes. E Mr. Ogle requested the Board strike COA #5.A, due to there being no requirement for tracking control. The Board agreed. In response to Commissioner Conway, Mr. Young stated he does not understand what the Small Business Development Program consists of. Commissioner Conway encouraged Mr. Young to speak to staff after the hearing. In response to Chair Freeman, Mr. Young indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. 2016-2585 PL2437 HEARING CERTIFICATION - MATTHEW AND HEATHER YOUNG (USR16-0020) PAGE 3 . Commissioner Kirkmeyer moved to approve the request of Matthew and Heather Young, for a Site Specific Development Plan and Use by Special Review Permit, USR16-0020, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (storage and fabrication of materials, including steel pipe) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 10:45 a.m. This Certification was approved on the 19th day of September, 2016.
