Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Parcel number 147128000059. Drainage Requirements: Please contact Department of Planning Services/Engineering Development Review for questions or assistance for drainage requirements at 970-353-6100. Detention Pond summarized in a Drainage Report: A final drainage report and detention pond design was submitted and is currently under review by engineering. The drainage report checklist will be used for a cursory review on compliance with county code. This site is not in a defined Municipal Separate Storm Sewer System (MS4)area which is a more urbanized area with state mandated, higher water quality requirements Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded).An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Floodplain: This area IS NOT in a FEMA regulatory floodplain. CONDITIONS OF APPROVAL: A. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required. (Department of Planning Services-Engineer) B. The plan shall be amended to delineate the following: 1. The applicant shall show and label the accepted drainage features and drainage flow arrows.Water quality features or stormwater ponds should be labeled as "Water Quality Feature/Stormwater Detention, No-Build or Storage Area" and shall include the calculated volume. According to the application the existing mobile home will be connected to a domestic well (permit 299840) and a new septic system. The mobile home cannot be utilized in conjunction with the business unless the well is repermitted to commercial. The application indicates that approximately 12 to 20 employees will access the site at full build out. A portable toilet and bottled water can be used for employees who are on site for 2 consecutive hours or less and 2 or less full time employees on site. A septic system will be required when the number of full time employees exceeds two. There will be washing on site, fuel storage and a maintenance shop. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 5. The facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in 25-12-103 C.R.S. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees, at all times. For employees or contractors on site for less than 2 consecutive hours a day, and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-site Wastewater Treatment Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The domestic well (permit 299840) shall be repermitted to commercial if used in conjunction with the business. 9. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 10.Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 11.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 12.The facility shall comply with all provisions of the State Underground and Above Ground Storage Tank Regulations. 13.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. MEMORANDUM 1ti ` ' ; C.= To: Diana Aungst, Planner February 19, 2016 From: Bethany Pascoe, Zoning Compliance Officer Subject: USR16-0006 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV15-00102)was noted. This violation was initiated due to the operation of a Commercial Trucking, more than 2 commercial vehicles (or at least commercially registered)without first completing the necessary Weld County Zoning Permits. This case has been forwarded to the County Attorney's Office and we have initiated legal action; therefore, an investigation fee is required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. If this application if approved by the Board of County Commissioners it will correct this outstanding violation. If this application is denied, the Department of Planning Services asks that the Board forward this case to the County Attorney's Office for legal action through the District Court process, but to delay that legal action for 30 (thirty)days to allow the applicant time to remove all but 1 Commercial Vehicle. Section 28: Part of the E/2NE/4 ("Application Property") Weld County, Colorado Ms. Aungst: This letter is being sent to inform you that Kerr-McGee Oil & Gas Onshore LP ("KMG" or the "Company") is the owner of valid oil and gas leases underlying all or parts of Section 28, Township 1 North, Range 66 West ("Leased Lands"), for which Weld County is reviewing USR16-0006. KMG is submitting this comment and objection, in accordance with the County's requirements. KMG's recorded oil and gas leases are real property interests entitling it to produce oil and gas from the Leased Lands (and, as may be applicable, adjacent lands). The Company has the right to utilize the Application Property to produce from existing wells, to maintain, rework, recomplete, and fracture those existing wells to enhance production, and to drill new wells to produce oil and gas, in accordance with applicable Colorado Oil and Gas Conservation Commission regulations and Colorado Statutes. KMG's oil and gas assets have significant value, and the Company is consequently concerned about any development, surface use, plan of use, PUD, zoning or rezoning, or other action by the County that would impair or preclude its ability to develop its oil and gas interests. KMG's preferred practice is to meet with surface owners and attempt to conclude a mutually acceptable agreement. KMG must object to any approval by the County for the Applicant's plans that fail to fully accommodate KMG's right to explore for, develop and produce oil and gas from its leasehold interests or the Leased Lands. KMG requests that the County withhold approval until such time as the Applicant and KMG have concluded an agreement. Any future surface development plans on the Application Property should incorporate and designate lands to be set aside for mineral development and expressly provide protection for KMG's current and future wells, pipelines, gathering lines and related oil and gas facilities and equipment. Weld County has a statutory obligation to ensure that the property rights of mineral interest owners are accommodated in its land use planning process. Approval of any surface development plan that forecloses the rights of mineral and leasehold owners may be a compensable taking. I. In reference to your answer to question 5 part (g) Brighton Fire Rescue District provides fire protection to the site. 2. Fire access road for existing structures on site shown on plans is approved subject to field inspection. It appears to meet requirements of 20 ft unobstructed width, 13.6 ft vertical unobstructed height and a maintained all weather driving surface capable of supporting 78,000 pounds. However, additional fire access road may be required with the development of the proposed future buildings(s). 3. Is the existing propane tank remaining on-site? If so please provide details. 4. Any structures built in the future will require notice letter from this office and may require a permit. 5. The proposed future 2,000 gallon fuel tank will require approval and a permit from this office in addition to any other county and state requirements. District Wildlife Manager Chris Mettenbrink reviewed the plans for the proposed project and has made a visit to the site to assess any potential impact the project may have on wildlife. The proposed project site is inhabited by a colony of prairie dogs. There are many burrows spread throughout the property. In addition to prairie dogs, there are other wildlife species that are dependent upon prairie dogs and their burrows for food, nesting, and raising their young. The primary species of concern is the burrowing owl. Burrowing owls begin arriving on the breeding grounds in Colorado in late March or early April with nesting a few weeks later. Burrowing owls will utilize prairie dog burrows for nesting and raising their young. If construction initiation is to begin between March 15th to October 31s`, we recommend that the prairie dog town be surveyed for burrowing owls. Colorado Parks and Wildlife has a set of standards for surveying for burrowing owls which can be found at the following link: http://cpw.state.co.us/Documents/WildlifeSpecies/Profiles/BUOWSurveyProtocol2007.pdf. If the applicant is not able to perform the survey, a wildlife consultant should be utilized to perform the necessary survey to prevent any take of burrowing owls. In addition, prior to any dirt work being performed, any prairie dogs in the footprint of the construction site should be humanely euthanized according to USDA standards. Once the prairie dogs have been euthanized, their burrows should be back filled to prevent other prairie dogs or other wildlife such as burrowing owls from occupying the burrows. If burrowing owls are detected on the property, the applicant should contact District Wildlife Manager Chris Mettenbrink at 303-906-1979 for advice on how to proceed with the proposed project. Any other questions regarding wildlife on the property may be direct to Chris as well.
