URBANIZING VS NON -URBANIZING DRAINAGE AREA:
This area IS within an Urbanizing Drainage Area:
Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of
the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for
URBANIZING areas.
Detention Pond summarized in a Drainage Report:
A drainage report and detention pond design shall be completed by a Colorado Licensed Professional
Engineer and adhere to the drainage related sections of the Weld County Code. The drainage report must
include a certification of compliance stamped and signed by the PE which can be found on the engineering
website. General drainage report checklist is available on the engineering website. More complete
checklists are available upon request.
The applicant has submitted an acceptable Final Drainage Report and is requesting a variance to allow for
Retention, due to the inability to release the water in the historical flow. This variance has been accepted.
MS4:
This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized
area with state mandated, higher water quality requirements
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant and Planning Department have reviewed the referral and surrounding
property owner comments. The Early Release Request may or may not be granted depending on referral
comments and surrounding property owner concerns. Contact a Engineering representative from the
Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692-
3575.
Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL:
A. The plan shall be amended to delineate the following:
1. The applicant shall show and label the accepted drainage features and drainage flow arrows. Water
quality features or stormwater ponds should be labeled as "Stormwater Retention, No -Build or
Storage Area" and shall include the calculated volume. (Department of Planning Services -

2. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for any Use Permitted as
a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or
Industrial Zone Districts (Outdoor storage of RVs, Boats, ATVs, vans, standalone
campers, motorhomes, 5th wheel trailers, pickup trucks with or without attached
campers, and other similar items including industrial or commercial vehicles and flatbed
trailers, an office and an RV dump station) provided that the property is not a lot in an
approved or recorded subdivision plat or lots parts of a map or plan filed prior to
adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District
There will be a RV dump station located on site. Portable toilets and bottled water will
be utilized according to EH division policy.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The facility shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.

4. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air quality
regulations.
5. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
6. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Onsite Waste Water Treatment Systems. A
permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
7. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. For 10 or less customers or
visitors per day, and 2 or less full time employees on site, portable toilets and
bottled water are acceptable. Records of maintenance and proper disposal for
portable toilets shall be retained on a quarterly basis and available for review by
the Weld County Department of Public Health and Environment. Portable toilets
shall be serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
8. RV dump stations shall be connected to an appropriately engineer designed
Onsite Waste Water Treatment System which complies with all provisions of the
Weld County Code, pertaining to Onsite Waste Water Treatment Systems.
9. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Dear Mr. Knodel:
The Fire Prevention Bureau has reviewed your submission to Weld County and have the
following comments based on the 2012 IFC:
1) Note: The IFC defines a facility as a building or use in a fixed location including exterior
storage areas for flammable and combustible substances and hazardous materials, piers,
wharves, tank farms and similar uses. This term includes recreational vehicles, mobile
home and manufactured housing parks, sales and storage lots.
1) Please provide a swept path analysis using the attached fire apparatus specifications to
show that our fire apparatus will be able to navigate along the fire access roads within the
facility:
a. 503.1.1 Buildings and facilities. Approved fire apparatus access roads shall be
provided for every facility, building or portion of a building hereafter constructed
or moved into or within the jurisdiction. The fire apparatus access road shall
comply with the requirements of this section and shall extend to within 150 feet
(45 720 mm) of all portions of the facility and all portions of the exterior walls of
the first story of the building as measured by an approved route around the
exterior of the building or facility.
b. 503.1.2 Additional access. The fire code official is authorized to require more
than one fire apparatus access road based on the potential for impairment of a
single road by vehicle congestion, condition of terrain, climatic conditions or
other factors that could limit access.
c. 503.2.1 Dimensions. Fire apparatus access roads shall have an unobstructed width
of not less than 24 feet (6096 mm), exclusive of shoulders, except for approved
security gates in accordance with Section 503.6, and an unobstructed vertical
clearance of not less than 13 feet 6 inches (4115 mm).
d. 503.2.3 Surface. Fire apparatus access roads shall be designed and maintained to
support the imposed loads of fire apparatus and shall be surfaced so as to provide
all-weather driving capabilities. Note: The term "all-weather driving capabilities"
would typically require some type of paved or hard surface. Gravel would be
prone to problems in areas subject to much rain or in snowy climates where
plowing.

e. 503.2.4 Turning radius. The required turning radius should be determined using
the fire apparatus specifications attached.
f. 503.2.5 Dead ends. Dead-end fire apparatus access roads in excess of 150 feet (45
720 mm) in length shall be provided with an approved area for turning around fire
apparatus. See approved turnarounds that are attached.
g. 503.6 Security gates. Where security gates are installed, they shall have an
approved means of emergency operation. The security gates and the emergency
operation shall be maintained operational at all times. Electric gate operators,
where provided, shall be listed in accordance with UL 325. Gates intended for
automatic operation shall be designed, constructed and installed to comply with
the requirements of ASTM F 2200.
2) Please provide documentation that water supply requirements are met in accordance with
the following:
a. 507.1 Required water supply. An approved water supply capable of supplying the
required fire flow for fire protection shall be provided to premises upon which
facilities, buildings or portions of buildings are hereafter constructed or moved
into or within the jurisdiction.
b. 507.2 Type of water supply. A water supply shall consist of reservoirs, pressure
tanks, elevated tanks, water mains or other fixed systems capable of providing the
required fire flow.
c. 507.3 Fire flow. Fire flow requirements for buildings or portions of buildings and
facilities shall be determined by Appendix B.
d. 507.5.1 Where required (hydrant system). Where a portion of the facility or
building hereafter constructed or moved into or within the jurisdiction is more
than 400 feet (122 m) from a hydrant on a fire apparatus access road, as measured
by an approved route around the exterior of the facility or building, on -site fire
hydrants and mains shall be provided.

Dear Ms. Aungst:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The application is for a site specific development plan and use by special use permit for an
outdoor storage business on a 10 acre parcel identified as Lot B of Recorded Exemption RE -
4217. The facility would have a security system with no on -site staff, though the applicant is
planning to build an office with one employee. The proposed water supply for the office is
bottled water and a porta-toilet. The application materials indicate that there will be on -site
landscaping. The applicant is also seeking a waiver to have a retention pond on -site instead
of a detention facility.
No information was provided about proposed water source for on -site landscape
irrigation. Any water used for irrigation must come from a legally available water source.
The applicant is seeking a waiver from the county's detention pond facility requirements so
that they may install a retention pond instead. As described in the application materials, the
proposed pond design will have no outlet and will not allow any storm water runoff to leave
the site. The structure appears to be below grade; it is unclear if the pond will expose
ground water and if the pond will continuously hold standing water or if the water is expected
to infiltrate the ground within a given period of time.

As described, the proposed retention pond does not appear to meet the requirements of a
"storm water detention and infiltration facility" as defined in section 37-92-602(8),
Colorado Revised Statutes. Any storage of storm water that does not meet the statutory
criteria referenced above will be subject to administration by this office and must be
capable of releasing all out -of -priority inflows or else obtain a court approved plan for
augmentation. In addition, at no point should the pond expose ground water without first
obtaining a court approved plan for augmentation and well permit.
Attached is DWR's Administrative Statement Regarding the Management of Storm Water
Detention Facilities and Post-WildlQnd Fire Facilities in Colorado, which describes the
requirements of section 37-92-602(8) in more detail. If you, or the applicant, have any
