SALTWATER INJECTION FACILITY) AND OBTAIN A CERTIFICATE OF DESIGNATION
IN THE A (AGRICULTURAL) ZONE DISTRICT - WASTE MANAGEMENT OF
COLORADO, INC.
A public hearing was conducted on July 13. 2016. at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 3. 2016, and duly published
June 8. 2016. in the Greeley Tribune, a public hearing was conducted to consider the request of
Waste Management of Colorado, Inc., for a Site Specific Development Plan and Use by Special
Review Permit, USR14-0080, for a Solid Waste Disposal Site and Facility (solids treatment and
beneficial reuse of commercial exploration and production waste and other appropriate non-
hazardous waste streams. including cements and other non -hazardous solid waste with free
water or liquids, oil water slurries, high oil content slurries, produced water/flowback from
exploration and production wells. and drilling fluids (muds), along with an Oil an and Gas Support
Facility (Class II Oilfield Waste Disposal Facility — Saltwater Injection Facility) and obtain a
Certificate of Designation in the A (Agricultural) Zone District. Bob Choate, Assistant County
Attorney, made this a matter of record.
a Mr. Choate stated his recommendation to continue the hearing due to the notice
requirements not being met. He explained the Certificate of Designation has very specific notice
requirements based on state statutes. The recommendation is to continue both the Use by Special

because they are related items and he further recommended each item be a separate item on the
agenda. He clarified this continuance will allow the County to meet the statutory commitments
regarding proper notification.
In response to Commissioner Kirkmeyer. Mr. Choate stated Bruce Barker, County Attorney,
recommended bringing them up separately.
FA Chair Freeman agreed with the recommendation to continue these items to August 24, 2016.
The Board agreed.
1,7= Jason Conn, applicant, stated he has spoken with the County Attorney and Mr. Gathman
and that he understands and accepts the need to continue to meet the statutory requirement.
No public testimony was offered concerning this matter.
Commissioner Cozad moved to continue the request of Waste Management of Colorado,
Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR14-0080, for
a Solid Waste Disposal Site and Facility (solids treatment and beneficial reuse of commercial
exploration and production waste and other appropriate non -hazardous waste streams. including
cements and other non -hazardous solid waste with free water or liquids, oil water slurries, high
oil content slurries, produced water/flowback from exploration and production wells. and drilling
fluids (muds). along with an Oil an and Gas Support Facility (Class II Oilfield Waste Disposal
Facility — Saltwater Injection Facility) and obtain a Certificate of Designation in the A (Agricultural)
Zone District. to August 24. 2016, at 10.00 a.m., to meet the obligatory state notification
requirement. The motion was seconded by Commissioner Conway. who also thanked the
applicant for their patience during this process. There being no further discussion, the motion
carried unanimously and the hearing was completed at 10:24 a.m.
