Explain in detail, the proposed use of the property. The oil and gas market is continuing to expand in Weld County. The applicant, Blue Grama Land Corporation (Blue Grama), proposes to use a 12.8 +/- acre parcel as a Truck Unloading and Oil and Gas Support Facility as defined in the Weld County Code. The proposed Riverside facility will collect crude oil produced on the 70 Ranch and neighboring properties via gathering lines and trucks that are already accessing the property. Material collected will then be transported in a 12" pipeline to the Lucerne East Facility under USR15-0037. At the Lucerne East Facility, the crude oil will be transferred into the 20" Grand Mesa Pipeline to Cushing, Oklahoma. The 12" pipeline will be regulated by FERC and designed to meet DOT standards. This 12" pipeline is exempt from needing a USR under the current Weld County Code Standards. Blue Grama has commitments from key industry producers to transport crude oil from Weld County to Cushing, Oklahoma. From Cushing, the resource is piped for refinement before being sent to other domestic and international destinations. A communications tower that will not exceed 35' is planned for the facility as illustrated on the attached USR application map. The site is located approximately 7,000' east of Weld County Road 69 and approximately 10,000' north of the intersection of Weld County Roads 69 and 50. The site is located in part of the South of half of Section 24, Township 5 North, Range 63 West of the 6th P.M., Weld County, Colorado. The facility access will be from WCR 388. The facility will operate 24 hours a day, 7 days a week, 365 days a year. This site is designed to be unmanned. For safety of the facility and the pipelines, the facility is monitored 24/7/365 from the Edmond, Oklahoma control center. Staff will visit the site for maintenance and inspection. The site will be monitored by surveillance cameras. Blue Grama anticipates that initially up to 20,000 barrels of product will be delivered to the facility by trucks each day. In the future, 60,000 barrels of product may be delivered to the facility via future gathering lines. As additional gathering lines are constructed to the facility, the number of trucks may be reduced. All out-bound material will be transported via pipe to the Lucerne East facility. The site will be secure and fenced with chain link and will include a swipe or keyed access. The unloading area will be fenced separately from the residual of the property. The unloading area may be open during daylight hours and access will be controlled via card or key-pad entry system for evening or weekend access. Access to the facility will be controlled by an automated access system. Lighting will be for security purposes and shall not spill onto adjacent properties. Access to the tank and laydown area will be secured 24/7 and accessed via swipe or key system. Traffic generation, site access and the proposed site improvements/structures are discussed in further detail elsewhere in this questionnaire. Cattle guards will be placed at the facility entry/exit points to keep cattle from entering the facility. There are other permits that Blue Grama will be submitting to the State of Colorado for this project. If requested, copies of these permits may be provided to Weld County. A copy of the Air Pollution Emission Notice permit application submittal are included with this USR Application submittal. A Secondary Containment and Unloading Pad Plan will be provided 30 days prior to construction of that portion of the facility, as applicable. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan The Weld County Comprehensive Plan has established Goals and supporting Policies that encourage responsible Oil and Gas development in Weld County. Below is a list of specific Oil and Gas goals followed by an explanation of how the goals are being addressed by this application. ❑ OG.Goal 1 : Promote the reasonable and orderly exploration and development of oil and gas mineral resources. ❑ OG.Goal 2: Ensure that the extraction of oil and gas resources conserves the land and minimizes the impact on surrounding land and the existing surrounding land use. OG.Goal 3: Prevent surface and groundwater contamination from oil and gas minerals exploration and extraction. The proposed Riverside Station is a new facility in an isolated area of Weld County experiencing increased oil and gas activities. The proposed facility will support the industry by transporting material produced in the vicinity to Cushing, Oklahoma where it is then transported to refineries for processing. This facility is designed to collect the produced oil from nearby wells via gathering lines and then pipe the material to the Lucerne Facility. It is estimated that 90% of the existing truck traffic will be eliminated from Weld County Roads by the development of this facility. The market has directed the need for this proposed facility. The facility will minimally impact the surrounding properties as the nearest residential structure is more than 7,000 feet to the west. Surrounding properties include unincorporated Weld County, oil and gas exploration, agricultural uses with some rural residential. The facility is surrounded by land owned by the 70 Ranch as well as the State of Colorado. Traffic generation and access will be discussed further in this application. Refer to the Drainage Report and Plan included with application materials. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. The application materials have been prepared according to the Weld County pre-application meeting held on July 17, 2015, and in conformance with Division 4 starting with Section 23-2-200 of the Weld County Code. The property is zoned "A" Agricultural and according to the Weld County Code, oil and gas support and service facilities are a Use allowed by Special Review in the Agricultural Zone District. Crude oil processing facilities are considered an oil and gas support facility supporting the submittal of this application for review. 2 Crude oil will be transferred into the 12" line that will connect the Riverside facility to the Lucerne facility. Once the material is transported from Riverside to Lucerne, the crude oil will be transferred to the 20" Grand Mesa Pipeline to Cushing, Oklahoma. The 12" pipeline will be regulated by FERC and designed to meet DOT standards. This 12" pipeline is exempt from needing a USR under the current Weld County Code Standards. 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surrounding land uses). The proposed facility has been designed to minimally impact the surrounding properties. The surrounding properties are in agricultural production with rural residential uses with 7,000 feet of the proposed facility. Surrounding properties include unincorporated Weld County, oil and gas exploration, agricultural uses with some rural residential. S. Describe, in detail, the following: a. Number of people who will use the site. b. Number of employees proposed to be employed at this site. This facility is designed to be unmanned. The facility will be visited by staff for maintenance and security purposes, however, staff will not be permanently employed at this facility. Up to 111 trucks will access the site in a 24-hour period. At this time, it is estimated that 90% of these trucks are already accessing the property. This proposed facility has the potential of reducing trucks on County Roads. Rather than exiting and entering the site several times during the day, the trucks will be able to use ranch roads to transport material to the facility vs. hauling material off-site. c. Hours of operation. Generally the site will be open from 7 am — 6 pm for trucking operations, however, the site will operate 24/7, 365 days per year. The Edmund control center operates 24/7 allowing continuous monitoring of the facility and pipeline for increased public safety, protection of the crude resource, and efficiency of delivery. d. Type and Number of structures to be erected (built) on this site. The following improvements/structures proposed to be located on site are listed below. It is important to note that the final dimensions and location of the equipment and structures will be determined with the final facility design and illustrated on building permits. The applicant has provided the best estimation of location and sizes of the equipment and structures for the USR application submittal. The general descriptions of these items are described below: ❑ Two 9,500 barrel tanks are illustrated on the USR Map. These tanks have been designed with primary and secondary containment structures. The tanks will be approximately 30 — 40' tall. 0 Covered truck unloading bays and staging area: Four covered units are planned. There will be a culvert structure under the bay to collect all crude should an accidental spill occur. There will be a hatch area to access and remove any collected material. The function of this area is to transfer material from the trucks to the Delivery Manifold. 3 o A Driver's Shack will be included in each lane for drivers to complete their Manifest documents. o Portable toilets with hand-sanitizer will be located in the bay area. o Instrumentation at the bay will identify the water and sediment content of the material. This facility will only accept merchantable crude oil. o Staging of one truck can occur at each bay. There is an overflow staging area designated on the USR Map. ❑ Facility Sump: The drain lines for equipment will be collected at this location. This is a collection point for all oil at the facility. • Booster Pump: This is the power source for the facility and will pressurize the crude oil from the tank entering the mainline pumps. ❑ Power Control Room (PCR): The switch gear and electrical equipment will be housed at this location. This building may be a manufactured structure permanent to the site. By including this in the USR application, the need for a Zoning Permit for a Mobile Structure is negated. ❑ Surveillance Meters: Crude flow will be metered in this area for line-balancing purposes. ❑ Launchers and Receivers: These pumps will pump the crude oil from the 9,500 barrel tanks into the 12" line to the Lucerne facility. Equipment called "Pigs" are used to check and clean out the lines. The area labeled "Launcher" is the launching area for then the pigs are needed. ❑ On-site transformers: This is the location where power will enter the site and be distributed for on-site activities only. The footprint illustrated on the application maps described the anticipated footprint. This is the general location of the facility. ❑ Office: There may be a mobile unit installed in the area illustrated on the submitted USR Map for use as a lab and/or an office. This building may be a manufactured structure permanent to the site. By including this in the USR application, the need for a Zoning Permit for a Mobile Structure is negated. ❑ Supportive equipment and incoming gathering lines: Some equipment will be linked to gathering systems from secondary companies who are connecting their production sites to this facility. The attached USR Map illustrates the out-bound line which will lead to the Lucerne Facility and the in-bound Rimrock Gathering Line. ❑ An outside lay-down yard is illustrated on the USR Map. This area will be used to store equipment needed for the construction of this facility as well as equipment that may be needed for the Grand Mesa Pipeline. 1 A future sign for the facility will not exceed 16 square feet in size and will not be greater than 6 feet tall. ❑ The traffic routes will be surfaced with native material or recycled base as illustrated on the USR Map. Aggregate materials such as pea gravel or larger gravel will cover portions of the site around the equipment areas similar to other facilities to reduce dust and weeds and allow easy maintenance and upkeep of the facility. • Typical lighting is illustrated on the submitted plans and shall be installed to not spill onto the adjacent land. Lighting will be directed to the equipment. ❑ Lightning suppressors will be incorporated into the site design. ❑ The facility will be fenced. The unloading bay area will be fenced separately. Fencing will be 6' chain link with 3' of barbed wire topping the chain link. An additional cattle guard fence 4 will be separated from the chain link fence by approximately 3 ' to allow weed management between both fences. The cattle guard fence (4-strand barbed wire) will allow adequate separation to protect the chain link fence. e. Type and number of animals, if any, to be on this site. Animals are not going to be kept on site. f. Kind of vehicles (type, size, weight) that will access this site and how often. It is anticipated this site will generate up to 111 trucks and 1 passenger vehicle per day with the majority of the trips occurring during daylight hours. The main access to the facility will be on a private road extending from Weld County Road 69. A dedicated truck entrance and truck exit into the unloading area are located off of the private 70 Ranch Road. Staff will access the residual portion of the site in passenger vehicles from the unloading area through a sliding gate. The access points have been designed to accommodate emergency vehicles. The applicant will reach out to the Platte Valley Fire Protection District prior to submitting the formal USR application. According to the Traffic Narrative, "the Blue Grama Riverside Facility will result in a reduction of about 100 trucks per day on CR 50, CR69, CR388 and other County roadways serving this area. Accordingly, the Blue Grama Riverside facility will beneficially impact area roadway operations and is viable from a traffic engineering perspective." g. Who will provide fire protection to the site. The property is within the Platte Valley Fire Protection District boundary. The applicant has provide information to the District as evidenced in application materials. Future collaboration between Blue Grama and the District is anticipated. h. Water source on the property (both domestic and irrigation). Water is needed for hydrotesting and dust control. i. Sewage disposal system on the property (existing and proposed). Portable toilets and hand-washing facilities will be provided for sanitary sewage disposal. j. If storage or warehousing is proposed, what type of items will be stored. Some outside storage of new pipe and facility-related equipment will be stored on site in the lay-down area. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. Landscaping is not proposed for the facility. Vegetation can be a fire hazard at these types of facilities. The detention facilities will be re-seeded for erosion control. The undisturbed areas will remain native. The remainder of the site, including the process areas, will be covered in road base, rock or other non- flammable aggregate material. These materials are most conducive to keep weed free. Stockpiles of topsoil 5 during construction will be seeded or covered to prevent blowing dust and to preserve the topsoil for use on site. 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. When termination of the facility occurs, the facilities will be removed and the land will be returned to its native state. 8. Explain how the storm water drainage will be handled on the site. Off-site flows will be routed around the site. On-site flows will be conveyed to on-site facilities/facility. The one-hundred year developed storm event will be released at the ten-year historic rate from the ponds. Additional details can be found in the Drainage Report attached with the USR application submittal. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. Blue Grama anticipates that it will take approximately 6 — 12 months to construct the site and are aiming to have the site functioning by mid - 2016. 10. Explain where storage and/or stockpiles of wastes will occur on this site. There will be no storage and/or stockpiles of waste on this site. 11. Please list all proposed on-site and off-site improvements associated with the use (example: landscaping, fencing, drainage, turn lanes, etc.) and a timeline of when you will have each one of the improvements completed. In addition to the response to Question 5d above, the following additional on-site improvements will be constructed at this location: ❑ Over-lot grading will be completed during the Winter, 2015 . Detention and drainage will be constructed after over-lot grading into Spring, 2016. 0 During construction, water will be used for dust suppressant as needed. ❑ Blue Grama is proposing temporary and permanent manufactured structures as illustrated on the USR Map submitted with application materials. The subject of this Lease is the following parcel (the "Blue Grama Lease Lands" or the "Lands"): 12.8 acres, more or less, in Section 24, Township 5 North Range 63 West, ft" P.M., Weld County, more particularly described as Weld County Parcel No. 096524100003 [see Exhibit 1 -A to the Surface Use Agreement for legal description and map]. For $ 100, payment of monthly rent, and other good and valuable consideration, the receipt and sufficiency of which arc hereby acknowledged, Terminus North by this Lease does grant, lease, remit and remise the Lands to Blue Grama, on the following terms: 1 . The term of this Lease shall extend for the period set forth in Section 9 of the Surface Use Agreement executed contemporaneously by Terminus North, Blue Grama, and 70 Ranch, LLC on the above date that is attached hereto as Exhibit 1 and made a part hereof as though fully set forth herein (the "Surface Use Agreement"), provided that, on the second anniversary of this lease, Blue Grama has built the Crude Oil Facility or is in the process of building said facility. 2. This Lease is granted for the purpose of allowing Blue Grama the right to apply for permits to use said premises for the purpose of erecting, installing, maintaining, operating, altering, replacing, repairing, and removing electrical meters and pump facilities, tanks, outbuildings, office space, truck loading and unloading sites, pipelines, including appurtenances thereto and for oil and gas storage in tanks, shipment by trucks and pipeline, measurement and other purposes and uses in connection therewith. Lessee shall have the right and obligation to do and perform such acts on adjacent land as may be necessary to protect Lessor's and its property in case of fire or flood and to prevent spread and loss of oil. Blue Grama shall have the use of the surface of the Lands during the term of this Lease. Blue Grama shall also have the right of ingress and egress to and from the Lands and across the adjoining lands owned by 70 Ranch, subject to the terms of the Surface Use Agreement. The monthly payment fees described in the Surface Use Agreement are rental obligations of this Lease. 3. All equipment, fixtures, and facilities placed on the Lands by Blue Grama shall be and remain the property of Blue Grama. Upon expiration of this Lease, Blue Grama shall have a reasonable time, not to exceed One Hundred Eighty ( 180) days, in which to remove all of Blue Grama's equipment, fixtures, and facilities. While the design of the facility has not been finalized , this application is to authorize the construction of: • Two (2) 9,500-barrel internal floating roof ( IFR) storage tanks (T-951 and T-952), and • One ( 1 ) 300 Kilowatt emergency generator. The maximum facility throughput is estimated at 19, 000 barrels per day (bpd ). Throughputs will be maintained on a 12-month rolling average. Total VOC emissions are estimated at hazardous air pollutant (HAP) emissions are estimated at 2 .2 TPY. A summary of emissions from the facility are presented in Table 1 - 1 . This will ensure the final design is reviewed before issuing of the permit. 1 Blue Grama Land Corporation - Riverside Station General Permit Application Project No. 0214P018B 2.0 PROCESS/PROJECT DESCRIPTION 2. 1 Process Description The Riverside Station receives crude oils and natural gas condensate via pipeline from nearby wells and production facilities. The material is stored in IFR tanks and transported out via pipeline and by tank truck. A process flow diagram is provided in Appendix A, Figure 2 . 2.2 Project Description The objective of this project is to construct: • Two (2) 9,500-barrel floating roof ( IFR) storage tanks (T-951 and T-952), • One ( 1 ) 300 Kilowatt generator, and • Additional fugitive components (i .e. , valves, flanges, etc. ) associated with the new tanks. 2.3 Station Location From Greeley, head North on 8th Avenue. Turn right onto O St. and continue on Co Rd 64. Turn left onto Weld County Rd 43. Take the first (paved ) right onto Co Rd 66 and continue for about 0.8 miles to find the Station entrance on the right. ZISIC Blue Grama Land Corporation - Riverside Station General Permit Application Project No. 0214P018B 3.0 EMISSIONS CALCULATIONS 3. 1 Storage Tanks VOC emissions from the proposed tanks are calculated using EPA's TANKS 4.09 program , as shown in Appendix C. The tanks store crude oil . Emissions from the tanks are summarized in Table C-2 of Appendix C. The TANKS 4.09d output file for condensate at RVP 12 is also included . 3.2 Startup, Shutdown, and Maintenance (SSM) Events (Roof Landings) The CDPHE requires the permitting of certain predictable SSM events for a facility. The only significant SSM events are the landing of the floating roofs during an inspection or repair. Blue Grama Land Corporation estimates that no more than two landing events each year. Emissions were calculated using the roof landing Equation 2-26 found in AP-42, Chapter 7. Emissions from roof landings are shown in Table C-3. Emissions from the roof landings are being included in the tank APEN . 13 Emergency Generator Riverside Station plans to install one ( 1 ) EPA-certified 300 Kw (449-hp) diesel-fired emergency generator. The run time on the generator will be limited to 500 hours per year, and the unit will be equipped with a non-resettable hour meter. Emissions from the emergency generator are based on EPA Tier III standards and AP-42 , Section 3.3. Calculations are shown in Appendix C, Table C-4. 3.4 Fugitive Emissions The definition of "Potential to Emit" can include physical or operational limitations that are state enforceable (5 CCR 1001 -2 I .G . ). Based on AQCC Regulation No. 7 requirements for fugitive sources (i .e. , LDAR program ) that the emissions from fugitive sources are APEN-exempt [i .e. , less than 1 ton per year (TPY)] . Fugitive VOC emissions are calculated using emission factors found in the EPA document "Protocol for Equipment Leak Emission Estimates" (EPA 453/R95- 017) Table 2-8 Oil and Gas Screening Ranges Emission Factors. A summary of proposed fugitive components and VOC emissions is included in Appendix C, Table C-2 for completeness. ZISIC Blue Grama Land Corporation - Riverside Station General Permit Application Project No. 0214P018B 4.0 REGULATORY APPLICABILITY ANALYSIS This section provides a summary demonstration that this project will meet all of the applicable Federal Regulations and State Regulations. 4. 1 Federal Regulations PSD, 40 CFR Part 52 [Not Applicable] The facility is not a Prevention of Significant Deterioration (PSD) major source because VOC emissions are less than 100 TPY. Standards of Performance for New Stationary Sources (NSPS), 40 CFR Part 60 [Applicable] Subpart A requires the submittal of several notifications for NSPS-affected sources. Within 30 days after starting construction of any affected facility, the Facility must notify the Administrator (CDPHE) that construction has commenced . A notification of the actual date of initial startup of any affected facility will be submitted within 15 days after such date. If required , initial performance tests are to be conducted within 60 days of achieving the maximum production rate, but not later than 180 days after initial startup of the facility. The facility must notify CDPHE at least 30 days prior to any initial performance test and must submit the results of the initial performance tests to CDPHE . Subparts Kb, Volatile Organic Liquid (VOL) Storage Vessels. This subpart regulates hydrocarbon storage tanks larger than 19,813 gallons capacity and built after July 23, 1984. The proposed IFR tanks are subject to and will comply with NSPS Subpart Kb. Subpart 1111 , Standards of Performance for Stationary Compression Ignition (CI ) Internal Combustion Engines ( ICEs). This subpart affects stationary CI ICEs based on power and displacement ratings, depending on date of construction , beginning with those constructed after July 11 , 2005. For the purposes of this subpart, the date that construction commences is the date the engine is ordered by the owner or operator. Compliance with this subpart is required in this permit for the emergency generator. National Emission Standards for Hazardous Air Pollutants (NESHAPs), 40 CFR Part 61 [Not Applicable] There are no emissions of the regulated pollutants other than benzene. The facility will emit less than 150 pounds of benzene in any 12-month period . However, the facility is not one of the listed affected sources and is, therefore, exempt from this part. NESHAP, 40 CFR Part 63 [Some Applicable] Potential HAP emissions from the facility are below the 10/25 TPY major source thresholds as shown in the emissions section . Subpart OO The facility is not subject to the provisions of this subpart because they apply to the control of air emissions from tanks for which another subpart of 40 CFR parts 60, 61 , or 63 references the use of this subpart for such air emission control . Subpart EEEE for storage of organic liquids. Final Rule published in the Federal Register on February 3, 2004. This facility is a true minor source of HAPs and is not subject to this subpart. ZISIC Blue Grama Land Corporation - Riverside Station General Permit Application Project No. 0214P018B Subpart ZZZZ, Reciprocating Internal Combustion Engines (RICE ). This subpart affects new engines at area sources. Blue Grama will meet the requirements of Subpart ZZZZ by complying with the applicable provisions of 40 CFR Part 60 Subpart 1111 for the emergency generator. Compliance Assurance Monitoring (CAM), 40 CFR Part 64 [Not Applicable] CAM applies to any pollutant-specific emission unit at a major source that is required to obtain a Title V permit, if it meets all of the following criteria : • It is subject to an emission limit or standard for an applicable regulated air pollutant. • It uses a control device to achieve compliance with the applicable emission limit or standard . • It has potential emissions, prior to the control device, of the applicable regulated air pollutant of greater than 100 TPY. The facility is not required to obtain a Title V permit, this rule does not apply. Chemical Accident Prevention Provisions, 40 CFR Part 68 [Not Applicable] The definition of a stationary source does not apply to transportation , including storage incident to transportation , of any substance or any other extremely hazardous substance under the provisions of this part. Naturally occurring hydrocarbon mixtures, prior to entry into a natural gas processing plant or petroleum refining process unit, including : condensate, crude oil , field gas, and produced water, are exempt for the purpose of determining whether more than a threshold quantity of a regulated substance is present at the stationary source. Stratospheric Ozone Protection, 40 CFR Part 82 [Not Applicable] The facility does not produce, consume, recycle, import, or export any of the controlled substances or controlled products as defined in this part, nor will service on motor (fleet) vehicles, which involves ozone-depleting substances, be performed . Therefore, as currently operated , the facility is not subject to these requirements. 4.2 Colorado Air Pollution Control Rules Regulation No. 1 (Particles, Smokes, Carbon Monoxide and Sulfur Oxides) [Not Applicable] Regulation No. 1 sets forth emission limitations, equipment requirements and work practices (abatement and control measures) intended to control the emissions of particles, smoke, and sulfur oxides from new and existing stationary sources. This facility is a source of VOC only so it not subject to Regulation No. 1 . Regulation No. 2 (Odor Control) [Applicable] Regulation No. 2 sets standards for allowable odor contaminants for different land-use areas in the state and outlines control measures that can be taken to bring violators into compliance. The Facility will comply with the applicable standards. Regulation No. 3 (Air Pollution Emission Notices-Permits) [Applicable] Regulation No. 3 requires sources of air contaminants to file Air Pollution Emission Notices. It also requires new or modified sources of air pollution to obtain preconstruction permits. The facility is complying with Regulation No. 3 requirements with this submittal . The tanks are subject to New Source Performance Standards Subpart Kb and will comply with applicable requirements. Regulation No. 7 (Volatile Organic Compounds Control) [Applicable] Regulation No. 7 sets standards for controls of VOCs from storage tanks located in non- attainment areas. The storage tanks are equipped with IFR controls that meet the regulatory requirements. Maintenance checks and readiness testing of such units is limited to 100 hours per year. There is no time Limit on the use of emergency stationary ICE in emergency situations. The owner or operator may petition the Administrator for approval of additional hours to be used for maintenance checks and readiness testing, but a petition is not required if the owner or operator maintains records indicating that Federal, State, or local standards require maintenance and testing of emergency ICE beyond 100 hours per year. Emergency stationary ICE may operate up to 50 hours per year in non-emergency situations, but those 50 hours are counted towards the 100 hours per year provided for maintenance and testing. The 50 hours per year for non-emergency situations cannot be used for peak shaving or to generate income for a facility to supply power to an electric grid or otherwise supply non-emergency power as part of a financial arrangement with another entity. For owners and operators of emergency engines, any operation other than emergency operation, maintenance and testing, and operation in non-emergency situations for 50 hours per year, as permitted in this section, is prohibited. VI. Emission Standards: A. The engine referenced herein shall meet all the emissions standards applicable to the engine. B. Compliance with the NSPS Subpart Jill Emissions Standards for Non-Methane Hydrocarbons (NMHC), Nitrogen Oxides (NOx), Carbon Monoxide (CO) and Particulate Matter (PM) shall be demonstrated by filing a copy of the unit's certification documentation of compliance with the NSPS Subpart IIII emissions standards, with the associated application.
