RESOLUTION
RE: APPROVAL OF FINAL PLAT FOR BIRD SUBDIVISION.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Final Plat for Bird Subdivision has been sub-
mitted to the Board of County Commissioners of Weld County,
Colorado for approval in accordance with the Subdivision Regula-
tions of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request and studied the recommendations of the Weld County Plan-
ning Commission, as submitted, and finds that said Final Plat
should be approved provided that the applicant accomplishes the
following prior to recording the Final Plat;
1. Delete the four (4) Development Standards
as now shown on the Final Plat.
2. The applicant shall pay a fee in the amount
of $1, 095. 00 in lieu of land for public
sites and/or open spaces.
3. A $12, 900. 00 bond shall be posted by the
developer for street grading and paving.
4. Sub-surface drainage, water lines and fire
hydrants shall be installed by the developer
before any building permits are issued.
WHEREAS, the Board of County Commissioners finds that the
Final Plat conforms in all major aspects to the Preliminary Plat
as previously reviewed and approved by the Board of County Com-
missioners, and
WHEREAS, the Board of County Commissioners further finds
that the applicant has complied with the Final Plat submission
requirements as set forth in the Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the Final Plat of Bird Sub-
division described in "Exhibit A" attached hereto and incorporated

SUBDIVISION AGREEMENT
THIS AGREEMENT, made and entered into this day of
, by and between the County of Weld, Colorado, acting through its Board
of County Commissioners, hereinafter called "County" , and
Lillian V. Bird , hereinafter called
"Subdivider".
WITNESSETH:
WHEREAS, Subdivider is the owner of or has a controlling interest in -
the following described property in the County of Weld, Colorado:
A parcel of land located in the Southwest Quarter (SW14) of Section 16,
Township 5 North, Range 66 West of the 6th P.M. , Weld County, Colorado,
being more particularly described as follows:
Beginning at the West Quarter Corner (W4 Cor) of said Section 16, and
considering the North line of said SW14 Section 16 as bearing North
89°45'10" East, with all other bearing contained herein relative thereto:
Thence North 89°45'10" East, along said North Line, 1124.03 feet; Thence
South 00°05'30" East, 413.00 feet; Thence South 59°30'10" West, 109.92 feet;

WHEREAS, a final subdivision plat of said property, to be known as
Bird Subdivision
has been submitted to the County for approval ; and
WHEREAS, Section 11-1 of the Weld County Subdivision Regulations pro-
vides that no final plat shall be approved by the Board of County Commissioners
until the Subdivider has submitted a Subdivision Improvement Agreement
guaranteeing the construction of the public improvements shown on plans,
plats and supporting documents of the subdivision, which improvements, along
with a time schedule for completion, are listed in Exhibits "A" and "B" of
this Agreement.
NOW, THEREFORE, IN CONSIDERATION OF the foregoing and of the acceptance
and approval of said final plat, the parties hereto promise, covenant and
agree as follows:

1 . Engineering Services : Subdivider shall furnish, at its own
expense, all engineering services in connection with the design
and construction of the subdivision improvements listed on
Exhibit "A" which is attached hereto and made a part hereof by
this reference.
1 .1 The required engineering services shall be performed
by a Professional Engineer and Land Surveyor registered
in the State of Colorado, and shall conform to the
standards and criteria established by the County for
public improvements.
1 .2 The required engineering services shall consist of,
but not be limited to, surveys , designs, plans and pro-
files, estimates, construction supervision, and the
submission of necessary documents to the County.
1 . 3 Subdivider shall furnish drawings and cost estimates
for roads within the subdivision to the County for ap-
proval prior to the letting of any construction contract.
Before acceptance of the roads within the subdivision by
the County, Subdivider shall furnish one set of repro-
ducible "as-built" drawings and a final statement of con-
struction cost to the County.
2. Rights_of_Wax_and Easements: Before commencing the construction of
any improvements herein agreed upon, Subdivider shall acquire, at its
own expense, good and sufficient rights-of-way and easements on all
lands and facilities traversed by the proposed improvements. All such
rights-of-way and easements used for the construction of roads to be
accepted by the County shall be conveyed to the County and the docu-
ments of conveyance shall be furnished to the County for recording.
3. Construction: Subdivider shall furnish and install , at its own
expense, the subdivision improvements listed on Exhibit "A" which is
attached hereto and made a part hereof by this reference, according
to the construction schedule set out in Exhibit "B" also attached hereto
and made a part hereof by this reference.
3.1 Said construction shall be in strict conformance to the
plans and drawings approved by the County and the speci-
fications adopted by the County for such public improve-
ments. Whenever a subdivision is proposed within three

miles of an incorporated community located in the County
or located in any adjacent county, the Subdivider shall
be required to install improvements in accordance with the
requirements and standards that would exist if the plat
were developed within the corporate limits of that com-
munity. If the incorporated community has not adopted
such requirements and standards at the time the subdivision
is proposed, the requirements and standards of the County
shall be adhered to. If both the incorporated community
and the County have requirements and standards , those re-
quirements and standards that are more restrictive shall
apply.
3.2 Subdivider shall employ, at its own expense, a qualified
testing company previously approved by the County to per-
form all testing of materials or construction that is re-
quired by the County; and shall furnish copies of test re-
sults to the County.
3.3 At all times during said construction , the County shall
have the right to test and inspect or to require testing and
inspection of material and work at Subdivider's expense. Any
material or work not conforming to the approved plans and
specifications shall be removed and replaced to the satis-
faction of the County at Subdivider's expense.
3.4 The Subdivider shall furnish proof that proper arrangements
have been made for the installation of sanitary sewer or
septic systems, water, gas , electric and telephone services.
3.5 Said subdivision improvements shall be completed, according
to the terms of this Agreement, within the construction
schedule appearing in Exhibit "B". The Board of County
Commissioners, at its option, may grant an extension of the
time of completion shown on Exhibit "B" upon application
by the Subdivider.
4. Release of Liability: Subdivider shall indemnify and hold harmless
the County from any and all suits, actions or claims of every nature
and description caused by, arising from, or on account of said con-
struction, and pay any and all judgments rendered against the County
on account of any such suit, action or claim, together with all reasonable

expenses and attorney fees incurred by County in defending such suit,
action or claim. All contractors and other employees engaged in
construction of the improvements shall maintain adequate workman's
compensation insurance and public liability insurance coverage, and
shall operate in strict accordance with laws and regulations of the
State of Colorado governing occupational safety and health.
5. Acceptance of Streets for Maintenance by the County: Upon com-
pliance with the following procedures by the Subdivider, streets with-
in a subdivision may be accepted by the County as a part of the County
road system and will be maintained and repaired by the County.
5.1 If desired by the County, portions of street improvements
may be placed in service when completed according to the
schedule shown on Exhibit "B", but such use and operation
shall not constitute an acceptance of said portions.
5.2 County may, at its option, issue building permits for con-
struction on lots for which street improvements detailed
herein have been started but not completed as shown on
Exhibit "B",and may continue to issue building permits so
long as the progress of work on the subdivision improvements
throughout the development is satisfactory to the County;
and all terms of this Agreement have been faithfully kept
by Subdivider.
5.3 Acceptance for Partial Maintenance: Upon the completion of
the construction of streets within a subdivision according
to Weld County Specifications , the Subdivider shall request
in writing that the County Engineer inspect said streets and
accept them for partial maintenance by the County. Partial
maintenance consists of all maintenance except for actual
repair of streets, curbs and gutters and related street
improvements. The County Engineer shall accept streets for
partial maintenance for a period of one year. Nine months
after initial acceptance, the County Engineer shall inspect
the subject streets, and notify the Subdivider of any defi-
ciencies. The County Engineer shall reinspect the streets
after notification from the Subdivider that any deficiencies
have been corrected. If the County Engineer finds that the
streets are constructed according to County standards , he
shall recommend the acceptance of the streets for full main-

tenance to the Board of County Commissioners .
5.4 Acceptance of Streets for Full Maintenance: Upon receipt of
a recommendation from the County Engineer for acceptance of
streets within the subdivision, the Board of County Commis-
sioners shall accept such streets as public facilities and
County property, and shall be responsible for the full main-
tenance of such streets including repair.
6. Improvements Guarantee: Subdivider shall furnish to the Board of
County Commissioners as guarantee of compliance with this Agreement,
collateral such as, but not limited to, performance or property bonds,
private or public escrow agreements , liens on property, deposit of
certified funds or other similar surety agreements acceptable to the
Board of County Commissioners. The amount of any of the above guarantees
shall be set by the Board of County Commissioners and portions of the
guarantee may be released upon completion of various portions of the
improvements. All or any portion of the guarantee will be released upon
completion of the guaranteed improvements according to County standards
and the terms of the subdivision plans and plats and, in the case of
the streets, upon acceptance of the streets by the County for full
maintenance as a part of the County road system.
7. Public Sites and Open Spaces : The Planning Commission and the Board
of County Commissioners , upon consideration of vehicular traffic and
facilities and the particular type of development proposed in the
subdivision, may require the dedication, development and/or reservation
of areas or sites of a character, extent and location suitable for pub-
lic use for parks, greenbelts or schools, other than subdivision streets
and utility easements designated, in accordance with one of the following
alternatives, or as specified in the PUD plan, if any:
7. 1 The required acreage as may be determined according to
Section 8-15-B of the Weld County Subdivision Regulations
shall be dedicated to the County or the appropriate school
district, for one of the above purposes. Any area so dedi-
cated shall be approved by the County or school district, and
shall be maintained by the County or school district.
7.2 The required acreage as determined according to Section 8-15-B
of the Weld County Subdivision Regulations may be reserved
through deed restrictions as open area, the maintenance of
which shall be a specific obligation in the deed of each lot

within the subdivison.
7.3 In lieu of land , the Board of County Commissioners may re-
quire a payment to the County in an amount equal to the
market value at the time of final plat submission of the
required acreage as determined according to Section 8-15-B.
Such value shall be determined by a competent land appraiser
chosen jointly by the Board and the Subdivider. The cash
collected shall be deposited in an escrow account to be
expended for parks at a later date.
8. Successors and Assigns : This Agreement shall be binding upon the
heirs, executors , personal representatives , successors and assigns of
the Subdivider, and upon recording by the County, shall be deemed a
covenant running with the land herein described , and shall be binding
upon the successors in ownership of said land.

SUBJECT: DRAINAGE REPORT FOR BIRD SUBDIVISION
PROJECT NO. 78 1 ENG 0241
A drainage study has been prepared for Bird Subdivision, a part of the SW
1/4 Section 16, T5N, R66W of the 6th P.M. . This study included 27 acres of
drainage basin located west of 71st Avenue that crosses the avenue and
flows along the south side of the subdivision. This basin (see®9 on
exhibit number 1) also discharges irigation wastewater, but it is our
understanding that this water is not being used downstream as irrigation
water.
DESIGN CRITERIA
The rational method was used to compute the peak runoff rates for the
design storm. This method is outlined in the Greeley Comprehensive Drainage
Plan. Rainfall intensity duration curves (see exhibit 2) were taken from
the Greeley Drainage Plan for the 25 year storm as recommended by the Weld
County Subdivision Regulations as revised April 17, 1974.
The runoff coefficients for use in the rational equation were:
C Cf
Undeveloped Land 0.20 x 1.1 = 0.22
Low Density Residential 0.30 x 1.1 = 0.33
Note that the coefficients have been increased by a frequency factor (Cf)
of 1 .1 in accordance with the Greeley Manual for a 25 year frequency storm.
Composite C values were calculated for some basins to compensate for
variable runoff characteristics of the basin.
DRAINAGE DESIGN
The runoff from the undeveloped site was calculated to be 13.7 cubic feet
per second (cfs) and the runoff from the developed site has been calculated
to be 16.2 cfs. The slight increase in discharge does not justify a
detention pond for the site. The site will, however, require drainage-ways
to convey the water from west to east. AreaAreaCt as indicated on exhibit
1 , will be drained along the south side of 24th Street in the roadway ditch
to 70th Avenue where it will enter a drainage swale near the south line of 3•
the subdivision.

Most of the subdivision will drain along the back of lots 2, 3, and 4 in an
excavated swale to 70th Avenue. At 70th Avenue the 6.29 cfs discharge will
cross the street in an 18 inch corrugated metal pipe. From the culvert,
the water will flow easterly in the cul-de-sac ditches and then easterly in
a swale between lots 7 and 8. The sections at A-A and B-B on exhibit 3
indicate the depth of flow expected in each of these drainage ways in a 25
year frequency storm.
The Bird Subdivision can be adequately protected from a 25 year frequency
storm with the construction of drainage-ways indicated on the grading plan.
The grading plan also calls for the filling of lots 7 and 8 to raise the
building site above potential flooding.

The following comments are in regard to a request for review of the Final Plat
for Bird Subdivision, to be located in a portion of the SW3 of Section 16, Twp.
5N, Range 66W, Weld County, Colorado.
Our initial review of the preliminary plan indicated a need for surface and
subsurface drainage plans plus an erosion control plan. Only the surface and
subsurface drainage plans were submitted for review with the final plat.
Surface Drainage Plan: The surface drainage plan as submitted is based on hydrology
calculations for a 25 - year frequency storm. The offsite storm discharge (27 acres
southwest of the subdivision) was calculated to produce 9.5 CFS direct runoff. Our
calculations for the same area indicate potential total peak discharge of 40 - 45
CFS based on 25 year/24 hour precipitation information. The only concern for the
difference in amount of discharge is to insure that the channel to be constructed
along 24th Street be of proper capacity. The designed channel as shown by section
A-A on Exhibit No. 3, Drainage Plan, indicates a flow depth of 0.96 feet with 3:1
slopes for 9.6 CFS. Velocity for this channel will be 4.5 feet per second. The
same channel will carry 41 CFS with 3:1 slopes, with a flow depth of 1.69 feet and
a velocity of 4.8 feet per second with the designed slope grade of 2.867.. The only
difference is the increased flow depth and resultant increased width of the channel.
However, the primary concern is the velocity that will be experienced during channel
flow. The maximum velocity a bare earthen channel can withstand without excessive
erosion is 1.5 - 2.0 feet per second. A vegetated channel can withstand velocities
of 5.0 - 7.0 feet per second. Alternative suggestions are: 1) Sod channel immedi-
ately after construction to insure erosion will not occur. 2) Provide a more erosion
resistant channel by lining with rock or concrete. 3) Seeding channel immediately
after construction with properly adapted grass species. This method will not provide
immediate results and the channel will be susceptable to erosion during vegetation
establishment. 4) Reduce the channel grade, increase channel width to reduce velo-
cities to acceptable limits.
The channel section to be constructed from the cul-de-sac to the east property boundary
appears to be adequate as designed with the exception that it should be constructed
with a stone center. The stone center will be necessary to counteract the possibility
of constant flowing water in the channel due to the outletting of the subsurface drain
system. A constantly wetted channel will not allow for proper vegetation establishment
to retard erosion.
Subsurface Drainage Plan: The subsurface drainage design appears to be
adequate. However, where the conduit is encased in a sand and gravel
filter, a minimum of 3 inches in depth filter material should be placed
on the bottom of the trench. The conduit should then be placed on grade
and the trench backfilled with filter material of 3 inch minimum depth.
The outlet should be protected against erosion and undermining of the
conduit, against damaging periods of submergence and against entry of
rodents or other animals into the subsurface drain.
Erosion Control Plan: None submitted for evaluation. All channels to
be constructed should be vegetated with a properly adapted grass species
to retard erosion. All channels as designed do appear to have quite high
velocities, which in many cases exceeds the range of acceptability for
bare earthen channels.

In reference to our discussion of Tuesday, February 20, 1979, this letter shall
address four areas of major contention dealing with Bird Subdivision located at
approximately 2420 71st Avenue.
Tail water ditch. Located on the South side of the property. The present ditch
shows severe signs of water erosion. The present ditch will be changed with the
construction of 24th Street. Due to the continued use of this ditch as a drainage
facility, we will line this ditch with 75% 4" to 5" rock the distance of 24th Street
until the intersection of 70th Avenue in accordance with Page 87 of A Guide For
Erosion Control, USDA soil conservation service.
Drainage Swale. Located between Lots 1 and 2, this swale will be cut and the excess
dirt distributed around the Easterly side of the cul-de-sac off of 70th Avenue.
Immediately following the final grading we will seed the area with 13 lbs./acre of
Lincoln Brome or other strain of Brome, in accordance with Page 164, 165, and 166,
using 13 lbs. per acre as a seeding guideline. This in turn will be covered with
straw as mulch and slit into the soil as per recommendation on Page 165.
Relocated Earth. Located around Easterly portions of the cul-de-sac off 70th Avenue.
This area will be loose packed and seeded upon completion of packing with approximately
6-1/2 lbs. per acre of Lincoln Brome or other suitable grass. No mulch is intended.
Subsurface to surface drainage. Located between Lots 7 and 8, this area will be
constructed in a similar manner as the aforesaid tail water ditch using 75% 4". to 5"
stones in compliance with Page 87 from the point of discharge of subsurface to the
farthest Easterly lot line.

4. Mulch Anchoring Tool - A tractor drawn implement especially designed
to punch and anchor mulch into the surface soil . This practice
I affords maximum erosion control , but its use is limited to those
slopes upon which the tractor can operate safely. Tool penetration
should be about 2-3 inches. ,
5. Pick Chain - This rolling spiked-chain implement can be operated
on slopes of 3:1 gradient or steeper. It is attached to a tractor
or truck which operates along the top of the slope. The pick
chain can also be used for seedbed preparation and mixing
fertilizer with soil .
6. Emulsified Asphalt applied as mulch material is blown from the
applicator or as a separate operation, provides excellent mulch
anchorage. Apply uniformly 0.04 gallons per square yard of rapid
curing (R.S. -1 or R.S.-2) , medium curing (M.S.-2) or slow setting
(S.S.-1 ) depending on desired curing time. See the manufacturer's
' specifications. Emulsified asphalt should not be used in freezing
weather since it contains approximately 50% water. Liquid asphalt
may be used in freezing weather.
V. Maintenance ,
Maintenance is a vital factor in maintaining an adequate vegetative erosion
control cover.
A. Irrigation - If soil moisture is deficient, supply new seedings with
adequate water if available (a minimum of 3-4" penetration) for
plant growth until they are firmly established. This is especially
true when seedings are made late in the planting season, in abnormally
dry or hot seasons, or on droughty sites.
B. Repairs - Inspect all seeded areas for failures and make necessary
repairs, replacements, and reseedings within the planting season,
if possible.
