BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
DECEMBER 21F 2016
The Board of county Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, December, 21 2016, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:

MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County
Commissioners meeting of December 19, 2016, as printed. Commissioner Kirkmeyer seconded the
motion, and it carried unanimously.
a CERTIFICATION OF HEARINGS: Commissioner Kirkmeyer moved to approve the Certification of
Hearings conducted on December 19, 2016, as follows: 1) Show Cause Hearing, PCSC16-0004,
16-0004,
(MUSR14-0030, and USR-1704) — Heartland Biogas, LLC. Commissioner Moreno seconded the motion,
which carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
la CONSENT AGENDA: Commissioner Iirkme er moved to approve the Consent Agenda as printed.

PUBLIC INPUT: No public input was given.
COMMISSIONER COORDINATOR REPORTS: Commissioner Moreno attended the Legislative
Breakfast. CommissionerKirkmeyerthankedeveryonehohelpedwith moving and setting up the Chase
Building. She also thanked Commissioner Freeman for allowing her and Commissioner Moreno to attend
the County Council meeting on his behalf,

1) PRESENT BID #B1600188, DATA DOMAIN - DEPARTMENT OF PUBLIC SAFETY
INFORMATION TECHNOLOGY: Jack Statler, Public Safety Information Technology, presented the three
(3) bids received and stated staff will bring back a recommendation on January 4, 2017.
NEW BUSINESS:
La CONSIDER CERTIFICATION OF TAX LEVIES AND REVENUE FOR 2017 AND AUTHORIZE
CHAIR TO SIGN: Christopher Woodruff, Weld County Assessor, reviewed the details of the report to
certify and approve levies and revenues, which will allow staff to carry them forward to the calculations
for the 2017 budget. Commissioner Kirkmeyer moved to approve certification of tax levies and revenues
and authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried unanimously.
a 2) CONSIDER CONTRACT ID #938 REGIONAL COMMUNICATIONS USER AGREEMENT AND
AUTHORIZE CHAIR TO SIGN — TOWN OF MEAD: Mike Wallace, Director of Public Safety
Communications, reviewed the agreement with the Town of Mead. Commissioner Kirkmeyer moved to
approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner
Moreno, and it carried unanimously.
L:ecil CONSIDER CHANGE ORDER #2 FOR DOWNTOWN PARKING LOT (BID #B1600149) AND
AUTHORIZE CHAIR TO SIGN — DCP CIVIL, LLC: Toby Taylor, Director of Buildings and Grounds, stated
this change order allowed DCP Civil, LLC, to use a machine to thaw the ground so the parking lot project
can continue, Commissioner Moreno moved to approve said Change Order *2 and authorize the Chair
to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously.
lz`1 CONSIDER CONDEMNATION REQUEST CR 74 AND HIGHWAY 392 REALIGNMENT
PROJECT — RODNEY WILSON: Frank Haug, Assistant County Attorney, presented the reasons for the
request of the County Attorney to proceed with a condemnation hearing. This is part of the realignment
project of State Highway 31. Rodney Wilson resident of Eaton, stated he is trying to work with the

County and reported receiving the CDOT appraisal. He stated he was also frustrated with the second
appraisal because the amount was unfair for how much it will impact him. Commissioner Kirkmeyer
explained to Mr. Wilson about the appraisal he had received. He explained he would like to be reimbursed
for fencing he would like to put around his property. Commissioner Kirkmeyer clarified the highest offer
was for $34,385.00, which included $500O.00 for the surveying, the incentive and the price per acre. She
requested Mr. Wilson clarify what he is asking of the County. In response to Commissioner Kirkmeyer,
Mr. Wilson stated he won't be able to farm the parcel because there is a road running through the middle
and would like to have additional funds to install fencing on both sides of the roadway at a later time.
krTh Tiffane Johnson, Department of Public Works, discussed the amount of fence needed and the price
and explained it is about $3.00 or $4.00 per foot. Ms. Johnson clarified the terms of the fencing before
and after the project and explained the value is determined by finding a comparable property.
Commissioner Kirkmeyer explained to Mr. Wilson she understands his frustration and clarified with Mr.
Wilson that he would like to receive the funds for the fence instead of the County installing the fence for
him. Commissioner Kirkmeyer explained to Mr. Wilson the County offered him $34385.00 which includes
$4,500 for CRP damages, $5,000 for miscellaneous costs, and she stated she is willing to include $4.00

r foot for the fence. Bruce Barker, County Attorney, stated that all the items of the contract need
to be detailed in the Resolution. Commissioner Kirkmeyer moved to approve the contract for
compensation of the property to include $4500.00 for damages, $50O0.0O for miscellaneous costs,
compensation for right-of-way of 16 acres for the amount of $15,250.00, $1,200.00 for a temporary
easement, $500 for permanent easement, 30% incentive for the amount of $7935.00, and $24,000,00
for permanent fencing ($4.00 per foot for 6,000 feet), for a total compensation of $58,885.00. Seconded

by Commissioner Moreno, it carried unanimously. Additionally, Mr. Wilson explained someone is puffing
ropes across County Roads 61 and 74 at night to move cattle. Commissioner Kirkmeyer stated she will
notify staff to investigate the matter. (Clerk's Note: restated agreement was subsequently approved via
Consent Agenda 1/3012017.)
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
