RESOLUTION
RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 54 - ROY MARTIN.
} WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home

i Rule Charter, is vested with the authority of administering the

WHEREAS, the Board of County Commissioners of Weld County,

ne exemption from the definition of "subdivision" and "subdivided

`) land" in Section 30-28-101 (10) , CRS 1973, as amended, and

c.: WHEREAS, the Board of County Commissioners finds that
—' Roy Martin is the owner of a parcel of land lying in the
Northwest Quarter of Section 32, Township 6 North, Range 65
West of the 6th P.M. Mr. Martin desires to gain approval to
combine two parcels into one legal lot. Parcel A and B are
more fully set forth below:
PARCEL A
Part of the NWa of Section 32, Township 6 North, Range
65 West of the 6th P.M. , Weld County, Colorado, Beginning
S00°15' West 1501.17 feet from the NW corner of S89°58'
East 288.47 feet, S03°12' 91.88 feet, N 86°02' West
111.56 feet, N 39°28' West 23.87 feet, N00°47' East 30.78
feet, N 89°58' West 157.45 feet N 00°15' East 34.89 Feet to
the true point of beginning .382 acres more or less.
PARCEL B
A parcel of land lying in the Northwest Quarter
(NW4) of Section Thirty-two ( 32) , Township Six
(6) North, Range Sixty-five (65) West of the 6th
P.M. , Weld County, Colorado, being more particularly
described as follows: Beginning at the Northwest
Corner (NW Cor) of said Section 32 , and considering
the West line of the Northwest Quarter (NWa) of said
Section 32 as bearing South 00°15 ' 40" West, with all
other bearings contained herein being relative thereto;
thence South 00°15' 40" West along the West line of the
Northwest Quarter of said Section 32 , 1501. 17 feet;
thence South 89°58 ' 20" East, 288. 47 feet to the True
Point of Beginning; thence South 03°12 ' 30" West, 91. 88
feet; thence South 86°02 ' 26" East, 325. 81 feet, thence
North 21°11 ' 24" East, 97. 04 feet; thence North 86°10' 20"
West, 355. 77 feet to the True Point of beginning.
WHEREAS, the Board of County Commissioners finds that the
intent of the applicant is to combine Parcels A and B into
one legal lot, and does not conflict with the intent of the Weld
County Comprehensive Plan, and will not have an adverse impact
on the existing use of the land, and
WHEREAS, the Board of County Commissioners has considered

the recommendations of the Department of of Planning Services on
this matter and has reviewed information submitted by the
applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the aforementioned
Parcels A and B owned by the applicant, be, and hereby are,
declared to be exempt from the definition of "subdivision" and
"subdivided land" as set forth in Section 30-28-101 (10) , CRS 1973,
as amended, and in Section 2-1 of the Weld County Subdivision
Regulations, and further finds that said Parcels A and B shall
be considered a single lot.
BE IT FURTHER RESOLVED by the Board that the remaining
tract of land owned by the applicant, Roy Martin, be, and hereby
is , declared to be exempt from the definition of "subdivision"
and "subdivided land" as set forth in Section 30-28-101 (10) ,
CRS 1973, as amended, and in Section 2-1 of the Weld County
Subdivision Regulations, and further finds that said parcel is
also considered as a single lot.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
January, A.D. , 1978 .

regulations adopted September 1972 which defines the term
subdivision :

Comments :
Parcel A, as described on the attached documents, is a . 382
acre parcel owned by Mr. Roy Martin. On November 17, 1977,
Mr. Richard Prouty transferred Parcel B, as described on the
attached documents, to Mr. Martin. This transaction was in
violation of the Weld County Subdivision Regulations . To
rectify the situation , Mr. Martin is requesting approval of
a Subdivision Exemption to combine Parcel A & B into one
legal lot .
