HomeMy WebLinkAbout20163539.tiffRESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH16-0037 - HORTON ASSOCIATES, LLC, C/O LISA BLACK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of November, 2016, at the hour of 9:00 a.m., in the Chambers of the Board for the purpose of hearing the application of Horton Associates, LLC, do Lisa Black, 13678 CR 4, Brighton, CO 80603, for a Zoning Permit, ZPMH16-0037, for a recreational vehicle to be used for a temporary use during a medical hardship, located in the A (Agricultural) Zone District on the following described real estate, to -wit: Lot A of Recorded Exemption, RECX14-0113; being located in the N1/2 NE1/4 of Section 32, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing the Board deemed it advisable to continue the matter to November 16, 2016, to allow additional time to provide notification to the surrounding property owners, and WHEREAS, on November 16, 2016, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 23-4-130 of the Weld County Code. 2. It is the opinion of the Board that the applicant has shown compliance with Section 23-4-200.A of the Weld County Code as follows: A.1 -- Compatibility with surrounding area, harmony with the character of the NEIGHBORHOOD and its effects upon the immediate area. A.2 -- Compatibility with Chapter 22 of the Weld County Code. A.3 -- Availability of adequate water and sewage disposal facilities. A.4 -- The general health, safety and welfare of the inhabitants of the area and the COUNTY. CG: PL Orin//w=) CLPPL /PPL (P ca/Is/tco 2016-3539 PL2017 ZPMH16-0037 - HORTON ASSOCIATES, LLC, C/O LISA BLACK PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Horton Associates, LLC, do Lisa Black, for permission to place a recreational vehicle to be used for a temporary use during a medical hardship on the above described parcel of land, which was found to be in compliance with Chapter 23, Article IV, Division 3, of the Weld County Code, be, and hereby is, granted subject to the following conditions: 1. The recreational vehicle must maintain current license plates at all times. 2. A medical hardship exists in which the person to be living in the recreational vehicle requires the supervision and care of those persons residing in the principal dwelling unit on the property (or the reverse). Documentation of the medical hardship shall be established in a letter from the subject's medical doctor or other evidence deemed suitable by the Department of Planning Services. The letter shall be submitted as a part of the zoning permit application and shall verify that the subject is physically impaired and requires full-time care. 3. There is no reasonable alternative available to the applicant for the care of a person who needs medical supervision. 4. Zoning Permit, ZPMH16-0037, for a recreational vehicle to be used during a medical hardship are temporary and shall be vacated on or before January 31, 2017. Such permits shall be subject to review and extended only per the direction of the Board of County Commissioners. Any permit for a medical hardship USE shall automatically expire, and the recreational vehicle shall not longer be utilized for living quarters upon cessation of the medical hardship or at any such time as the recreational vehicle is used for other than the permitted use. 5. The recreational vehicle shall not be occupied by any persons other than those permitted through the medical hardship permit. Failure to comply will result in revocation to the permit. 6. The applicant shall submit a statement of an exit plan acknowledging that the temporary permit shall cease to exist at any such time the recreational vehicle is used for other than the permitted use. Such statement shall include a detailed plan for removal of the recreational vehicle upon expiration of the permit, or at such time the permit is not renewed by either the Department of Planning Services or Board of County Commissioners. 7. All temporary permits for recreational vehicles shall not be transferable by the applicant and/or owner to any successor; the zoning permit shall terminate automatically upon conveyance or lease of the property. 8. The property is in violation of Chapter 23 of the Weld County Code (Violation #ZCV16-00059). All vehicles located on the property must be operational with current license plates, or be screened from all adjacent properties and public rights -of -way, or be removed from the property. All other items considered to be part of a noncommercial junkyard must also be removed from the property or screened from adjacent properties and public rights -of -way. 10. All proposed or existing structures will meet the minimum setback and offset requirements for the zone district in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure as defined and limited to those occupancies listed as Groups A, B, E, F, H, I, M and R in Section 302.1 of the 2012 International Building Code, shall be constructed within a 200 -foot radius of any tank battery or within a 150 -foot radius of any wellhead or within a 25 -foot radius of any plugged or abandoned oil and gas well. Any construction within a 200 -foot radius of any tank battery or 150 -foot radius of any wellhead shall require a variance from the terms of Chapter 23 in accordance with Subsection 23-6-10.C of the Weld County Code. 11. Any future structures or uses on the site must obtain the appropriate zoning and building permits. 12. Effective April 25, 2011, Building Permits issued on the proposed lot will be required to adhere to the fee structure of the County -Wide Road Impact Fee Program. 13. Effective April 25, 2011, Building Permits issued on the proposed lot will be required to adhere to the fee structure of the County Facility Fee and Drainage Impact Fee Programs. 14. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant to Chapter 15, Article I and II, of the Weld County Code. 15. When demolishing or removing an existing structure, specifically a mobile/modular home, please contact the Weld County Treasurer's office at 970-353-3845, to ensure that the taxes have been paid and that this structure is removed from the tax roll. 16. The submitted materials are not compliance with the application requirements of Section 23-4-130 of the Weld County Code. A. RECREATIONAL VEHICLE: A transportation STRUCTURE or self-propelled vehicle with or without flexible, removable or collapsible walls and partitions designed to be used as a dwelling for travel, recreation or vacation USES. The term RECREATIONAL VEHICLE shall include: motor home, camper bus and travel trailer, but shall not include pickup trucks with camper shells that do not extend above the cab of the truck. For the purpose of this Code, a RECREATIONAL VEHICLE shall be subject to all requirements and restrictions for RECREATIONAL VEHCILES as provided in this Chapter when its placement is intended for nontransient residency. A RECREATIONAL VEHICLE shall not be used for TEMPORARY Storage, TEMPORARY ACCESSORY Farm USE, TEMPORARY ACCESSORY USE During a Medical Hardship, TEMPORARY ACCESSORY USE as an OFFICE, or as a Principal DWELLING UNIT. The use of a recreational vehicle used for the use of a temporary medical hardship is not a use allowed by the Weld County Code. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. Should the Board of County Commissioners approve this request for temporary use, the Department of Planning Services' staff recommend the following as conditions of approval: 1. The recreational vehicle must maintain current license plates at all times. 2. Pursuant to Chapter 15, Articles 1 and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All other vegetation, other than grasses, need to be maintained at a maximum height of 12 inches until the area is completely developed. 15. When demolishing or removing an existing structure, specifically a mobile/modular home, please contact the Weld County Treasurer's office at 970-353-3845, to ensure that the taxes have been paid and that this structure is removed from the tax roll. 16. My vote is to deny the permit and remove the 5th wheel from the lawn. Most people living in the area of the mentioned property have lived there for a long time if not there entire life. They enjoy and care about their neighborhood. It is a farming community that is proud of their way of life, taking pride in how their property looks and functions. Letting their property get trashy and cluttered with debris and inoperative cars and trucks only degrades the value of the entire neighborhood. We own the adjacent farm land and believe this situation will detract and de value the area. As mentioned in the Weld co. Zoning Violation meaning, Miscellaneous junk, trash, storage of commercial vehicles in a residential area is not permitted. The mentioned property has all of the mentioned violations. Now they have parked a 5th wheel trailer in the middle of the lawn and lifted the lid to the septic tank and ran the black water hose into the septic tank, leaving the septic tank open, causing odors that will attract wildlife such as skunks, muskrats, miscotoes, mice, rats, bugs and flies. The 5th wheel has also hooked into the household well water supply designed for one household. When the weather gets colder the water and black water will freeze causing additional trouble. I can't believe that Tri County Health would accept an open sewer. I regards to this specific home 13678 Weld Co. rd 4. My wife grew up in this house and we inherited it after the parents passed on. I have performed many many maintenance items over the years and am extremely familiar with the house, we sold the house to Mr. Horton 2 years ago. The wiring uses the old glass fuses, 4 for the entire house. Each fuse feeds several plugs, tapping into one of these plugs to run the electrical needs of the proposed 5th wheel will undoubtedly will overload the fuse. Unless a larger fuse is installed that would make the wiring the weak link in the wiring, meaning an increased chance of fire. I understand the parties want to claim a medical reason, I would hope Wend Co. would require a Dr. diagnosis backing up their claim. I was told the sister just went thru a divorce and needed a place to hang out for a while. Reasons to reject 1 tapping into the septic clean out leaving it open to all kinds of problems and unhealthy situations. 2 Only one septic system per household.
