Two copies of the application are on file with the DRMS . The following additions and revisions are included : 1 . Revised Exhibits C1 and C1 — These have no changes from the previous drawings submitted except that they are now AutoCAD documents . 2 . Revised Exhibit F - This map was also transferred to AutoCAD . It contains the revisions of the slope and topsoil replacement depth as requested . 3 . He also owns a private gravel road leading to a tank battery. EOG owns a cattle guard at the entrance to a tank battery. The cattle guard is within 200 feet of the permit boundary. Weld County owns CR 136 . 5 and a cattle guard adjacent to the permit boundary. Weld County will ensure repairs of any damages to either the cattle guard or County Road 136. 5 . The Oneok Bakken Pipeline is within 200 feet of the permit boundary. In addition , the proposed haul road will cross over four gas pipeline easements, one of which is owned by Kinder Morgan and three owned by Tallgrass Energy Partners . Agreements have been sent via certified mail to each structure owner. Proof of mailing and any agreements received are attached . In addition , an Engineering Evaluation of the area is attached in order to provide further details regarding the measures Weld County will be taking in order to protect all structures within 200 feet of the permit area . Box 37 Hereford , CO 80732 RE : Agreement for Compensation for Damage to Structures within 200 feet of Mining Activities at the Peters 313 Pit Dear Mr. Peters : Weld County is currently applying for a permit from the State of Colorado , i Division of Reclamation , Mining , and Safety ( DRMS ) to mine in the south half of the southwest corner of Section 26 , Township 12 North Range 63 West of the 6th P . M . , in Weld County, Colorado . The DRMS application requires the submittal of an agreement between the mine permit applicant and the owners of any structures located within 200 feet of the proposed area to be mined , in which the mine permit applicant agrees to provide compensation to the structure owners if mining activities cause any damage to the structures . A title search of the area to be mined and the properties around that area has revealed that a fence on the west side of the property and a gravel road leading to a tank battery , owned by John L . Peters , are located within 200 feet of the area to be S mined . Mining will be completed so that vertical/high wall conditions will not occur, and the reclamation slopes will be mild ; no steeper than one foot vertical change for every three feet horizontal change . Weld County agrees to provide fair compensation to John L . Peters if, in the course of conducting mining and reclamation activities , the structure(s) are damaged as a direct result of these activities . Box 871 Tulsa , OK 74102 RE : Agreement for Compensation for Damage to Structures within 200 feet of Mining Activities at the Peters 313 Pit Dear Oneok Bakken Pipeline Representative : Weld County is currently applying for a permit from the State of Colorado , Division of Reclamation , Mining , and Safety ( DBMS) to mine in the south half of the southwest corner of Section 26 , Township 12 North Range 63 West of the 6th P . M . , in Weld County, Colorado . The DRMS application requires the submittal of an agreement between the mine permit applicant and the owners of any structures located within 200 feet of the proposed area to be mined , in which the mine permit applicant agrees to provide compensation to the structure owners if mining activities cause any damage to the structures . A title search of the area to be mined and the properties around that area has revealed that a buried pipeline , owned by Oneok Bakken Pipeline , L . L . C . , is located within 200 feet of the area to be mined . An analysis performed by the Weld County Engineering Department shows that mining operations will come within approximately 25 feet of this structure . {00075940 - 1 }Page 1 of 4 /6 /J9/ Structure compensation agreement . 4 Weld County will be taking precautions in order to insure that all mining activities remain within the permitted area . The permit boundary will be staked in order to allow the free movement of the land owner' s cattle when mining is not occurring , and mining will come no closer than 25 feet from the permit boundary . A setback of approximately 25 feet from any pipeline easements will be maintained . A berm will be constructed along the eastern edge of the Oneok Bakken Pipeline easement along the proposed haul road route leading from County Road 136 . 5 to the area to be mined . Mining will be completed so that vertical/high wall conditions will not occur , and the reclamation slopes will be mild ; no steeper than one foot vertical change for every three feet horizontal change . In addition , no blasting will occur at this site . Weld County would like to request your authorization to conduct mining and reclamation activities within 200 feet of the structure specified in this document. Weld County agrees to provide fair compensation to Oneok Bakken Pipeline , L . L . M . , in Weld County , Colorado . The DRMS application requires the submittal of an agreement between the mine permit applicant and the owners of any structures located within 200 feet of the proposed area to be mined , in which the mine permit applicant agrees to provide compensation to the structure owners if mining activities cause any damage to the structures . A title search of the area to be mined and the properties around that area has revealed that three buried pipelines , owned by subsidiaries or affiliates of Tallgrass Development , LP , are located within 200 feet of the mine permit area . An analysis performed by the Weld County Engineering Department shows that our proposed haul road will cross these pipelines , but mining operations will not occur within 200 feet . Mining will come no closer than 25 feet from the permit boundary . Enclosed is a proposed design for the haul road that shows no excavation occurring directly above your pipelines . Weld County would like to request your authorization to conduct mining and reclamation activities within 200 feet of the structures specified in this document . Weld County agrees to ( i ) call in pipeline locates through the Colorado 811 service prior to construction of proposed haul road , ( ii) provide fair compensation to Taligrass Development , LP if, in the course of conducting mining and reclamation activities , any of these structures are damaged as a direct result of these activities .
