Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: 10 Lot PUD This project is west of and adjacent to CR 72 and is north of CR 19. Parcel number 080704402005 Drainage Requirements: Please contact Department of Planning Services/Engineering Development Review for questions or assistance for drainage requirements at 970-353-6100. URBANIZING VS NON -URBANIZING DRAINAGE AREA: This area IS mostly within an Urbanizing Drainage Area: Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas. Detention Pond summarized in a Drainage Report: A preliminary drainage report and detention pond design was submitted and is acceptable. A final report will be required. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692- 3575. Geologic Hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a FEMA regulatory floodplain. CONDITIONS OF APPROVAL: A. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required. (Department of Planning Services -Engineer) B. The plan shall be amended to delineate the following: 1. The applicant shall show and label the accepted drainage features and drainage flow arrows. Water quality features or stormwater ponds should be labeled as "Water Quality Feature/Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume. (Department of Planning Services -Engineer) Prior to Construction: A. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required. (Department of Planning Services -Engineer) WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT 1555 North 17th Avenue, Greeley, CO 80631 www.weldhealth.org Memorandum To: Diana Aungst From: Lauren Light, Environmental Health Services Date: May 10, 2016 Re: PUDZ16-0001 Gander Valley Farms, LTD Environmental Health Services has reviewed this Planned Unit Development Change of Zone Request to Rezone Lot 5 Gander Valley PUD from Planned Unit Development with Agricultural Zone District Uses (PUD-A) to Planned Unit Development with Estate Zone District Uses (PUD-E). The applicant is proposing a 10 lot PUD on 40.46 acres. Septic systems will provide sewer for the lots and the minimum lot size of 3.2 acres coupled with an overall density of one septic system per 4 acres does meet current Department policy. Individual taps from North Weld County Water District will provide water. The application has satisfied Chapter 27 of the Weld County Code in regard to water service. The Assistant Weld County Attorney has approved the water source of North Weld County Water District. The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service. Sewer will be provided by individual on -site wastewater treatment systems (OWTS). A preliminary subsurface exploration report from Earth Engineering Consultants, LLC, dated September 25, 2015, was submitted with the sketch plan. Soil and percolation testing completed by Earth Engineering Consultants, LLC indicate that the site is suitable for the construction of OWTS. The average percolation rate was below 20 mpi. According to the report, areas of expansive clays and shallow bedrock likely exist on the parcel. A thorough geotechnical investigation should be conducted at each proposed building site to identify if these conditions exist. This Department recommends that language for the preservation and/or protection of the absorption field shall be placed in the development covenants as well as a note on the change of zone plat. The Environmental Impact Plan (section 27-6-30) adequately addresses all environmental impacts. Water service may be obtained from North Weld County Water District 2. The parcel is currently not served by a municipal sanitary sewer system. Sewage disposal may be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Language for the preservation and/or protection of the absorption field shall be placed on the plat. The note shall state; Activity or use on the surface of the ground over any part of the OWTS must be restricted to that which shall allow the system to function as designed and which shall not contribute to compaction of the soil or to structural loading detrimental to the structural integrity or capability of the component to function as designed. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of Weld County Environmental Health Services, a fugitive dust control plan must be submitted. 5. If land development creates more than a 25 -acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice application, and apply for a permit from the Colorado Department of Public Health and Environment. 6. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. The District's comments remain the same with the request for payment of cash -in -lieu fees at $2,240 per lot with the payment to be made to the District prior to final plat by the county.
