WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, held a public hearing on the 8th day of November, 1978 at the hour of 2 :00 o'clock p.m. , for the purpose of hearing the application of Brian Martin, Route 1, Box 71B, Berthoud, Colorado 80513, for the granting of a Special Use Permit for a poultry opera- tion on the following described real estate, to-wit : Located in the North one-half of the North one- half of the Northwest one-quarter of Section 32, Township 4 North, Range 68 West of the 6th P.M. , County of Weld, State of Colorado. Beginning at a point in the extreme Northwest corner of said Northwest one-quarter of Section 32; Thence South along the West line a distance of 662.87 feet; Thence East South 89°57'39" East, a distance of 2640.05 feet; Thence North 00°00'00", 662.45 feet; Thence Vest S89°57'09" East, 2638.42 feet, to the true point of beginning. RECOMMENDATION September 19, 1978 use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agri- cultural uses, compatible with the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the county. This determination is based upon the following : A. The poultry production operation and management practices as outlined and controlled in the Development Standards will make this operation compatible with the surrounding area by minimizing any potential adverse impacts. B. The proposal is for an agri-business in an agriculturally zoned area, with existing land uses being predominantly agricultural. C. The following referral entities have reviewed this request and have set forth no objections to it : 1. Weld County Engineering Department 2. Berthoud Fire Protection District 3. Weld County Health Department provided the applicant addresses the Health Department ' s comments in its letter dated September 7, 1978. The Health Department 's comments are incorporated in the attached Development Standards. 4. Soil Conservation Service D. The Weld County Extension Agent has indicated the space requirements and facilities appear adequate for this operation. He did not observe any problems with the proposed operation. E. The Town of Mead Planning Commission did not have any objections to this request . F. The applicant has submitted a petition form in support of his request for this Special Use Permit which was signed by five of the surrounding property owners within 500 feet of the property under consideration. The Planning Commission recommendation for approval is conditional upon the following: 1. The attached Development Standards being recommended and adopted for the Special Use Permit . 2 . No building or electrical permits shall be issued for the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delievered to the Department of Planning Services office. , Brian Martin SUP DEVELOPMENT STANDARDS 1. The poultry production operation on the hereon described parcel of land shall be limited to the facilities shown which are designed to handle a total of 40, 000 chickens . 2. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust , and the growth of noxious weeds . 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission , and sanitary disposal systems . 4. All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department . 5. There shall be no discharge of wastes into any streams , other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 6 . The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations . Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services . Comments : Our office has received one letter from Mr. Ilaiko F,i_chler, a surrounding property owner, concerning this request . A copy of his letter is in the attached materials. The Weld County Planning Commission held a scheduled meeting on September 19 , 1978, at 1 : 30 p .m. in the Weld County Centennial Center County Commissioners Hearing Room, first floor, 915 10th Street , Greeley , Colorado . This sand is used to fracture oil and gas wells in Weld County. This will be done in conjunction with some existing tanks already on the property. There being no questions at this time , Chuck Cunliffe read the staff ' s recommendation for approval . No further comments at this time. MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners based on the staff ' s recommendation . The feathers will be used for tying flies for fishing world-wide. Chuck Cunliffe then read the staff ' s recommendation for approval and the Development Standards. NW4f Section 30, T5N, R67W LOCATION: 25586 Weld County Road 13 - 22 miles northwest of Johnstown SUBJECT: Hog Operation APPEARANCE : Allen Johnson DISCUSSION: Mr. Johnson desires to raise 700 hogs on 6�` acres of property. The operation will be from birth to finish. These being no questions at this time, Tom Honn read the staff ' s recommendation for approval and the Development Standards . Some discussion followed regarding the waste disposal system. Mr. Otis asked for some clarification regarding fly and odor control as mentioned in the comments from the Weld County Health Department . Steve Stramberger of the Weld County Health Department stated that a possible aeration program could be practiced by the applicant if he so desires. Mr. Johnson , however, stated that the area will be enclosed and a disinfectant will be used to hold down the odor. Flies will be controlled with bait and spraying. This will be acceptable to the • Weld County Health Department as long as it meets their standards for fly and odor control. MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Board of County Commissioners based on the staff ' s recommendation. W SW*, Section 31, T2N, R68W LOCATION : 2 miles northeast of Fort Lupton SUBJECT: Amendment to SUP-348 - Oil Field Fluids Disposal Site APPEARANCE : Stan Rech DISCUSSION: Mr. Rech is requesting the addition of three 400 barrel tanks and one 300 barrel tank and a gel water pit . Mr. Rech briefly explained that the tanks are used for disposal of water that comes from oil wells and is now needing more tanks . The gel is used for fracing the wells. Chuck Cunliffe then read the staff' s recommendation for continuing the application . MOTION: Be it therefore resolved to continue the meeting to October 3 , 1978 , for additional information and a field trip . Motion by Jim Gilbert , seconded by Irma White . SW* SE -, Section 31, T2N, R68W LOCATION : z mile east of Boulder/Weld County line on the north side of Colorado Highway 52 SUBJECT: Change of Zone from "A" Agricultural Zone District to "I" Industrial Zone District APPEARANCE : John Birmingham DISCUSSION: Mr. Birmingham' s request is to locate his solvent blending and chemical business on this 2 . 1 acre parcel which was formerly a sugar beet receiving station . This location was chosen because of its remoteness in the area. There is a slight fire hazard involved and a slight chance of explosion with this business , however, Mr. Birmingham said a sprinkler system will be utilized. There would be three separate buildings - one for a warehouse for storing, one for solvent blending equipment and one for a ship and office building. Tom Honn then read the staff ' s recommendation for denial of the proposal . Mr. Otis asked what the potential danger was for explosion of the chemicals and the hazards involved. Don Marvin , Fire Chief of the Longmong Fire Protection District , said he could not approve of this proposal with only a sprinkler system installed. He recommended that a fire protection system be utilized. Some general discussion followed regarding the fire hazard danger involved with the proposed facility. Carolyn Bulthaup presented a petition to the Planning staff with 37 signatures of people in opposition to the request . She also commented that there is a fire hazard involved with trains that throw sparks. There are oil wells in the area that vent natural gas which could be ignited from the sparks . Shirley Koch expressed the same concern . Don Marvin also stated this was a real problem. Mr. Birmingham stated he would be supportive of the recommendation by Mr. Marvin for a fire protection system. MOTION: Be it therefore resolved to continue the hearing to October 3, 1978, for further study. Motion by Fred Otis , seconded by Jim Gilbert . Planning Commission mutes Page 4 September 19 , 1978 VIOLATOR : Edwin and Mary Klein CASE NUMBER: VI-89 : 78 : 13 LEGAL DESCRIPTION: Lot 28, Westridge 4th Filing LOCATION: 2675 65th Avenue SUBJECT: Junkyard in Estate Zone District DISCUSSION : Cathy Carter, Zoning Violation Inspector, stated that she had checked the property the evening of September 18 , 1978 , and found that the last car body had been removed from the property , so the violation no longer exists . She commented that she had discussed with the neighbors the possibility of considering putting the covenants into effect by the Architectural Control Committee to regulate some of the offensive activity that continues to occur on this parcel of land. This could eliminate a lot of problems in the future. Discussion followed regarding the exact meaning of "junkyards" and the procedure for recommending that legal action be forwarded to the County Commissioners . Mr. Jim Gilbert then recommended that the staff ask the County Attorney to write an appropriate letter to the Architectural Control Committee that they enforce their covenants to alleviate any problems in the future . A packet of pictures was also distributed among the members showing the violation on the property in question . Co. 80631 Dear Mr. Cunliffe: In response to your notification of Brian Martin for a Special Use Permit for Poultry Production , I would like to express myself as follows: While I personally have nothing against the Martin Family raising Poultry on their property, I would like to point out that the poultry they plan on raising and have been raising for the past several years, is not for the purpose of meat production but for the chicken necks alone to be sold to fishing tackle manufacturers. While there also is nothing wrong with that, however, it creates an enormous amount of unwanted carcasses. Some of those they have been able to sell to private individuals, but a substantial number has ended up in their open air dump along with portions of carcasses and hides of other animals slaughtered by the Martins. This creates a bad odor and attracts rodents and dogs. My suggestion relative to the Special Use Permit is, that the Martins should be required to dispose of such carcasses and refuse in a sanitary fashion by burning, if permissible by law, having a rendering company pick up such carcasses"or by burying. We have been breeding these chickens and experimenting for the past six years and have now begun to expand and raise enough for the market all over the world that we have built. We have a laying flock and hatch our own eggs. The cape is pro- cessed here and we will ship them weekly. We own 40 acres that had not been tilled previously for 15 years. Manure will be disced and/or plowed under. Frequency will be dependent upon location taken from. Small pens of mostly sawdust are cleaned approximately once each month. Larger pens of dry litter are cleaned each six months. All pens which include the above pens are dry and have absolutey no flies. The two brooders for chicks are cleaned almost every day. The caged chickens will be cleaned once each year. The man- ure from this method is dried below the cages with fans and hardens to the point that it is not attractive to flies. In addition this building has no windows so that all light is artificial. This lighting is at the top of the second floor. The floor consists of joists to hold pyramid cages. The first floor is eight feet in height to allow manure removal by trac- tor. As an end result, not much light reaches the manure. Flies require more light than is available to move about. Rodent Control. The main method of rodent control will be poison bait. In addition the barns are structured with a minimum of obstacles and places for rodents to hide and breed. The two primary soils found on this site are Aquolls & Aquepts flooded (34U) and Thedalund Loam on 3-9% slope (43-CD) . As the first soil is subject to flooding, I assume the construction of the poultry housing will be on the Thedalund Loam. This soil is moderately deep over sandstone or shale bedrock at depths of 20 to 40 inches . Construction of buildings have moderate limitation because of low strength of the soil; but septic tank and lagoon have severe limitation because of depth to bedrock. Moderate or severe rating is not intended to pre- clude the use of a soil or site for a particular purpose. These ratings are intended to emphasize that these are hazards and limita- tions to be considered , and that alternatives in design are needed to overcome the hazard or limitation. A soil engineering test should be obtained for lagoon and septic tank design on this soil. These comments are made in reference to the general soil descrip- tion for the legally described area above. This report does not preclude the need for on-site investigation of the soils for the land use proposed. Actual soil site condition may vary from those described.
