HomeMy WebLinkAbout20161591.tiff RESOLUTION RE: APPROVE THREE (3) AGREEMENTS FOR COMPENSATION FOR DAMAGE TO STRUCTURES WITHIN 200 FEET OF MINING ACTIVITIES (PETERS 313 GRAVEL PIT) AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with three (3) Agreements for Compensation for Damage to Structures Within 200 Feet of Mining Activities (Peters 313 Gravel Pit) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the three (3) parties listed below, commencing upon the full execution of signatures, with further terms and conditions being as stated in said agreements for the property described as part of the S1/2 SW1/4 of Section 26, Township 12 North, Range 63 West of the 6th P.M., Weld County, Colorado, and 1. Colorado Interstate Gas Company, LLC 2. Tallgrass Energy Partners 3. Oneok Bakken Pipeline, LLC WHEREAS, after review, the Board deems it advisable to approve said agreements, copies of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the three (3) Agreements for Compensation for Damage to Structures within 200 Feet of Mining Activities (Peters 313 Gravel Pit) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the three (3) parties listed above be, and hereby are, approved. Agreement with: • Colorado Interstate Gas Company, LLC • Tallgrass Energy Partners • Oneok Bakken Pipeline, LLC M:\Francie\AGENDA memos\Agenda-ValerieMino.doc 2016-1591 BOARD OF COUNTY COMMISSIONERS PASS-AROUND REVIEW/WORK SESSION REQUEST RE: Structures Agreements Required for the Peters 313 Sand and Gravel Pit Division of Reclamation,Mining and Safety Permit DEPARTMENT: Public Works DATE: 4/27/16 PERSON REQUESTING: Valerie Mino Brief description of the problem/issue: The attached agreements are Structures Agreements required by the Division of Reclamation,Mining,and Safety as part of the mining permit process for the proposed Peters 313 Pit. The Agreement states that Weld County shall be responsible for any damages that occur, as a result of mining activities,to any permanent structures within 200 feet of the affected land. In order to protect these structures from damage,the County will stake the mining boundary and will offset a minimum of 25 feet from that boundary. Additionally, a minimum setback of 25 feet will be maintained from the edge of all pipeline easements. A berm(strip of raised ground) will be constructed parallel to the eastern edge of the Oneok Bakken Pipeline easement between the pipeline and the proposed haul road route leading from County Road 136.5 to the area to be mined. This will create a barrier between the haul road and the Oneok Bakken pipeline so mining vehicles do not accidentally drive on the pipeline. Mining will be completed so that vertical/high wall conditions will not occur, and the reclamation slopes will be no steeper than one foot vertical change for every three feet horizontal change. In addition,no blasting will occur at this site. Colorado Interstate Gas Company, L.L.C., Tallgrass Energy Partners, and Oneok Bakken Pipeline, L.L.C. have each, separately, agreed to enter into this agreement with Weld County. A total of five buried pipelines will be covered under these agreements. What options exist for the Board? (Include consequences, impacts, costs, etc. of options) These agreements are required by the Colorado Division of Reclamation, Mining, and Safety in order to receive a permit for a new sand and gravel mine. The County also enters into these agreements with the operators of new pits when those pits are within 200 feet of our roads. The County has already entered into one of these agreements with the landowner,John Peters, for the fences that exist within the vicinity of the permit area. Recommendation: The pipeline companies have already signed the agreements. Approval from the Board of County Commissioners is recommended. The DRMS application requires the submittal of an agreement between the mine permit applicant and the owners of any structures located within 200 feet of the proposed area to be mined, in which the mine permit applicant agrees to provide compensation to the structure owners if mining activities cause any damage to the structures. A title search of the area to be mined and the properties around that area has revealed that three buried pipelines, owned by subsidiaries or affiliates of Tallgrass Development, LP, are located within 200 feet of the mine permit area. An analysis performed by the Weld County Engineering Department shows that our proposed haul road will cross these pipelines, but mining operations will not occur within 200 feet.
