SUBMITTAL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Application for the Domestic Violence
Fast Track Program and Domestic Violence Felony Project Grant from the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
19th Judicial District Attorney's Office, to the Colorado Division of Criminal Justice, commencing
upon full execution, with terms and conditions being as stated in said application, and
WHEREAS,after review,the Board deems it advisable to approve said application, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado,that the Application for the Domestic Violence Fast Track Program and Domestic
Violence Felony Project Grant from the County of Weld, State of Colorado, by and through the

The 19th Judicial District Attorney's Office is a government agency statutorily
mandated to prosecute those charged with committing crimes against the State
of Colorado. The Victim Witness Assistance Unit, established in 1980, is a
department in the District Attorney's Office. Twelve staff work in the unit
providing assistance to victims of defendants charged with felonies,
misdemeanors, and traffic cases. The number of criminal cases filed in 2015
were 14,879: 2321 felony, 755 juvenile, 3618 misdemeanor, and 8090 traffic.
The unit supports all victims of crime. VRA victims represent 35% of felony
crimes (207 primary DV victims), 28% of juvenile crimes, 40% of misdemeanor
crimes (877 primary DV victims). Since there are only a couple of traffic crimes
that are designated as VRA the percent of VRA traffic crimes was .01% (13
victims).

The VW Director of the 19th Judicial District has written federal grants (VAWA
and VOCA) since 1997 and has written VAWA and VOCA grants in the 19th
Judicial District since 2005. Weld County Government oversees the financial
aspect of grants which includes the separation of duties and a multiple review
process.

Immediate contact with domestic violence victims is crucial to effectively
prosecute the defendants in these cases whose victims may later recant the
seriousness of the violence. The Misdemeanor Domestic Violence Fast Track
Progra and Felony DV Program both have immediate contact with domestic
violence victims through DA Office Victim Assistants. Immediate contact with
victims is essential to properly address bond conditions, mandatory protection
orders, explain victim's rights in the criminal justice system and give referrals for
resources.

The Greeley metropolitan statistical area, which encompasses all of Weld, was
named the eighth fasted -growing metro area in the United States from July
2013 to July 2014, according to the population estimates, released today by the
U.S. Census Bureau.

Based on 2015 statistics kept by the Victim Witness Assistant Unit for grant
reports, 39.6% of the domestic violence cases filed in Weld County Courts
involved Hispanic or Latino victims and 5.8% of these victims were Spanish
speaking only. These victims are served by two bi-lingual Victim Witness
Assistants that are requested in this application. Weld County also has a
refugee population who speak mostly limited or no English. We communicate
with the refugee population (in 2015 .8%) by use of interpreters or Language
Line.

Beginning January 1, 2015, the misdemeanor domestic violence cases began
to be filed in the four county court divisions instead of one dedicated DV
Courtroom. This necessitated the part time VW Intern position to be upgraded
to a full time VW Assistant which was accomplished 7-1-15 by receiving an
increase of funding by both Local VALE and the Weld County Government.
The VAWA funding percentage for the original part time position did not change
in this 2017 grant request.
Continuation Quality Assurance Plan Progress:

Weld County's Misdemeanor Domestic Violence Fast Track Program makes
initial contact with victims of domestic violence the morning after a domestic
violence arrest. Our Goal was to serve 441 victims in 2015 and actually served
546, 23% more than projected. The two Victim Assistants (one is Spanish-
bilingual) make initial contact with victims by phone, and/or in-person if the
victim attends the first bond hearing. During these initial contacts, the Victim
Assistants discuss safety concerns, resources, sentencing possibilities and plea
offers and collect victim input for the Deputy DA. It is imperative to the program
that police officers collect accurate victim contact information in order for the jail
to provide the VW Assistants a way to make initial contact with the victims. Our
Goal was to contact 70% of the victims the next day; we actually contacted 68%
of victims who had phone numbers listed (61 victims had no phone number
listed n the police report).
Our Goal was to serve 36 victims of felony domestic violence (3 Spanish
speaking). The Spanish bi-lingual Victim Assistant served 64 victims (77%
more than projected) 6 were Spanish speaking only. Our goal was to have
initial contact with 68% of victims prior to the Advisement hearing; we actually
had 73% contact with victims.
The grant goal is to have an 80% approval rate of survey returned by domestic
violence victims. The overall approval rating by domestic violence victims was
89%.

Grant dollars are being requested for the District Attorney's Office Victim
Witness Assistance Program to partially fund three Victim Assistants who
support and assist victims of domestic violence throughout the criminal justice
system.
Victim Assistants help reduce the overwhelming feelings victims many times
have by emotionally supporting victims, educating victims about the court
system, and providing the many referrals a victim needs when faced with
becoming a victim of domestic violence. The Victim Assistants working in the
District Attorney's Office are the first victim assistance contact the victim has
had with a law enforcement agency. The grant funding will provide assistance to
771 domestic violence victims in 2017: 719 misdemeanor and 52 felony.

The funding requested in this grant will enable the Weld County District
Attorney's Office to continue their proactive, immediate contact with victims of
domestic violence. The MISDEMEANOR DOMESTIC VIOLENCE FAST
TRACK PROGRAM was instituted in 2005 and provides immediate victim
assistance contact (the day after the crime) giving resources and Criminal
Justice System education to those most vulnerable. Victims of FELONY
DOMESTIC VIOLENCE CASES also come to court the day after the crime, but
prior to 2008, we had no process in place to know a new felony domestic
violence case was scheduled for an initial court hearing. These victims would sit
in crowded courtrooms with no one to answer their questions unless a Victim
Assistant happened to be in the courtroom for another matter. In 2008, we
received a VOCA Grant to fund part of one Victim Assistant to be assigned to
the victims of felony domestic violence. A process was created to identify all
new felony domestic violence cases on the docket each day to provide
immediate contact,support, and VRA and criminal justice system education.

The 19th Judicial District Attorney's Office will provide effective assistance to
victims of domestic violence by providing Victim's Rights information and
education, Victim Compensation information, referral to community services,
updates on the status of the prosecution and support throughout the court
process. The support and services provided should give these results: Victims
felt their contact with the court system was positive under the circumstances;
victims felt their Victim Assistant was accessible by phone; victims felt that they
received adequate explanation of what would happen at court hearings; victims
were aware of their victim rights at each critical stage of the court process and
supported by a Victim Assistant whenever they came to a court hearing; victims
were given referrals to community agencies, victims were told about Victim
Compensation and were assisted in completing applications by their Victim
Assistant. Client Survey giving the victim options to rate services from "Very
Satisfied" to "Very Unsatisfied", overall experience from "Very Good" to "Very
