RECEIVED DEC 0 8 2016 WELD COUNTY COMMISSIONERS Wow, just read in the local paper that at the last meeting the commissioners eliminated the requirement for companies to go through public hearings on any new projects, even for drilling in residential areas! What is wrong with you people?!!! Do you even live in this area, though I know it's a requirement, will your neighborhood be affected? Do you have children that you want to raise in a healthy, clean environment? These things mentioned can be obtained with CLEAN ENERGY! Your practices sound shady and tied to the oil industry. Pretty sure the industry can be successful without the county allowing them full access with no regard to the environmental impacts of our communities. I am outraged and frankly frightened by your actions. I have never attended a 9 a.m. Monday or Wednesday meeting, frankly who can? I have a job that does not allow the luxury of keeping my ELECTED officials in check. I elect my officials with the understanding they are looking out for myself and my family, not the oil industry! I believe in the electoral process and will be voting AGAINST all of the board members who have created this scary opportunity for the oil companies to have FREE reign in my community! SHAME ON YOU! Your email addressed to the County Commissioners sent on December 8, 2016 was forwarded to my attention. First off, thank you for your interest in the County's new oil and gas rules. The County Commissioners and staff spent a year working on the new rules and unfortunately the recent articles in the Greeley Tribune lacked a lot of details and specifics which I hope to clarify in my email. To give a little context, oil and gas production has been a Use By Right in Weld County. When oil and gas operations were classified as a use by right, most permitting was handled by the Colorado Oil and Gas Conservation Commission (COGCC). Beginning In the 1990s, conflicts between the COGCC and the County began to surface because the COGCC was inserting themselves into traditional county - held land -use matters such as siting, setbacks and flood plain administration - going beyond "down hole" regulation and trying to regulate surface issues, which is the job of the county. The problem with the setback regulations, for example, pushed oil and gas facilities into the middle of agricultural fields taking valuable land out of production and harming surface -owner rights. In 2015, the Commissioners, Planning Department staff and diversified stakeholders set out to revise county code to establish three primary goals relating to oil and gas production in Weld County: one, ensure surface private property owner's rights are not infringed upon and they have more of a determination as to the operations occurring on their property; two, to ensure local land use authority is not usurped by a state agency; and three provide certainty to oil and gas operators with regard to regulation of the surface. The result was the development of the Weld Oil and Gas Location Assessment (WOGLA). It's important to point out that a WOGLA is required in every zone district. The WOGLA establishes a more robust notification process on the front end of the state process. This notification process involves the surrounding building -unit owners and forces operators to certify they have reached an agreement with the surface owner on a proposed oil and gas location. Following the notice requirements, the operator files a WOGLA with the planning department. The standards embedded in WOGLA require oil and gas operators to demonstrate how operations wilt mitigate noise, lighting, dust, drainage, etc. The WOGLA process is handled administratively and the County's full-time Oil and Gas Liaison will review the WOGLA. Comment and concerns from the public will be taken by the liaison and if solutions or compromises can be agreed upon, the application is approved and moves on to the state permitting process . If there is disagreement, the application is forwarded to the Board of County Commissioners for a public hearing. Oil and gas operators will not enjoy any more freedoms in February, when the county's WOGLA process goes into effect, than they do now. In fact, operators will have to put in more effort prior to drilling than the county has ever made them do in the past — they will have to comply with the WOGLA. Surface owners and residents will not be left out of the process when it comes to where oil and gas locations are sited within the county. In fact, they can be more involved than ever with the process because of the WOGLA. 1 Staff is currently finalizing the WOGLA application and once the Commissioners have reviewed the application it will be available on the County's website.
