RE: ACCEPT PETITION AND AUTHORIZE VACATION OF A PORTION OF COUNTY
ROAD 61 - ROBERT AND RODNEY WILSON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on September 21, 2015, the Board was presented with a Road Petition from
Robert and Rodney Wilson, 37900 County Road 61, Eaton, Colorado 80615, a copy of said
petition and a list of the adjoining property owners marked Exhibit A, being attached hereto and
included by reference, requesting vacation of a portion of right-of-way for County Road 61, being
more fully described as follows:
The portion of Public Road Right-of-Way situated in
the of Section 25, Township 7 North, Range 64 West
and in the W1/2 of Section 30, Township 7 North,
Range 63 West of the 6th P.M., Weld County,
Colorado, more particularly described in Exhibit B.
WHEREAS, at said meeting the Board deemed it advisable to continue the matter to
November 23, 2015, to allow the neighbors adequate time to decide if they want to deed the
60-foot right-of-way to the County, and
WHEREAS, on November 23, 2015, the Board deemed it advisable to continue said
matter to January 11, 2016, to allow the petitioner additional time to work with the neighbors.
WHEREAS, any persons owning dedicated and recorded easements and rights-of-way
for the use of the right-of-way to be vacated, if any, may continue such use after formal vacation
by Weld=County, and
WHEREAS, the Department of Public Works has recommended approval of said request
since that portion of right-of-way is not needed for the safety and welfare of the traveling public,
with the condition that a Deed of Dedication be provided to Weld County for the County Road 61
Right-of-Way at County Road 61's present physical location, south of County Road 78, and
WHEREAS, the Board of County Commissioners heard testimony and reviewed all other
i evidence presented therein by staff and the public, and
WHEREAS, the evidence showed that the vacation of that portion of right-of-way which is
described above will not leave any land adjoining the roadway without an established public road
or private access easement connecting the land with another established public road, and
WHEREAS, the Board of County Commissioners deems it advisable to vacate said portion
of road right-of-way, with said vacation to become effective upon recording as required below.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Road Petition from Robert and Rodney Wilson be, and hereby is,
accepted.
BE IT FURTHER RESOLVED by the Board that the portion of right-of-way which is
described above be, and hereby is, vacated, conditional upon submittal of a Deed of Dedication
to Weld County for acceptance of the County Road 61 Right -of -Way at County Road 61's present
physical location, south of County Road 78.
BE IT FURTHER RESOLVED by the Board that any persons owning dedicated and
recorded easements and rights -of -way for the use of the vacated right-of-way, if any, shall not be
affected by the right-of-way vacation authorized herein.
BE IT FURTHER RESOLVED by the Board that Weld County shall retain any mineral
interests it may possess in the area of the vacated right-of-way and that the vacation authorized
herein shall in no away affect such mineral interests.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to record this Resolution and the attached Exhibits A and B in the records of the Weld
County Clerk and Recorder.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of January, A.D., 2016.

A portion of a Weld County Road Right of Way being vacated, situate in the East Half (E1/2) of
Section Twenty-five (25), Township Seven North (T.7N.), Range Sixty-four West (R.64W.) and in
the West Half (W1/2) of Section Thirty (30), Township Seven North (T.7N.), Range Sixty-three
West (R.63 W.), both of the Sixth Principal Meridian (6h P.M.), County of Weld, State of Colorado,
and more particularly described as follows:
COMMENCING at the Southeast corner of said Section 25, as monumented by a No. 6 rebar with
a 3-1/4" Aluminum Cap stamped LS22098, and assuming the East line of the Southeast Quarter of
said Section 25 as bearing North 01°32'55" East a distance of 2649.39 feet, the East Quarter corner
of said Section 25 being monumented by a No. 6 rebar with a 3-1/4" Aluminum Cap stamped
LS22098;
THENCE North 87°04' 14" East along the South line of the Southwest Quarter of said Section 30 a
distance of 30.41 feet to a line parallel with and 30.00 feet Easterly of, as measured at a right angle
to the center line of an existing county maintained roadway;

Ladies and Gentlemen,
My name is Stephanie K. Watson and I am the Broker/Owner of Colorado Land Associates (CLA). CLA is
a farm and ranch real estate company holding offices in Greeley, CO. I am acting as the Agent for Robert and
Rodney Wilson.
The reason in writing this letter is to explain the proposed road vacation. Recently it was discovered that
back in history when WCR 61was constructed between WCR 76 and WCR 78 the proposed road vacation veered
Westerly as the road passed between Section 30 and Section 25.
Historically shown the property has been considered part of the Wilson's property. Currently Section 30
has farm improvements and irrigation improvements on Section 25.The parties on both side of the proposed road
vacation have transferred the Title to match the center line of the existing road which also known as WCR 6I.This
transfer on the proposed road vacation will clean up the Records and will resolve any further Title issues that may
arise in the future.
The Existing County Road Right away granted by Patton on the section line passes through Wilson's
property. The County now has a Prescriptive Right of Away existing along the current location of the road known as
WCR 61 and should have no further need to maintain the Right of Way that passes entirely through Wilson's
property along Section line 30.
